City Council met in adjourned session - Mayor Fred C. Kimball presiding.
Present: R. P. Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary
Absent: V. H. Brazil
The following applications for permit to build were granted on motion of
R. P. Howell, seconded by Ralph C. Kennedy:
Mary B. Brazil - Cement foundation, Lot 51 Blk 4, Cost 100.00
' Theo. Ingersoll Kinney - Garage, Lot 24, Blk 11, Weill's Addn. " 50.00
The application'of George A. Freitas for permit to raze building recently
damaged by fire, lot 179.B1k 63, commonly known as "Convent Building" granted on motion
of Ralph C. Kennedy, seconded by R. P. Howell.
The application of Robert P. Swanson for licenses for Soft Drinks and Cigars
Sideline at 1023 Morro Street was referred to the Commissioner of Public Health and Safety
for investigation and report to the Council. I .
The petition of C. A. Markel for transfer for license for Lunch Counter,
soft Drinks and Cigars Sideline at Texas Cafe, 1088 Higuera Street to Christine Lee was
referred,. on motion of R. P. Howell, seconded by Ralph C. Kennedy to the Commissioner of
Public Health and Safety for investigation and report to the Council.
On motion of R. P. Howell, seconded by Ralph C. Kennedy, the following
applications for permit to lay sidewalk and curbing were granted with the provision that

In a communication, Abb.ie S. Kellogg, Secretary of the Public Library,
thanked the Council for increased tax apportionment. Communication ordered filed.
The petition of Joe Greenway, by-Walter B. Roselip, for permit to grade and
gravel surface of Lots 3,4,5 and 6, Block 6, Southside Addition for the purpose of load-
ing and unloading new cars as are being distributed to the dealers of San Luis Obispo
received, and on motion of Joseph Leary, seconded by Ralph C. Kennedy, the matter was re-
ferred to the Commissioner of-Public Works, with power to act.
The report of the Pound Master for the month of September received and
ordered placed on file.
On motion of Joseph Leary, seconded by Ralph C. Kennedy, the communication
of K. J. Abel, 2251 Broad Street, relative to drainage at the corner of Broad and Funston
Ave. was referred to the Commissioner of Public Works for investigation and report.
The petition of C. M. Long, 1670 Monterey Street, relative to ownership of
certain portion of Block..136, Phillips Addition, was received and on motion of Joseph
Leary, seconded by R. P. Howell, the matter was referred to the City Attorney and the
City Engineer for investigation and report.

This being the date fixed by the Council as per Minute Order of September 25,
1939, and in accordance with published notice for receiving Bids for furnishing to the
City of San Luis Obispo, corrugated iron roofing and siding for Reservoirs'No. 1 and 3,
the following is a list of those submitting bids, which said bids were publicly opened
and read:
Farmers Hardware and Implement Co. - San Luis Obispo, California
H. B. Nicholson,- 438 Chamber of Commerce Bldg., Los Angeles, Calif.
Southern Pacific Milling Co., - San Luis Obispo, Calif.
Pacific Coast Coal Co.,- San Luis Obispo, Calif.
This being the date fixed by the Council as per +minute Order of September 25,
1939, and in accordance with published notice for receiving Bids for furnishing to the
City of San Luis Obispo, reinforcing steel for Reservoir Nc. 3, the. following is a list
of those submitting bids, which said bids were publicly opened and read:
Southern Pacific Milling Co. - San Luis Obispo, Calif.
Trojan Steel, Inc. - 3.500 Medford-St., Los Angeles, Calif.
Pacific Coast Coal Co., San Luis Obispo, Calif.
Soule Steel Co., 6200 Wilmington Ave., Los Angeles, Calif.
On motion of Ralph C. Kennedy, seconded by Joseph Leary the hereinabove mentioned
bids were referred to the City Attorney and th-e City Engineer for report back to the
Council; the Council then recessed to await checking said bids. City Engineer reported
findings on bids. It appearing that the bid of the Southern Pacific Milling Co. in the
amount of $9188.78 was the lowest and best bid of all bids received for corrugated iron
roofing and siding for Reservoirs No. 1 and 3, it was moved by R. P. Howell, seconded by
Joseph Leary that the bid of the Southern Pacific Milling Co.-be accepted in the amount
of $9188.78, said amount including sales tax. Motion carried.
It appearing that the bid of the Pacific Coast Coal Co. in the amount of $3.19
per cwt. for reinforcing steel for Reservoir No. 3 was the lowest and best bid of all
bids received. It was moved by R. P. Howell, seconded by Ralph C: Kennedy that the bid
of the Pacific Coast Coal Co. for $3.19 per cwt, be accepted and the contract awarded to
said company. Motion carried.
The following petitions were held over for further report:
Petition of John B. Nelson - to erect a metal sign with wood frame at 1044 Chorro Street;

