City Attorney Christine Dietrick indicated that the Council met in closed
session and no reportable action was given.

2. CALL TO ORDER
A Regular Meeting of the San Luis Obispo City Council was called to order on
February 7, 2023 at 5:45 p.m. in the Council Chambers, 990 Palm Street, San
Luis Obispo, by Mayor Stewart.

Vice Mayor Jan Marx led the Council in the Pledge of Allegiance.

4.a WATER RESOURCE RECOVERY FACILITY PROJECT UPDATE
Utilities Director Aaron Floyd and Utilities Deputy Director of Engineering
& Planning Miguel Barcenas provided a brief update on the Water
Resource Recovery Facility (WRRF) Project.
4.b CITY MANAGER REPORT
City Manager Derek Johnson provided a report on upcoming projects.

6.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES
Waive reading of all resolutions and ordinances as appropriate.

JANUARY 26, 2023 COUNCIL MINUTES
Approve the following minutes of the City Council:
• January 12, 2023 - Adjourned Meeting

6.c AUTHORIZATION TO ADVERTISE SAN LUIS OBISPO CREEK BANK
REPAIR PROJECT, SPECIFICATION NO. 1000035
1. Approve the project plans and specifications for the San Luis Obispo
Creek Bank Repair Project, Specification No. 1000035; and
2. Authorize staff to advertise for bids; and
3. Authorize an appropriation of $1,500,000 from the Capital Projects
Reserve Fund to the project account (1000035); and
4. Authorize the City Manager to award the Construction Contract for the
bid total if the lowest responsible bid is within the Engineer’s Estimate
of $1,140,000; and
5. Authorize the City Engineer to approve Contract Change Orders up to
the available project budget; and
6. Adopt Resolution No. 11388 (2023 Series) entitled, “A Resolution of
the City Council of the City of San Luis Obispo, California, approving
the Mitigated Negative Declaration for the San Luis Creek Bank Repair
Project” adopting the final Initial Study – Mitigated Negative
Declaration (IS-MND); and
7. Adopt Resolution No. 11389 (2023 Series) entitled, “A Resolution of
City Council of the City of San Luis Obispo, California, authorizing use
of Capital Projects Reserve Fund to support the San Luis Obispo
Creek Bank Repair Project, Specification No. 1000035.”
6.d AUTHORIZATION TO ADVERTISE NORTH BROAD STREET
NEIGHBORHOOD PARK PROJECT, SPECIFICATION NO. 91683
1. Approve the project plans and special provisions for the North Broad
Street Neighborhood Park, Specification Number 91683; and
2. Authorize staff to advertise for bids; and
3. Authorize the City Manager to award the construction contract for the
bid total if the lowest responsible bid is within the engineer’s estimate
of $775,000; and
4. Authorize the City Engineer to approve Contract Change Orders up to
the available project budget; and
5. Authorize an appropriation of $200,000 from the Capital Projects
Reserve Fund to the project account (91683); and
6. Authorize the Finance Director to return unspent Capital Reserve funding
to the Capital Projects Reserve Fund balance after project completion;
7. Adopt Resolution No. 11390 (2023 Series) entitled, “A Resolution of
City Council of the City of San Luis Obispo, California, authorizing use
of Capital Projects Reserve Fund to support the North Broad Street
Neighborhood Park, Specification Number 91683.”

Utilities Director Aaron Floyd responded to Council questions.

Vice Mayor Marx indicated, for the record, that she is not in support of the
project and her ‘Yes’ vote was just to receive and file the report.

Receive and file an update related to the City’s timing and strategy for
maximization of recycled water.

7. PUBLIC HEARING AND BUSINESS ITEMS
7.a FISCAL YEAR 2022-23 MID-YEAR BUDGET REVIEW

Finance Director Emily Jackson and Budget Analyst Natalie Harnett
provided an in-depth staff report and responded to Council questions.

Motion By Vice Mayor Marx
Second By Council Member Francis
1. Receive the Mid-Year Budget report based on revised projections for
all major funds at the mid-point of the 2022-23 fiscal year; and
2. Adopt Resolution No. 11391 (2023 Series) entitled, “A Resolution of
the Council of the City of San Luis Obispo, California, approving
amendments to the adopted 2022-23 Budget Appropriations” and
approve the one-time allocations as stated in the Mid-year Budget
Report with the following change:
SECTION 4. The City will make a $2,437,211 additional
discretionary payment to CalPERS.

3. Provide direction on whether the one-time budget allocations from the
2021-23 Financial Plan listed in Attachment A – Appendix B should be
considered as ongoing expense and included in the base budget for
2023-25.
Council continued discussion on Appendix B to a date certain,
the February 11, 2023 Special Meeting.

8. STUDY SESSION
8.a STUDY SESSION: HOMELESSNESS RESPONSE STRATEGIC PLAN

Community Development Director Michael Codron, Acting Homelessness
Response Manager Daisy Wiberg, and Housing Policy & Programs
Manager Teresa McClish provided an in-depth staff report and responded
to Council questions.

ACTION: The Council provided direction on the City’s Draft Strategic Plan
Framework for the City’s first Homelessness Response Strategic Plan.
9. LIAISON REPORTS AND COMMUNICATIONS
Council Member Francis, Council Member Shoresman, and Mayor Stewart
attended New Mayor and Council Member conference paid for by the City.
Vice Mayor Marx indicated the IWMA is holding a tour of the Cold Mountain
Canyon landfill. She also attended a tour of the pallet housing in Grover Beach.
Council Member Pease participated in the Cal Cities quarterly Environmental
Quality Committee meeting and the Water Resources and Quality Committee
meeting last week.
Mayor Stewart will attend the Cal Cities African American Caucus meeting on
Monday.

10. ADJOURNMENT
The meeting was adjourned at 9:41 p.m. The City Council will hold a Special
Meeting on Saturday, February 11, 2023 at 8:30 a.m. in the Council Chambers at
City Hall. The purpose of this Special Meeting is to hold a Goal Setting Workshop
for development of Major City Goals for the 2023-25 Financial Plan.
The City Council will hold a Special Closed Session Meeting on Wednesday,
February 15, 2023 at 5:30 p.m. at City Hall, 990 Palm Street, San Luis Obispo.
The next Regular Meeting of the City Council will be held on February 21, 2023
at 5:30 p.m. in the Council Chambers at City Hall, 990 Palm Street, San Luis
Obispo.
