Howell, Acting Mayor presiding. Present: W.H. Brazil, R.P. Howell, Ralph C. Kennedy, Joseph Leary Absent: F. C. Kimball The minutes of April 6th and 13th were read and approved as read. The application of Harry Overland for permit to build a dwelling and 2 car garage on Lot 5 and part of Lot 6, Block 1, pathway Addition, at a cost of $1000.00 was granted on motion of W. H. Brazil, seconded by Ralph C. Kennedy. The following applications were referred to the Commissioner of Public Works, with power to act: C. F. Jones - 50 ft. of sidewalk on the east side of Lincoln St. between Montalban and Center Streets Chris Anholm - Sewer connection - Chorro St. between Center St: and Venable St. The following applications for city licenses were referred to the Commissioner of Public Health and Safety for investigation and report on motion of Ralph C. Kennedy, seconded by W. H. Brazil: Mrs. Thelma Ibanez and ( Restaurant George R. Howell, seconded by W.H. brazil. The transfer of license for rooming house from J. Carlson at 676 Monterey Street to Lucille Poe was granted on motion of W. H. Brazil, seconded by Ralph C. Kennedy. Petition filed by the Southern Pacific milling Co. for permit to install 1 - 550 gallon gasoline tank and pump at the corner of Santa Barbara Ave. and High Street was held over until the next meeting. Ordinance No. 239 (New Series) - An Ordinance amending Section four and one -half of Ordinance No. 122 (New Series) was finally passed on motion of W.H. Brazil, seconded by Ralph C. Kennedy upon the follaejing vote: Ayes: 'N.H.Brazil, R.P.Howell, Ralph C. Kennedy, Joseph Leary Noes: None Absent: F. C. Kimball Mr. J. B. Dawson, Division Engineer of the Southern Pacific Co. appeared before the Council presenting a blue print on the proposed change of alignment of the Fairview Ave. overhead crossing and requested permission to close Fairview Ave. during this reconstruction which is necessary to complete their Central Traffic Control System being installed by the Southern iacific Railway Co. controlling rail traffic between the City of San Luis Obispo and Santa :largarita, and on motion of VJ.H. Brazil, seconded by Joseph Leary the request was granted. After discussion the Council requested Mr. Dawson to submit his request in letter form stating the actual time needed in rebuilding this structure. Commissioner R. P. Howell reported that it might not be possible to continue with the Pismo- Nipomo street Jt. Improvement plan due to a government order which prohibits the start of construction on highway, roadway, sub- surface, utilities etc. if the cost of the project amounts to $5,000 or more. On motion of W. H. Brazil, seconded by Joseph Leary it was moved that George H. Fierce be appointed as Police Officer for the usual six months probationary period at a salary of $135.00 per month as of March 16, 1942, subject to prior release from services made necessary due to return from war activities of veterans previously in city employ.
