CALL TO ORDER A rescheduled Regular Meeting of the San Luis Obispo City Council was called to order on January 10, 2023 at 5:40 p.m. in the Council Chambers, 990 Palm Street, San Luis Obispo, by Mayor Stewart, with Vice Mayor Marx participating via teleconference. 2. PLEDGE OF ALLEGIANCE Council Member Pease led the Council in the Pledge of Allegiance. CITY MANAGER REPORT City Manager Derek Johnson provided a report on the storm activities over the past two days. 3. BUSINESS ITEM 3.a APPROVAL OF EMERGENCY SERVICES DIRECTOR PROCLAMATION NO. 1 (2023 SERIES) Emergency Services Director Derek Johnson provided a situational update and responded to Council questions. Public Comments: None ---End of Public Comment--- Motion By Council Member Shoresman Second By Council Member Pease 2 Adopt Resolution No. 11382 (2023 Series) entitled, "A Resolution of the City Council of the City of San Luis Obispo, California, confirming the Emergency Services Director’s Proclamation of existence of a Local Emergency." Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 4. PUBLIC COMMENT PERIOD FOR ITEMS NOT ON THE AGENDA Public Comment: None --End of Public Comment-- 5. CONSENT AGENDA Council Member Pease requested that Item 5c be pulled from the Consent Agenda. Vice Mayor Marx requested that Item 5d be pulled from the Consent Agenda. Motion By Council Member Pease Second By Council Member Francis To approve Consent Calendar Items 5a and 5b. Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 5.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 5.b MINUTES REVIEW - DECEMBER 9, 2022 AND DECEMBER 13, 2022 COUNCIL MINUTES Approve the following minutes of the City Council: • December 9, 2022 - Special Meeting • December 13, 2022 - Special Meeting 3 5.c COUNCIL LIAISON SUBCOMMITTEE ASSIGNMENTS FOR 2023 Motion By Council Member Pease Second By Vice Mayor Marx Approve the Council Liaison Subcommittee assignments for the 2023 calendar year with the following changes to the document: • For 2022, under the Homeless Services Oversight Committee, move Council Member Pease to Member and Vice Mayor Christianson to Alternate. • Under the Special Purpose Subcommittees, County/Regional, and Ad Hoc Subcommittee sections, change the headings from Chair and Member to Member and Alternate. Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 5.d AUTHORIZATION TO ADOPT A RESOLUTION APPROVING THE CITY OF SAN LUIS OBISPO’S PARTICIPATION IN SAN LUIS OBISPO COUNTY’S REGIONAL DESAL PLANNING EFFORTS Motion By Council Member Pease Second By Council Member Shoresman 1. Authorize the City to be included in the San Luis Obispo County’s preliminary scoping and planning efforts to develop a Regional Desalination Executable Solution and Logistics (DESAL) Plan; and 2. Adopt Resolution No. 11383 (2023 Series) entitled, “A Resolution approving City of San Luis Obispo participation in the San Luis Obispo County Regional Desalination Executable Solution and Logistics (DESAL) Plan”; and 3. Find the action exempt from the California Environmental Quality Act (CEQA). Ayes (4): Council Member Francis, Council Member Pease, Council Member Shoresman, and Mayor Stewart Noes (1): Vice Mayor Marx 4 CARRIED (4 to 1) 6. PUBLIC HEARING AND BUSINESS ITEMS 6.a REISSUANCE OF CONDUIT FINANCING FOR THE HOUSING AUTHORITY OF THE CITY OF SAN LUIS OBISPO FOR THE ACQUISITION AND REHABILITATION OF 172 AFFORDABLE HOUSING UNITS LOCATED IN THE CITY (Estimated Time: 15 minutes) Assistant Planner Owen Goode provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- Motion By Vice Mayor Marx Second By Council Member Francis 1. Conduct a public hearing under the Tax Equity and Fiscal Responsibility Act (TEFRA) of 1982 and pursuant to the requirements of the Internal Revenue Code of 1986, as amended; and 2. Adopt Resolution No. 11384 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, adopting the Reissuance of a Tax-Exempt Note by the Housing Authority of San Luis Obispo” allowing the reissuance of a tax- exempt obligation by the Housing Authority of the City of San Luis Obispo (HASLO), for the purpose of providing financing for the acquisition and rehabilitation of various multifamily rental housing facilities located in the City (the “Project”), in order to preserve existing affordable housing; such adoption of the resolution is solely for the purposes of satisfying the requirements of TEFRA, the Code, and the California Government Code Section 6500 et seq. Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 5 6.b 2023-25 FINANCIAL PLAN PROCESS, ECONOMIC OUTLOOK, BUDGET POLICIES, AND CAPITAL IMPROVEMENT PLAN REVIEW (Estimated Time: N/A) Motion By Mayor Stewart Second By Council Member Shoresman To continue the item to the City Council Adjourned Meeting on January 12, 2023 at 5:30 p.m. in Council Chambers. STUDY SESSION 7.a STUDY SESSION ON THE URBAN FORESTRY PROGRAM (Estimated Time: N/A) Motion By Mayor Stewart Second By Council Member Shoresman To continue the item to the City Council Adjourned Meeting on January 12, 2023 at 5:30 p.m. in Council Chambers. ADJOURNMENT The meeting was adjourned at 6:59 p.m. The City Council will hold an Adjourned Meeting on January 12, 2023 at 5:30 p.m. in the Council Chambers at City Hall.
