Stewart called the Closed Session Meeting of the San Luis Obispo City Council to order at 4:45 p.m. in the Council Hearing Room at City Hall, 990 Palm Street, San Luis Obispo. 1.b PUBLIC COMMENT FOR CLOSED SESSION ITEMS ONLY Public Comments: None ---End of Public Comment--- 1.c CONFERENCE WITH LABOR NEGOTIATORS ACTION: City Attorney Christine Dietrick reported that the City Council met regarding labor negotiations and there was no reportable action taken on this item. She also indicated that the Council continued the Closed Session to a date certain of September 26, 2023, at 6:00 p.m. in the Council Hearing Room, 990 Palm Street, San Luis Obispo. 1.d ADJOURNMENT 2. CALL TO ORDER A Regular Meeting of the San Luis Obispo City Council was called to order on September 19, 2023 at 5:35 p.m. in the Council Chambers, 990 Palm Street, San Luis Obispo, by Mayor Stewart. 2 3. PLEDGE OF ALLEGIANCE Vice Mayor Jan Marx led the Council in the Pledge of Allegiance. 4. PRESENTATIONS 4.a CITY MANAGER REPORT City Manager Derek Johnson provided a report on upcoming projects. 5. CONSENT AGENDA Vice Mayor Marx recused herself from Item 6d. Council Member Pease requested Item 6b be pulled from Consent. Motion By Vice Mayor Marx Second By Council Member Francis To approve Consent Calendar Items 6a, 6c and 6e to 6g. Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 6.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 6.c EQUIPMENT SURPLUS DESIGNATION AND AUTHORIZATION OF SALE OF WATER DISTRIBUTION, WASTEWATER TREATMENT, AND IRRIGATION ASSETS Authorize the designation and disposal of surplus items in accordance with the City’s policies and procedures as prescribed in the Financial Management Manual Sections, 480-A, and 480-B. 2 6.e FY 2023-24 GRANT APPLICATIONS FOR THE ALCOHOLIC BEVERAGE CONTROL AND BUREAU OF JUSTICE ASSISTANCE; AND ACCEPTANCE OF GRANT FUNDING FROM THE CALIFORNIA BOARD OF STATE AND COMMUNITY CORRECTIONS 1. Authorize staff to submit grant applications to the following entities: a. FY 2023-24 Department of Alcoholic Beverage Control – Office of Traffic Safety in an amount not to exceed $40,000. b. FY 2023-24 Edward Byrne Memorial Grant for $16,271. 2. Authorize staff to accept funding from the California Board of State and Community Corrections for an Officer Wellness and Mental Health Grant in the amount of $42,124.96; and 3. Adopt Resolution No. 11449 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, authorizing Grant Applications for funding provided through the Department of Alcoholic Beverage Control and the Office of Traffic Safety through the National Highway Traffic Safety Administration to increase education and enforcement programs focusing on underage drinking and authorizing the City Manager or their designee to execute all related grant documents”; and 4. If the grants are awarded, authorize the City Manager or their designee to execute grant related documents and authorize the Finance Director to make the necessary budget adjustments upon the award of the grant. 6.f AWARD CONSTRUCTION CONTRACT FOR FIRE STATION 1 FLEET MAINTENANCE ROOF PROJECT, SPECIFICATION NO. 2000075-5.01 1. Award a Construction Contract to Edwards Construction Group, Inc. in the amount of $348,290.86 for the Fire Station 1 Fleet Maintenance Roof Project, Specification Number 2000075-5.01; and 2. Approve the transfer $81,893 between Major Facilities Maintenance Account subprojects to support the project; and 3. Approve the transfer of $18,000 from the Local Sales Tax Fund Completed Projects Undesignated Capital Account to the project account (Spec. No. 2000075-5.01). 6.g AUTHORIZE THE CITY MANAGER TO EXECUTE AN AMENDMENT TO TRANSDEV’S AGREEMENT FOR HIRING INCENTIVES AND TERM EXTENSION 1. Approve the sole source procurement for transit operations and maintenance services; and 2. Authorize the City Manager to negotiate and execute an amendment to the transit operations and maintenance agreement with Transde v North America, formerly First Transit, to include hiring incentives and to extend the term of the agreement. 3 Pulled from Consent by Council Member Pease. 