IT Edna X1. Russell - to install a septic tank at 1445 Mill Street;
Application of L & L Amusement Co. - to install Music Vending Machines at 894 �iguera St.
and at 1088 Higuera Street.
The petition of La:arence L. Leitner for permit to connect with sewer on Islay
Street between Santa Rosa and Toro Streets was granted on motion of R. P. Howell, seconded
b,v Joseph Leary with the provision that work be done under the supervision of the City
Engineer.
The petition of M. A. Cheda for sewer connection on Peach Street between Santa
Rosa and Osos Street again laid over until contractor named therein takes license for
contracting.
The petition of Anita M. Hathway relative to acceptance of a certain street in
Hathway Addition again continued.
The petition of Mrs. H. L. Coffin for "Dead End Street Sign" at Santa Rosa and
Leff Street was denied as per petitioner's request.
The communication of E. C. Schwafel and Edmond Williams relative to Traffic
matters were again held over.
The petition of Walter Melin for sewer connection on Brandii° Street between Cypress
Street and Beebee Street granted on motion of R. F. Howell; seconded by Joseph Leary with
the provision that work be done under the supervision of the City Engineer,

The petition of George B. Benner for extension of sewer for a distance of
approximately 40 ft. southerly from its present terminus on Fixlini Street was denied
without prejudice to the petitioner, on motion duly seconded and carried.
The petitions of Henry Kast and C. C. Dennis relative to Fire Alarm Boxes
in the vicinity of Price and Cyrress Streets again laid over.
The application of A. L. Shelton.for license for Lodging House at 546
Higuera Street granted on motion of Joseph Leary, seconded by R. r. Howell.
The petition of J. C. Naylor for sewer connection for Lot 3, Block 2,
IMcBride Tract laid over.
The matter in connection with acceptance of a map of the Nelson Subdivision
was continued to the next meeting.
It was moved by Ralph C. Kennedy, seconded by Joseph Leary and carried that
the following list of licenses charged for the sale of Oleomargarine under Ordinance
No. 162 (New Series) now repealed by Ordinance No. 204 (Ne�-j Series) and remaining unpaid

Resolution No. 469 (New Series) -A Resolution providing for the execution

of an Agreement between the City of San Luis Obispo and the estate Relief Administration
was passa& and adopted on motion of R. P. Howell, seconded by Ralph C. Kennedy, by the

Resolution No. 471 (New Series) - A Resolution providing for'the execution of
an Agreement between the City of San Luis Obispo and Smith Booth Usher Company relating

Grader, Serial No. M 597" on'a rental basis, particularly set out in said Agreement

Ordinance No. 206 (New Series) - An Ordinance repealing Ordinance No. •194 '(New
Series.) entitled "An Ordinance providing for the lease of certain real property owned
by the City of San Luis Obispo" was introduced and -passed to print on motion of Ralph
C. Kennedy, seconded by R. P. Howell by the following vote:
Ayes: R. P. Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary

On motion of Ralph C. Kennedy, seconded by R. P. Howell the City Attorney was
authorized and directed to draw papers and rent the City of San Luis Obispo!s Laguna
property to A. Alberti for a period of one year at an annual rental of $775.00 per year.
Commissioners R. P. Howell, and Ralph C. Kennedy were named by the Mayor as a
Committee to work with the City Engineer for recommendation relative to sewer drains
being independently and separately connected with the main public sewer in cases where
there are more than one building on one lot requiring sewer connection.
Gn motion of Ralph C. Kennedy, seconded by R. P. Howell, the meeting adjourned.
