CLOSED SESSION: STARTS AT 4:30 PM 1.a CALL TO ORDER Mayor Erica A. Stewart called the Closed Session to order at 4:30 PM in the Finance & IT Conference Room located in City Hall, 990 Palm Street, San Luis Obispo with all members present. 1.b PUBLIC COMMENT FOR CLOSED SESSION ITEMS ONLY Public Comments: None ---End of Public Comment--- 1.c CONFERENCE WITH REAL PROPERTY NEGOTIATORS City Attorney Christine Dietrick indicated there was no reportable action taken on this item. 1.d ADJOURNMENT Closed Session was adjourned at 5:15 PM to the Regular Meeting of the City Council. 2. CALL TO ORDER A Regular Meeting of the San Luis Obispo City Council was called to order on May 2, 2023 at 5:30 p.m. in the Council Chambers, 990 Palm Street, San Luis Obispo, by Mayor Stewart. 1 3.PLEDGE OF ALLEGIANCE Council Member Andy Pease led the Council in the Pledge of Allegiance. 4.PRESENTATIONS 4.a NATIONAL TOURISM WEEK PROCLAMATION AND CALIFORNIA TOURISM MONTH PROCLAMATION Mayor Stewart presented a proclamation declaring the week of May 7 - 13, 2023 as "National Travel and Tourism Week" and the month of May as "California Tourism Month" to Lydia Bate, Vice Chair of the Tourism Business Improvement Board. 4.b PUBLIC SERVICE APPRECIATION WEEK PROCLAMATION Mayor Stewart presented a proclamation declaring the week of May 7 - 13, 2023 as "Public Service Appreciation Week" to Jesus Nolasco, President of PACE on behalf of City of San Luis Obispo employees. 4.c PROCLAMATION HONORING DETECTIVE LUCA BENEDETTI & DETECTIVE STEVE OROZCO AND DEDICATION OF A FREEWAY SIGN FOR THE BRIDGE AT BUENA VISTA AND HWY 101 HONORING DETECTIVE LUCA BENEDETTI Mayor Stewart presented a proclamation in honor of Detective Luca Benedetti & Detective Steve Orozco. The City Council also accepted the dedication of a memorial freeway sign for the bridge at Buena Vista and Hwy 101 honoring Detective Luca Benedetti. At 5:50 p.m., Mayor Stewart announced that Council would break for a short reception in the Council Hearing Room. 4.d CITY MANAGER REPORT City Manager Derek Johnson provided a report on upcoming projects. 5. Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 6.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 6.b MINUTES REVIEW -APRIL 6, 2023 AND APRIL 18, 2023 COUNCIL MINUTES Approve the following minutes of the City Council: April 6, 2023 -Special Meeting April 18, 2023 - Regular Meeting 6.cREVIEW OF A MILLS ACT HISTORICAL PROPERTY CONTRACT FOR THE CALL HOTEL AT 1703 SANTA BARBARA AVENUE (HIST-0616- 2022) As recommended by the Cultural Heritage Committee, adopt Resolution No. 11416 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California,approving a Historic Property Preservation Agreement between the City and the owner of the Call Hotel at 1703 Santa Barbara Avenue (Application No. HIST-0616-2023)” under the terms described in the draft agreement. 6.d RECEIVE THE CARBON NEUTRAL CITY FACILITIES PLAN, FLEET ELECTRIFICATION ROADMAP, AND THE ELECTRIC VEHICLE INFRASTRUCTURE ROADMAP Receive and file the Carbon Neutral City Facilities Plan, the Fleet Electrification Roadmap, and the Electric Vehicle Infrastructure Roadmap. 6.e CONSIDERATION OF THE 2022-23 HUMAN SERVICES GRANT FUNDING RECOMMENDATIONS FROM THE HUMAN RELATIONS COMMISSION 3 Vice Mayor Marx indicated thather husband is anunpaid volunteer for City Farm which received a grant. However, there is no conflict of interest so she will not be recusing herself from this item. 1.As recommended by the Human Relations Commission, approve the 2022-2023 Human Services Grants funding allocations in the amount of $150,000; and 2. Authorize the City Manager to execute agreements with each grant recipient. 7. STUDY SESSION 7.a STUDY SESSION: DIVERSITY, EQUITY, AND INCLUSION PROGRAM UPDATE AND STRATEGIC PLAN FRAMEWORK Deputy City Manager Greg Hermann and Diversity, Equity, and Inclusion Manager Nestor Veloz-Passalacqua provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- ACTION: The City Council provided the following consensus comments: Vision is appropriate but a little wordy. They like the four pillars and categories. Goal statements within each pillar could be a little more to the point and approachable. Community Development and Support goal to promote awareness and inclusion is a little bit passive. Love the grant program but there might be gaps. Adaptability and Sustainability is a little hard to measure. When do we know this is sustainable, needs to be fleshed out more. Look at the passive language. Public engagement should also include one on one engagement. You can’t over-communicate. 