CLOSED SESSION: STARTS AT 4:30 PM 1.a CALL TO ORDER Mayor Erica A. Stewart called the Closed Session Meeting of the San Luis Obispo City Council to order at 4:30 p.m. in the Council Hearing Room at City Hall, 990 Palm Street, San Luis Obispo with Vice Mayor Marx attending virtually. 1.b PUBLIC COMMENT FOR CLOSED SESSION ITEMS ONLY Public Comments: None ---End of Public Comment--- 1.c CONFERENCE WITH REAL PROPERTY NEGOTIATORS (APN 053-012-028 & 020) ACTION: City Attorney Christine Dietrick indicated no reportable action was taken. 1.d CONFERENCE WITH LABOR NEGOTIATORS ACTION: City Attorney Christine Dietrick indicated no reportable action was taken. 1.e ADJOURNMENT The City Council adjourned the Closed Session at 5:40 p.m. to the Regular Meeting of the City Council on June 6, 2023 at 5:30 p.m. in the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo. 2 2. CALL TO ORDER A Regular Meeting of the San Luis Obispo City Council was called to order on June 6, 2023 at 5:45 p.m. in the Council Chambers, 990 Palm Street, San Luis Obispo, by Mayor Stewart, with all Council Members present except for Vice Mayor Marx, who participated virtually. 3. PLEDGE OF ALLEGIANCE Mayor Stewart led the Council in the Pledge of Allegiance. 4. PRESENTATIONS 4.a INTRODUCTIONS - NICOLE VERT, FIRE DEPARTMENT ADMINISTRATIVE ANALYST, AND SAMMY FOX, DEPUTY FIRE CHIEF Fire Chief Todd Tuggle introduced Nicole Vert, Administrative Analyst, and Sammy Fox, Deputy Fire Chief. 4.b HUNGER AWARENESS DAY PROCLAMATION Mayor Stewart presented a proclamation declaring June 2, 2023, as "Hunger Awareness Day" to Garret Olson on behalf of the San Luis Obispo Food Bank. 4.c PRIDE MONTH PROCLAMATION Mayor Stewart presented a proclamation declaring the month of June as "Pride Month" to Elissa DeHart and Dusty Colyer-Worth on behalf of the Gala Pride and Diversity Center. 4.d CITY MANAGER REPORT City Manager Derek Johnson provided a report on upcoming projects. 5. Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 6.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 6.b MINUTES REVIEW - MAY 9, 2023 AND MAY 16, 2023 COUNCIL MINUTES Approve the following minutes of the City Council: • May 9, 2023 - Special Closed Session Meeting • May 16, 2023 - Regular Meeting 6.c SECOND READING OF ORDINANCE NO. 1729 (2023 SERIES) TO REPEAL AND REPLACE MUNICIPAL CODE TITLE 16 (SUBDIVISION REGULATIONS) TO APPROVE A COMPREHENSIVE UPDATE TO THE SUBDIVISION REGULATIONS Adopt Ordinance No. 1729 (2023 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, repealing Title 16 (Subdivision Regulations) of the Municipal Code in its entirety and introducing and adopting a replacement Title 16 to include recommended updates and amendments as reflected in the attached Exhibit A” (CODE- 0155-2023). 6.d AMENDMENT NO. 1 TO THE ENHANCED EMERGENCY SERVICES AGREEMENT WITH CALIFORNIA POLYTECHNIC STATE UNIVERSITY Authorize the City Manager to execute Amendment No 1. to the Enhance d Emergency Services Agreement with California Polytechnic State University (Cal Poly), approving a one-year extension (July 1, 2023, until June 30, 2024) to the existing agreement. 4 6.e AUTHORIZATION TO CONTINUE THE COLLECTION OF MULTI- DWELLING PROPERTY FIRE AND LIFE SAFETY INSPECTION FEES Adopt Resolution No. 11424 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, authorizing the San Luis Obispo County Auditor to collect fees for 2023 -24 Fire and Life Safety Inspections of Multi-Dwelling Properties containing three or more dwelling units on the Secured Property Tax Roll pursuant to California Government Section 54988, Et Seq.” 6.f AUTHORIZATION TO ADVERTISE FIRE STATION #1 FLEET MAINTENANCE ROOF, SPECIFICATION NO. 2000075-5.01 1. Approve the project plans and special provisions for the Fire Station #1 Fleet Maintenance Roof, Specification Number 2000075-5.01; and 2. Authorize staff to advertise for bids; and 3. Authorize the City Manager to award the construction contract for the bid total if the lowest responsible bid is within the engineer’s estimate of $250,000; and 4. Authorize a budget transfer of $63,563.00 from the City Hall Meeting Room Tenant Improvement project account (2000055) to the Fire Station #1 Fleet Maintenance Roof project account (2000075-05.01) 6.g ADVISORY BODY APPOINTMENTS - CULTURAL HERITAGE COMMITTEE AND TOURISM BUSINESS IMPROVEMENT DISTRICT BOARD Confirm the appointments of Benjamin Arrona to the Cultural Heritage Committee (CHC) and Sandy Sandoval to the Tourism Business Improvement District Board (TBID). 