Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary Absent: None The minutes of October 2nd and 9th were read and approved as read. The following applications for permit to build were granted on motion of R. P. Howell, seconded by ,'1. H. Brazil: C. R. Ristine - Res. and Gar. Lot 7, Blk 9, Anholm Addn, Cost $ 4000.00 August Lohrberg - Addn to Res. Lot .17, Blk 3, Imperial Addn. it 500.00 The application of W. W. Gilmore for permit to move a building from part of Lots 13, 149 15 and 16, Block 29, to Lot 2, Block 119, lei & C Addition was granted on motion of R. P. Howell, seconded by Joseph Leary. The following applications for permit to lay sidewalk and curbing were granted on motion of R. P. Howell, seconded by W. H. Brazil: Albert T. Earl - 50 ft. of 5 ft park sidewalk and curbing on the south side of Center Street between Chorro and Lincoln Streets. Stanley V. Cole - 50 ft. of 5 ft. park sidewalk and curbing on the south side of Center Street, between Cho rro.& Lincoln Streets. Miss Elsie Hewitt- 50 ft of 5 ft park sidewalk and curbing on the east side of Chorro Street between Venable and Center Streets. The applications of A. W. McCurdy for permit to lay 60 ft. of 10 ft. sidewalk and curbing on the east side of Santa Rosa Street between Buchon and Pismo Streets in t Lavina Block, and the application of Roy Dennis for permit to lay 198 ft. of 5 ft. park sidewalk on the east side of Nipomo Street at High Street, Block 124, M & C Addition, -,,)ere referred on motion of Joseph Leary, seconded by W. H. Brazil to the Commissioner of Public works, with power to act. On motion of R. P. Howell, seconded by 'W. H. Brazil the application of G. R. Greenelsh for permit to recess curb for a distance of 12 ft. for driveway on the west side of Broad Street between Woodbridge and Caudill Street granted. The petition of E. D. Dunning, Supt. of Buildings and Grounds of the San Luis Obispo City Schools for permit to build a rock and brick wall at the Senior High School and also requesting permit to remove evergreen trees on Second Street along the Fremont -3chool grounds were granted on motion of R. P. Howell, seconded by Joseph Leary - work to be done under the supervision of the City Engineer. The petition of Vernon Flory, Minister of the Seventh Day Adventist Church, for permission to extend the time of conducting public meetings at the big tent at the corner of Pacific and Garden Streets to November 30th, 1939 was granted on favorable repor of W. H. Brazil, seconded by Ralph C. Kennedy. The petition of F. Deleissigues requesting that a Stop Sign be placed at the intersection of Munoz and Johnson Ave. was referred to the Commissioner of Public Health an Safety. On motion of R. P. Howell, seconded by Ralph C. Kennedy, the application of the Modern Neon Sign Co. for permit to hang a neon sign at 856 Monterey Street, for "Billie's Toy and Baby Shop" was referred to the Commissioner of Public Health and Safety for investigation and report. The petition of Paul Piantineda for permit to connect with sewer on Alexander Street between Broad and Victoria Streets was referred to the Commissioner of Public 'Works with power to act, on motion of Ralph C. Kennedy, seconded by Joseph Leary. 40 A petition was received from the Union Oil Co. for permit to do the following described work on Pismo Street, north of the Southern t'a.ci_'ic Railroad Co. right -of -way as shown on plan presented: (1) - Tie in 2 -8" oil pipelines into two existing oil pipe lines. , (2) - Remove sections of 2 -8" oil pipe lines laying in Pismo Street The above made necessary by.the subdivision of the Nelson property north of the Senior High School. The application was granted on motion of R. P. Howell, seconded by Ralph C. Kennedy. In a communication, Ralph C. Kennedy presented the matter relative to the can- cellation of taxes levied against lot 15 of the Loma Vista Addition, assessed for the year 1939 -1940 to Alvinza 5ebster et ux, title now vested in the Veteran's A'elfare Board of the State of California, under contract No. 23440 with William Muss, Jr. A petition from the Veteran's Welfare Board for cancellation of said taxes having been.denied by the Col.:ncil as of August 28th, 19391 it wasmoved