8. PUBLIC HEARING AND BUSINESS ITEMS 4 8.aINTRODUCE TWO (2) ORDINANCES AMENDING THE ZONING MAP AND AMENDING MUNICIPAL CODE CHAPTER 9.10 FOR THE CANNABIS BUSINESS PROGRAM AND ADOPT A RESOLUTION UPDATING THE MERIT CRITERIA FOR COMMERCIAL CANNABIS OPERATOR PERMIT APPLICATIONS Community Development Director Michael Codron and Cannabis Business Coordinator Alex Fuchs provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- Motion By Council Member Pease Second By Council Member Francis 1. As recommended by the Planning Commission, introduce Ordinance No. 1727 (2023 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, amending the City’s Zoning Map to expand the Cannabis Business Overlay Zones where cannabis businesses may be located as may be allowed or conditionally allowed by the underlying base zones and the rules and regulations established in the City’s Municipal Code (RZ-0118-2023)”; and 2. Introduce Ordinance No. 1728 (2023 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, amending Chapter 9.10 (Cannabis Regulations) of the Municipal Code adding requirements for owners that lease real property to commercial cannabis operators (CODE-0164-2023)”; and 3. Adopt Resolution No. 11417 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, approving updates to the cannabis operator permit ranking criteria.” Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 5 8.bENDORSEMENT OF THE DIVERSITY, EQUITY, AND INCLUSION UPDATE TO THE PUBLIC ENGAGEMENT AND NOTICING MANUAL Deputy City Manager Greg Hermann and Public Communications Manager Whitney Szentesi provided an in-depth staff report and responded to Council questions. Public Comments: Gerri Clemens ---End of Public Comment--- Motion By Vice Mayor Marx Second By Council Member Shoresman To endorse the updated Public Engagement and Noticing Manual to serve as a strategic guide for staff to increase diverse participation in City programs, projects and policy decisions. Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 8.c AMENDMENTS TO THE COUNCIL POLICIES AND PROCEDURES MANUAL TO IMPLEMENT HYBRID CITY COUNCIL MEETINGS (AB 2449) (Estimated Time: 45 minutes) City Clerk Teresa Purrington provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- Motion By Council Member Shoresman Second By Vice Mayor Marx Adopt Resolution No. 11418 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, establishing policies and procedures for compliance with Assembly Bill 2449 relating to teleconference participation in Legislative Meetings” which would implement hybrid City Council meetings. 6 Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 9.LIAISON REPORTS AND COMMUNICATIONS Vice Mayor Marx attended the Earth Day celebration in Laguna Lake Park, presented at the SLO Film Festival, attended Channel Counties League dinner, and the Fire Fighters picnic. the Holocaust remembrance in Atascadero. Council Member Francis attended the Police Department promotions ceremony, took a Food Bank tour, and toured the Grizzly Academy. She also attended the Nacimiento Commission meeting. Council Member Pease attended SCLC monthly meeting regarding their strategic planning. She also announced that on May 11 the Latino Outreach Council was holding a town hall meeting. Council Member Shoresman attended the Earth Day celebration in Laguna Lake Park, the Channel Counties dinner, and the Construction Board of Appeals meeting. She announced SLO High was holding a bike breakfast tomorrow (May 3) at 7:00 a.m. Mayor Stewart also attended the Channel Counties dinner. She congratulated Sam Andrews the new ASI President, and Jack Stever the new ASCC President. Friday is the grand opening of the Frost Building at Cal Poly. 10. ADJOURNMENT The meeting was adjourned at 10:16 p.m. The City Council will hold a Special Closed Session Meeting on Tuesday, May 9, 2023 at 5:30 p.m. in the Council Hearing Room at City Hall. The next Regular Meeting of the City Council will be held on May 16, 2023 at 5:30 p.m. in the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo. APPROVED BY COUNCIL: 05/16/2023 7
