The City Engineer presented and read Plans and Specifications for the Im-
provemant of State Highway Route No. 2 through the City ( i.e.,

specifications were duly and regularly ordered filed.
Resolution No. 459 (New Series) - A Resolution adopting plans and specifi-
cations for the improvement of a, portion of State Highway No. 2 within the City of San
Luis Obispo was passed and adopted,on motion of R. P. Howell, seconded by W. H. Brazil,
by the following vote:
Ayes: W. H. Brazil, R.P.Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary
Noes: None
Absent: None

The following applications for permit to build were granted, on motion of

The petition.of G. H. Shadinger for transfer of license for Restaurant and
igars Sideline, at 1129 Monterey Street to C. L. Burch was referred to the Commissioner
Public Health and Safety for investigation and report to the Council.
The following applications for permit to lay sidewalk and curbing were
ted on motion of R. P. Howell, seconded by Ralph C. Kennedy, with the provision that
the work be done under the supervision of the City Engineer:
Jerry Rhodes - 48 ft. of 6 ft. park sidewalk on the west side
of Chorro Street between Upham Street and Church Street.
Ewell Cox - 60 ft of 6 ft. park sidewalk on the west side of
Chorro Street between Upham and Church Streets
G. L. Bishop - 100 ft of 6 ft. park sidewalk on the north side of
Upham Street between Garden and Chorro Streets,

Re: Blotter of application of J. C. Naylor.for permit to recess curbing for
10 ft. driveway on the east side of Broad Street between High Street and the inter-
section of Broad Street and Chorro Street: It was moved by R. P. Howell, seconded by
W. H. Brazil that the application be granted with the provision that the work be done and
the supervision of the City Engineer. Matter discussed. Motion withdrawn and the matter
referred to the Commissioner of Public Vlorks and the Commissioner of Finance for inves-
tigation and report to the Council.
On motion of Ralph 0. Kennedy, seconded by R. P. Howell, the Merchandising
Bond of J. J. Langdon, secured by certified check in the amount of $$200.00, was ordered
cancelled and the certified check ordered returned, - the principal having fulfilled
obligations under said bond.
On Motion of R. P. Howell, seconded by W. H. Brazil, the following applicati
for permit to hang signs were referred to the Commissioner of Public Health and Safety
for investigation and report to 'the Council:

The petition of H. H. McBride for permit to cut pavement 6 ft. x 4 ft. on
Higuera Street ( 338 Higuera Street) between Nipomo and South Streets, for the purpose of
replacing old 4" sewer line with a 6" line, was granted, on motion of R. P. Howell,
seconded by Joseph Leary, with the provision that the work be done under the supervision o
the City Engineer and with the further provision that the petitioner file a bond with the
City for replacing pavement cut.
The petition of Model Linen Supply by H. B. Page, for the installation of one
70 H. P. Steam Boiler and one Fuel Oil Storage Tank at 348 Higuera Street was referred,
on motion of Joseph Leary, seconded by V.I. H. Brazil to the Commissioner of Public Works
and the City Engineer for investigation and report to the.Coundil.
Reports of the City Clerk and the City Treasurer for the month of July, 1939,
were received and ordered placed on file.
The petition of H. A. Scott for permit to connect two residences at the cor-
ner of Peach and Toro Streets on one sewer, was denied, on motion of R. P. Howell, seconde
by W. H. Brazil.
In the matter of the Protest of the City Council of the City of San Luis
Obispo and Don W. Parks, Chief of Police, and Vd. H. Brazil, Commissioner of Public Health
and Safety, against the issuance of "On Sale Beer" License to: Refugio Lopez dba E1
Rancho Grande Cafe, 887 Palm Street, in the City of San Luis Obispo:-, California, under
Alcohclic Beverage Control Act: Notice from State Board of Equalization of Hearing on
said Protest filed with the State Board, June 10th and 16th, 1939, will be held before
a representative of the Board in the County Court House, San Luis Obispo, California,
on Wednesday, August 23, 1939 at 10 o'clock A. M: It was moved by R. P. Howell, seconded
by Ralph C. Kennedy that the matter be referred to the Commissioner of Public Health and
Safety and the Police Department and the City Attorney to appear at said Hearing and
enter further protest on the said application.
The matter of the request of the Union Oil Co. of California for permit to
substitute Pacific Indemnity Co. Bond No. 99087 in the a -mount of $1000.00 in lieu of
National Surety Co. Bond No. 460189 in support of Franchise awarded the Union Oil Co.
by Ordinance No. 158 of the City of San Luis Obispo dated Sept. 7,1909, covering rights
etc., to lay and use oil, gas, water and telephone lines etc., waS referred, on motion of
R. P. Howell, seconded by W. H. Brazil to the•Commissioner of Finance and the City Attorney

for report to the Council.
Application of the Veteran's Welfare Board of the State of California for
cancellation of assessment for the year 1939 -1940 against lot 15 of the Loma Vista Tract,
assessed to Alvinza Webster and Edith F. Webster, title now vested in the Veteran's Welfa
Board, State of California, was received and on motion of R. P. Howell, seconded by W. H.
Brazil, the said matter was referred to the Commissioner of Finance for investigation and
report to the Council.
This being the date fixed by the Council for receiving Bids for Steel as per
published notice of August 8, 19399 to be used in the construction of City Reservoir No. 1
known as "Small Reservoir ", the following is a list of Bidders submitting Bids and which
said Bids were publicly opened and read:

Truscon Steel Co., Los Angeles, Calif.

It appearing that the bid of S. P. Milling Co. was the lowest and best bid of all bids
received, it was moved by R. P. Howell, seconded by W. H. Brazil that the ::id of the S.P.
Milling Co. for steel be accepted. Motion carried. For further reference see bids on
file in the office of the City Clerk.

Petition of Gertude and George Venema for permit to construct a fence 5 -1/2'
high in lot 3, Block 151, Harford Addn. was granted on motion of W. H.brazil, seconded
by R. P. Howell.
The petition of 0. W. Hodgin for license for Restaurant at 968 Monterey Street
laid over for report.
Application of Kathryn Ahlrich for license for Spiritual Readings at 856
Monterey Street :^gas denied, on motion of Joseph Leary, seconded by R.'P. Howell.
Application of L & L Amusement Company, by James Ariaga, for permit to
place Music Vending Machines at the following places:
(1) O.K. C fe - ?08 Higuera Street
(1) Redwooda Tree Lunch, 1254 Monterey Street
(1) Coffee Pot Cafe, 882 Marsh Street
was granted on motion of R. P. Howell, seconded by W. H. Brazil.
Application of A. L. Shelton for license for Lodging House at 546 Higuera
Street ,again continued.
Petition of R. Leal for permit to grade a certain alley at 237 High Street
granted ;, on motion of R. 1'. Hovuell, seconded by Ralph C. Kennedy. 'stork to be done under
the supervision of the City Engineer.
Com„�issioner of Finance, Ralph C. Kennedy, reported on the matter of oleo-
margarine ordinance and recommended its repeal. Matter discussed and it was moved by
R. P. Howell, seconded by Ralph C. Kennedy, that the City Attorney draw; an Ordinance
