CLOSED SESSION: STARTS AT 5:00 PM 1.a CALL TO ORDER Mayor Erica A. Stewart called the Closed Session Meeting of the San Luis Obispo City Council to order at 5:00 PM in the Council Hearing Room at City Hall, 990 Palm Street, San Luis Obispo. 1.b PUBLIC COMMENT FOR CLOSED SESSION ITEMS ONLY Public Comments: None ---End of Public Comment--- 1.c CONFERENCE WITH REAL PROPERTY NEGOTIATORS (APN 002-436-022) Action: This item was pulled from the agenda and continued to the City Council meeting on October 17, 2023. 1.d CONFERENCE WITH REAL PROPERTY NEGOTIATORS (APNs 053-032-003, 004, 005) Action: City Attorney Christine Dietrick indicated that the Council met in Closed Session on one matter of real property negotiations. The Council provided direction on price and terms, and no other reportable action was taken. 1.e ADJOURNMENT 2 2. CALL TO ORDER A Regular Meeting of the San Luis Obispo City Council was called to order on October 3, 2023 at 5:30 p.m. in the Council Chambers, 990 Palm Street, San Luis Obispo, by Mayor Stewart. 3. PLEDGE OF ALLEGIANCE Council Member Shoresman led the Council in the Pledge of Allegiance. 4. PRESENTATIONS 4.a DATING AND DOMESTIC VIOLENCE AWARENESS MONTH PROCLAMATION Mayor Stewart presented a proclamation declaring the month of October as "Dating & Domestic Violence Awareness Month" to Police Chief Rick Scott and Courtney Taylor on behalf of Lumina Alliance. 4.b FIRE PREVENTION WEEK PROCLAMATION Vice Mayor Marx presented a proclamation declaring the week of October 8 - 14, 2023 as "Fire Prevention Week" to Fire Chief Todd Tuggle on behalf of the City of San Luis Obispo Fire Department. 4.c NATIONAL HISPANIC, LATINX, LATINO HERITAGE MONTH PROCLAMATION Council Member Pease presented a proclamation declaring September 15 to October 15, 2023 as "National Hispanic, Latinx, Latino Heritage Month" to Erica Ruvalcaba-Heredia on behalf of the Latino Outreach Council. 4.d MOBILITY SERVICES DIVISION AND BUSINESS MANAGER OVERVIEW Public Works Director Matt Horn, Deputy Director of Mobility Services Jennifer Rice, and Mobility Services staff provided an overview of the Mobility Services Division. 4.e CITY MANAGER REPORT City Manager Derek Johnson provided a report on upcoming projects. 3 5. Ayes (5): Council Member Francis, Council Member Pease (recused from item 6c), Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 6.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 6.b MINUTES REVIEW - SEPTEMBER 12, 2023 AND SEPTEMBER 19, 2023 COUNCIL MINUTES Approve the following minutes of the City Council: • September 12, 2023 - Special Closed Session Meeting • September 19, 2023 - Regular Meeting 4 6.c SECOND READING OF ORDINANCE NO. 1730 (2023 SERIES) TO ADOPT LOCAL AMENDMENTS TO THE CALIFORNIA ENERGY CODE Council Member Pease declared a conflict on this item and recused due to her employment in the building industry. 1. Adopt Ordinance No. 1730 (2023 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, adopting Local Amendments to Part 6 of the Building Construction and Fire Prevention Code, 2023,” to be codified under San Luis Obispo Municipal Code Chapter 15.04.060 – “Amendments – Energy Standards”; and 2. Direct staff to submit the approved local amendments and accompanying required submittal forms and information to the California Energy Commission to initiate the local amendments to California Energy Code review and approval process. Ayes (4): Council Member Francis, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart Recused (1): Council Member Pease CARRIED (4 to 0) 7. PUBLIC HEARING AND BUSINESS ITEMS 7.a FY 2022-23 YEAR END BUDGET REVIEW (UNAUDITED) Finance Director Emily Jackson and Policy and Project Manager Natalie Harnett provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- Motion By Vice Mayor Marx Second By Council Member Shoresman 1. Receive and file the Fiscal Year 2022-23 Year End Budget report; and 2. Adopt Resolution No. 11451 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, to delegate appropriation authority to the City Manager for California Integrated Waste Management Act of 1989 (AB939) and Senate Bill 1383 (SB1383) fees” compliant with the Fund Balance & Reserve Policy and corresponding legislation. Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 5 8. STUDY SESSION 8.a CODE ENFORCEMENT UPDATE Community Development Director Timmi Tway, Chief Building Official Michael Loew, and Code Enforcement Supervisor John Mezzapesa provided an in-depth staff report and responded to Council questions. Public Comments: Reagan Denny Olivia Momberg Tyler Coarey Barry Price ---End of Public Comment--- Action: By consensus, the City Council provided the following comments for staff on the Code Enforcement Division, no formal action was taken. 1. Careful balance, the goal is safe housing and compliance 2. Outreach, Brochure, and Meet CalPoly halfway 3. Follow up with notes from Stakeholder Meetings 4. Make sure to reach out to tenant groups and marginalized groups 5. Reach out Cuesta College 6. How to use Ask SLO Video? 9. LIAISON REPORTS AND COMMUNICATIONS Council Member Shoresman attended the Cal Cities Annual Conference, spoke at one of the Drive Electric Week events, and attended the ‘SLO City Day’ at the Cal Poly football game. Council Member Pease attended the Cal Cities Annual Conference, paid for by the City, and participated in the Electrify Your Life event. Council Member Francis attended the Cal Cities Annual Conference, paid for by the City, and attended the September Scramble. Mayor Stewart attended the Cal Cities Annual Conference, paid for by the City; attended the California Medical Association Dinner; met with Cal Poly ASI officers and team; attended the Women's Legacy Fund Luncheon; attended the Celebration of Life for Paso Robles Mayor Steve Martin; and the Labor Leaders Breakfast sponsored by Assemblymember Dawn Addis. Vice Mayor Marx attended the Cal Cities Annual conference, paid for by the City, the Air Pollution Control District meeting, and the IWMA meeting. 6 10. ADJOURNMENT The meeting was adjourned at 9:48 p.m. The next Regular Meeting of the City Council will be held on October 17, 2023 with Closed Session at 4:30 p.m. in the Council Hearing Room and the Regular Meeting at 5:30 p.m. in the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo.
