M. City Council met in adjourned session - Mayor Fred C. Kimball presiding. Present: !'1.H.Brazil2 R. P. Howell, Ralph C. Kennedy, Fred C. iiimball, Joseph Leary .Absent: None The following application for permit to build was granted on motion of R. P. Howell, seconded by Ralph C. Kennedy' Thos. Turner - Garage, Lot 25, Subs of Blk 151, Ha.rford Addn. Cost $ 45.00 45 A communication from Mrs. M. A. Taylor relative to certain curb to driveway a 1322 Morro Street was referred to the Commissioner of iublic Works, with power to act, on motion of Ralph C. Kennedy, seconded by Joseph Leary. Communication from C. D. Hinkle, IVlayor of Santa Cruz, relative to attendance at the Annual Convention of the California Mission Trails Association and Conference of Mayors and City Managers, to be held at the Casadel Rey Hotel in Santa Cruz, January 12th and 13th was read and referred to the Mayor. Dr. A. B. Martin appeared relative to condition of street in 500 Block on Hathway Ave.. and requested that something be done to correct the condition. It was moved by Ralph C. Kennedy, seconded by W. H. Brazil that the matter be referred to the Commissioner of Public Ylorks, with power to act. The applications for the quarterly licenses were granted on motion of W. H. Brazil, seconded by R. P. Howell. Applications of Ross Page for certain licenses at 986 Monterey Street were held over for one week. The application of Carl M. Stockman for license for Skating Rink at the I. D. E. S. Hall was denied on motion of W. H. Brazil, seconded by Joseph Leary. The application of Merton Austin for Parcel Service at 1112 Morro Street was granted o:_ motion of 4J. H. Brazil, seconded by R. P. Howell. A petition of Louise Righetti relative to improvement of Essex Street be- tween Palm and Monterey Streets was continued for one week at the request of the Com- missioner of Public Works. Resolution No 478 (New Series) - A Resolution accepting a deed from G. M. P. Anholm and Kirstine Anholm conveying title of lot.15, block 16 Anholm Addn., to City of San Luis Obispo was passed and adopted on motion of R. P. Kimball, Joseph Leary Noes: None Absent: None Ordinance No. 209 (New Series) - An Ordinance establishing grades on Hathway Ave. between Third Street and Murray Ave. was introduced and passed to print on motion of R. P. Howell, seconded by W. H. Brazil by the following vote: Ayes: W. H. Brazil, R.P. Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary Noes: None Absent: None The City Attorney presented a draft of an Ordinance relative to license fee for Tent Show, fixing said fee at x;50.00 per week and not permitting the selling of merchan- dise nor "After Shows ". Letter read from Fred H. Jennings of the Jennings Tent Shows requesting that the sale of Merchandise and "After Shows" be permitted under said ordi- nance. Matter was discussed and continued for one week; City Attorney to write Mr. Jennings that the Council is of the opinion that the ordinance should stand as submitted by the City Attorney. Resolution of Intention No. 479 (New Series) - A Resolution of Intention to call a Special Election to submit to qualified electors of the Caudill Tract and a part of the Imperial Addition, the question whether such territory shall be annexed to, incor- porated in, and made a part of the City of San Luis Obispo,was passed and adopted on motion of R. P. Howell, seconded by W. H. Brazil by the following vote: Ayes: 11..H. Brazil, R. F'. Howell, Ralph C. Kennedy, Fred C. liimball, Joseph Leary Noes: None Absent: None The City Attorney was requested to get a ruling from the State Board of Equali- zation relative to local licensing of trucks transporting liquor'in the City of San Luis Obispo. This being the time and place fixed, as per minutes of December 4, 1939, for hearing protests on the improvement of Islay Street and a portion of Toro Street; the matter was now taken up. There were no written or verbal protests filed by property owners, and '.there: was no one present to enter any verbal protest against the improve - went. City Attorney presented Resolution. Resolution No. 480 (New Series) - Approving the assessment for the improve- went of Islay Street and a portion of Toro Street in the City of San Luis Obispo was duly and regularly adopted on motion of Ralph C. Kennedy, seconded by W. H. Brazil by the following vote: Ayes: W.H. Brazil, R.F. Howell, Ralph C. Kennedy, Fred C. Kimball, Joseph Leary Noes: None Absent: None This being the time and place fixed for hearing on the improvement of a portion of Morro :street in the City of San Luis Obispo, as per minutes of December 4,.1939; the matter was now taken up.