6.h APPROVE A FUNDING CONTRIBUTION AGREEMENT WITH THE COUNTY OF SAN LUIS OBISPO FOR BUCKLEY ROAD IMPROVEMENTS Adopt Resolution No. 11425 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, authorizing the City Manager to execute a Funding Contribution Agreement with the County of San Luis Obispo to fund Buckley Road Improvements” to contribute $230,000 in fees paid by the Avila Ranch development to San Luis Obispo County for Buckley Road transportation improvements. 5 6.i ADOPTION OF A RESOLUTION ACKNOWLEDGING RECEIPT OF A REPORT ON THE SAN LUIS OBISPO FIRE DEPARTMENT’S COMPLIANCE WITH CALIFORNIA HEALTH AND SAFETY CODE SECTIONS 13146.2 AND 13146.3 PURSUANT TO SENATE BILL 1205 Adopt Resolution No. 11426 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, acknowledging receipt of a report on the San Luis Obispo Fire Department’s compliance with California Health and Safety Code Sections 13146.2 and 13146.3 pursuant to Senate Bill 1205.” 7. PUBLIC HEARING AND BUSINESS ITEMS 7.a CONSIDERATION OF THE 2023-25 WATER RATES (Estimated Time: 20 minutes) Utilities Director Aaron Floyd and Utilities Administrative Analyst Shane Whittington provided an in-depth staff report and responded to Council questions. Receive and file the Comprehensive Water Rate Study, April 2023; and 2. Adopt Resolution No. 11427 (2023 Series) entitled “A Resolution of the City Council of the City of San Luis Obispo, California, establishing the Water Service Rates for Financial Plan 2023 -25” provided there is no majority protest against the proposed water rates; and 3. Find the action statutorily exempt from the California Environmental Quality Act (CEQA) under Public Resources Code 21083 and 21080(b)(8) and State CEQA Guidelines Section 15273 (Rates, Tolls, Fares, and Charges). Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 6 7.b CONSIDERATION OF THE 2023-25 SEWER RATES (Estimated Time: 20 minutes) Motion By Vice Mayor Marx Second By Council Member Shoresman 1. Receive and file the Comprehensive Sewer Rate Study, April 2023; and 2. Adopt Resolution No. 11428 (2023 Series) entitled “A Resolution of the City Council of the City of San Luis Obispo, California, establishing the Sewer Service Rates for Financial Plan 2023-25” provided there is no majority protest against the proposed sewer rates; and 3. Find the action statutorily exempt from the California Environmental Quality Act (CEQA) under Public Resources Code 21083 and 21080(b)(8) and State CEQA Guidelines Section 15273 (Rates, Tolls, Fares, and Charges). Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) At 8:30 p.m., Vice Mayor Marx announced that she would be leaving the meeting. 7.c ADOPTION OF THE 2023-25 FINANCIAL PLAN AND FISCAL YEAR 2023-24 BUDGET (Estimated Time: 90 minutes) Finance Director Emily Jackson and Principal Budget Analyst Natalie Harnett provided an in-depth staff report and responded to Council questions. Public Comments: Christian O'Neal Leann Standish ---End of Public Comment--- Vice Mayor Marx left the meeting at 8:30 PM Motion By Council Member Shoresman Second By Council Member Francis Adopt Resolution No. 11429 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, approving the 2023-25 Financial Plan and Fiscal Year 2023-24 Budget.” 7 Ayes (4): Council Member Francis, Council Member Pease, Council Member Shoresman, and Mayor Stewart Absent (1): Vice Mayor Marx CARRIED (4 to 0) 8. LIAISON REPORTS AND COMMUNICATIONS Council Member Pease announced that SLOCOG will adopt the final version of the regional transportation plan at their June 7, 2023 meeting. Council Member Shoresman attended several events including the HSOC meeting, the State of the City presentation at City Hall, and the ‘Textures’ opening event. Council Member Francis attended the Nacimiento Commission meeting, an Air Pollution Control District meeting, and a CAPSLO meeting. 9. ADJOURNMENT The meeting was adjourned at 10:17 p.m. The next Regular City Council Meeting is scheduled for June 20, 2023 at 5:30 p.m. in the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo.