6.b MINUTES REVIEW - SEPTEMBER 5, 2023 COUNCIL MINUTES Motion By Council Member Pease Second By Council Member Shoresman To approve the September 5, 2023 City Council Minutes, with the following revisions to bullet #4 of the motion for Item 6a, US 101/Prado Road Interchange Project: 4. Added during the meeting: Council provided direction to staff to explore incorporate leading ways strategies to maximally reduce embodied carbon to the extent feasible. Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 6.d APPROVE USE OF FUNDING FOR RECYCLED WATER USER SITE IMPROVEMENTS Vice Mayor Marx declared a conflict on this item and recused due to owning property within the San Luis Ranch development, which is near one of the proposed locations. Motion By Council Member Francis Second By Council Member Shoresman 1. Authorize the use of up to $172,647.45 in available funding from the Recycled Water System Retrofits CIP (Project #2000573) to make recycled water and water distribution system protection site improvements on qualifying private properties; and 2. Find that the use of this funding does not constitute a gift of public funds and fulfills a public purpose; and 3. Find the action categorically exempt from the California Environmental Quality Act. Ayes (4): Council Member Francis, Council Member Pease, Council Member Shoresman, and Mayor Stewart Recused (1): Vice Mayor Marx CARRIED (4 to 0) 4 7. PUBLIC HEARING AND BUSINESS ITEMS 7.a AWARD CONSTRUCTION CONTRACT FOR THE CULTURAL ARTS DISTRICT PARKING STRUCTURE PROJECT, SPECIFICATION NO. 90435 (Estimated Time: 20 minutes) Public Works Director Matt Horn and Engineer III Madeline Kacsinta provided an in-depth staff report and responded to Council questions. Approve the final project plans and specifications for the Cultural Arts District Parking Structure Project; and 2. Adopt Resolution No. 11450 (2023 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, to appropriate $47 Million in Bond Proceeds to the Cultural Arts District Parking Structure Project Account”; and 3. Award a construction contract for the Cultural Arts District Parking Structure Project to Swinerton Builders Inc. in the amount of $41,070,044.00. Ayes (5): Council Member Francis, Council Member Pease, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart CARRIED (5 to 0) 5 7.b INTRODUCTION OF AN ORDINANCE APPROVING LOCAL AMENDMENTS TO THE CALIFORNIA ENERGY CODE (Estimated Time: 45 minutes) Council Member Pease declared a conflict on this item and recused due to her employment in the building industry. Deputy City Manager Greg Hermann, Sustainability Manager Chris Read, and Chief Building Official Michael Loew provided an in -depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- Motion By Council Member Shoresman Second By Council Member Francis Introduce Ordinance No. 1730 (2023 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, adopting Local Amendments to Part 6 of the Building Construction and Fire Prevention Code, 2023,” to be codified under San Luis Obispo Municipal Code Chapter 15.04.060 – “Amendments – Energy Standards”. Ayes (4): Council Member Francis, Council Member Shoresman, Vice Mayor Marx, and Mayor Stewart Recused (1): Council Member Pease CARRIED (4 to 0) 8. LIAISON REPORTS AND COMMUNICATIONS Council Member Shoresman attended the California Men's Colony Advisory Body meeting and the Convocation at Cal Poly. Vice Mayor Marx attended the IWMA Board meeting. Council Member Pease attended the RTA meeting and the Groundwater Sustainability Commission meeting. Council Member Francis attended the IWMA free compost giveaway, the 9 -11 Ceremony at Fire Station 1, and the Cal Poly Convocation. Mayor Stewart attended the 9-11 Memorial at Fire Station 1, the CASA 40th anniversary celebration, a virtual tour of Orange County's Be Well program. Central Coast Community Energy's annual meeting in Paso Robles, and the 6 Convocation at Cal Poly. She also met with Vishesh Anand, Deputy Regional Director, External Affairs LA, Ventura, SB, and SLO Counties Office of Governor Gavin Newsom and Angel Moreno from the Office of Attorney General Rob Bonita. 9. ADJOURNMENT The meeting was adjourned at 8:43 p.m. The next Regular Meeting of the City Council will be held on October 3, 2023, with Closed Session at 4:30 p.m. in the Council Hearing Room and the Regular Meeting at 5:30 p.m. in the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo.
