City Hall, Tuesday,.September 5, 1939- 7:330 P.M.
City Council met in regular adjourned session - Mayor Fred C. Kimball presiding.
Present: W.H.Brazil,R.P.Howell, Ralph C.Kennedy, Fred C.Kimball, Joseph Leary
Absent: None
as read.
The Minutes of August 21st and 28th and September lst, 1939 were read and approved
The following applications for permit to build were granted on motion of R. P.
Howell, seconded by W. H. Brazil:

The application of Nellie M.aston for license for Merchandise (Confectionery,
Lunch, Soft Drinks, etc..) at 1177 Marsh Street was referred to the Commissioner of Public
Health and Safety for investigation and report to the Council.
The application of Howard B. Kirtland for permit to lay 62 ft. of full width side-
walk and curbing on the south side of First Street between Essex and Johnson Street, Lot
it Block 43, was referred, on motion of Ralph C. Kennedy, seconded by R. P. Howell to the
Commissioner of Public Works and the City Engineer with power to act, and if granted, work
to be done under the supervision of the City Engineer.
The application of Lola McNamara by 11. S. Hockett for permit to open street for
sewer connection on Peach Street between Toro and Essex Streets granted, on motion of R.P.
Howell, seconded-by Ralph C.. Kennedy.
The application of the Union Oil Company of California for permit to relocate.
2 -8" -main trunk lines through the Nelson Subdivision (Escuela Alta) and the High- school
property was referred, on motion of Ralph C. Kennedy, seconded by W. H. Brazil to the
Commissioner of Public Works and the City Engineer, t -:ith power to act.
The petition of the San Joaquin Power Division, Pacific Gas and Electric Company
for permit to remove certain poles and anchors to curb line at Toro and Islay Streets, on
account of improvement work on Islay Street was granted on- motion of Ralph C. Kennedy,
seconded by R. P. Howell with the provision that work be done under the supervision of
the City Engineer. Joseph Leary voted "No".
The reports of the City Collector, the Police Judge and the Round Master. for the
(month of August were received and ordered placed on file, on motion duly seconded and
carried.
On motion of R.P.Ho�nell, seconded by W. H. Brazil, the report of the City Collectoi
on unpaid licenses for the July quarter was referred to the Police Department for col-
lecti on.
Claims against the City for the month of August, 1939, were ordered paid, on
(motion of Ralph C. Kennedy, seconded by W. H: Brazil, subject to the approval of the
heads of the respective departments and the blayor.
The State Liquor Administrator, George M. Stout, reported officially for the State
IBoard of Equalization that the protest of the City to said board, regarding the appli-
(cation of Refugio Lopez, dba E1 Rancho Grande Cafe, 887 Palm Street for "On Sale Beer"
license, had been denied, It was ordered that the report be placed on file.
Ordinance No. 204 (New Series) - An Ordinance repealing Ordinance No. 162 (New
(Series) relative to the licensing of oleomargarine was finally passed on motion of R.P.
(Howell, seconded by W. H. Brazil by the following vote:

The application of A. L. ,Shelton for license for lodging house at 546 Higuera
Street again continued.
The matter of the petition of Chandler P. Ward requesting that a water main
be extended on Fixlini Street from Upham Street to l.ot 20 of the Fixlini Tract was
again brought up. Commissioner R. P. Howell reported.. Matter discussed and on motion of
Joseph Leary, seconded by 7J. H.. Brazil.it was ordered, that the City Attorney be in-
structed to draw up an agreement between the property owners on Fixlini Street and the Cit
of San Luis Obispo and present to the Council. Motion carried and it was so'ordered.
The report of the Chief of Police on the application of Chas. L. Burch of the
Wideawake Cafe, 1129 Monterey.Street relative to his application to the State Board of
Equalization for license for "On Sale Beer" was received and ordered placed on file.
The Monthly Crime Report of the Chief of Police, Don W. Parks, was received
and on motion of R. P. Howell, seconded by Joseph Leary the same was ordered placed on
file.
On motion of R. P: Howell, seconded by W. H. Brazil, the City Engineer was
instructed to furnish the Council with specifications for reinforcing steel to be used
in connection with the improvement of Large Reservoir, known as "Reservoir No. 2".
In response to invitation of the Chamber.of Commerce,.inviting the council to
accompany said Chamber on a Goodwill Caravan to Santa Maria and Santa Barbara on Sept.
13th, was announced by the Mayor. Commissioner.R. P. Ho%vell was named as Chairman of the
Committee to make arrangements.
Re: Request of Lafe Todd and Horatio Warden for water to be furnished to Rodeo
Field. Matter discussed. It was moved by Ralph C. Kennedy, seconded by W. H. Brazil
that the matter of the laying of pipe be referred to the Commissoner of Public Works and
the City Engineer with power to act,- it being understood that the petitioners, would
furnish pipe to be used.
On motion of Joseph Leary, seconded by Ralph C. Kennedy, the meeting adjourned
to Monday, September 11, 1939 at 7:30 P. M.