by Ralph C. Kennedy, seconded by W. H. Brazil that the Council.rescind the action taken on August 28, 1939 and,that the petition be granted and that the City Clerk be directed to cancel such taxes now levied against said property. Motion carried. Communication received from M. Bonetti relative to ringing the Mission bells at 12 o'clock noon. City Clerk was directed to notify the petitioner that the Council, as a Body, has no objection; that the matter should be taken up directly with the Mission. Reports of the City Clerk and the City Treasurer for the month of September, 1939, were received and ordered placed on file. The request of John R. Ranson., M. D., Roll Call Chairman of the Red Cross for permit to conduct the annual Red Cross Roll Call in the City of San Luis Obispo was granted. The petition of Daisy A. Bishop relative to parking of trucks ( loaded and unloaded) at the corner of Garden and Upham Streets was received. Matter discussed and on motion of Ralph C. Kennedy, seconded by R. P. Howell the matter was referred to the Commissioner of rublic Health and Safety for investigation and report to the Council. Re: Proposed increased water rates for territory outside incorporated limits of the City of San Luis Obispo: H. J. Dubin, C. E. Freeman and others, residents of territory outside of the City of San Luis Obispo were present and discussed with the Council, the proposed increased water rates for outside territory. Ordinance No. 206 (New Series) - An Ordinance repealing Ordinance No. 194 (New Series) relating to the lease of certain real properly owned by the City of San Luis Obispo was finally passed on motion of R. P. Howell, seconded by Ralph C. Kennedy, by the following vote:. Ayes: 711. H. Brazil, R. P. Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary Noes: None Absent: None The petition of Neon Sales and Service for permit to hang a horizontal neon sign at the Ford Garage at Higuera and Santa Rosa Street was referred, on motion of Joseph Leary, seconded by Ralph C. Kennedy, to the aommissioner of Public Health and Safet,y,with power to act. The applications of L & L Amusement Co., by James Ariaga for permit to install Music 'Tending Machines at Dennis Dairy Lunch, 894 Higuera Street and at George Dawson Restaurant at 1088 Higuera Street were laid over for further investigation by the Com.` missioner of Public.Health and Safety. 1 1 1 1 1 1 1 1 J The petition of John B. Nelson for permit to place a metal sign with wood frame, at 1044 Chorro Street granted on motion of W. H. Brazil,seconded by R. P. Howell. The communication of Henry Kast and C. C. Dennis relative to installing fire alarm boxes in the vicinity of Cypress, Price and. Harris Streets was ordered filed for future reference. Resolution No. 472 (New Series) - A Resolution accepting a deed from u. C. Kinsman et al quit - claiming unto the City of San Luis Obispo a strip -of property known as "Caudill Street" was passed and adopted on motion of Ralph C. Kennedy, seconded by W. H. Brazil by the following vote: Ayes: W. H. Brazil, R. P. Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary Noes: None Absent: None Commissioner Kennedy made informal report relative to licensing of outside laundries, bakeries,. etc. doing business within the City of San Luis Obispo The following matters were continued for further investigation and report: 965 Transfer of License for Lunch Counter, Soft Drinks, Cigars Sideline at 1088 Higuera St., from C. A. Markel to Christine Lee. Application of Robert Swanson for license for Soft Drinks, Cigars Sideline at 1023 Morro St. Petition of K. J. Abel, relative to water drain at Broad Street and Funston Ave. Petition of C. M. Long, relative to certain property in Blk 136, Phillips Addition. Petition of Edna M. Russell, relative to septic tank at 1445 Mill Street. Petition of M. A. Cheda for sewer connection_ at Peach St. between Santa Rosa and Osos Streets. Petition of E. C.Schwafel, relative to "Traffic "at Beach and Pacific Streets. Petition of J. C. Naylor, relative to sewer connection at Broad St. at Garden Street. Petition of Anita Hathway, relative to deeding street known as "Ellen Way ". The matter of acceptance of map for the Nelson Subdivision.
