City Hall, Monday, August 25, 1952 - 7:30 P.M.
The Council met in adjourned session; Mayor Timothy I. O'Reilly presiding.
Present: Paul W. Davis, Fred Lucksinger, Timothy I. O'Reilly
Absent: D.M. Carpenter, Frank V. Woods
First order of business:
The awarding of the bid on the FREEWAY SANITARY SEWER RELOCATION: The City Engineer,
Homer Hamlin reported favorable on the bid or' L.E. Webb Construction Co. Inc., the amount
of the bid being $10,897.30, and on motion of Paul W. Davis, seconded by Fred Lucksinger
the bid was awarded to L. E. Webb Construction Co. in amoun t of $10,897.30 and the
following resolution was adopted.
Resolution No. 1134 (New Series) - A Resolution accepting Bed for Freeway Sanit
Sewer Relocation Project No. 2852A was passed and adopted on motion of Paul W. Davis,
s= conded by Fred Lucksinger upon the following roll call vote:
Ayes: Paul W. Davis, Fred Lucksinger, Timothy I: O'Reilly
Noes: None
Absent: D. M. Carpenter, Frank V. Woods
The City* Engineer reminded the Council tha. the State will reimburse the City
100% for this project. After discussion and on motion of Paul W. Davis, seconded by
Timothy I. O'Reilly a Resolution is to be prepared by the City Attorney, establishing a
Revolving Fund for this project, which will be reimbursed by the State.
Comm. from Marilyn Hildebran rendering her resignation as City Collector was
read to the Council and on motion of Paul W. Davis, seconded by Timothy I. O'Reilly,
same was accepted. Motion carriedl
Comm. from the Volunteers of America asking permission to hold their annual Tag
Day on Sept. 27th, in the City of San Luis Obispo was granted on motion of Paul W. Davis,
seconded by Fred Lucksinger.
Comm. from Robert V. Bromley Re: Water drainage from the street over the curb
and through his property at 546 Lawrence Dr. was read to the Council. On motion of
Paul W. Davis, seconded by Fred Lucksinger the matter was referred to the Public Works
Dept. for action and report. City Engineer Homer Hamlin informed the Council that he
was familiar with the existing condition and will try tc alleviate the situtation as soon
as possible.
Comm. from Willeford & Wiltshire submitting Proposal: to the Council relative
to auditing S. L. 0. City Books and records was read. It was moved by Paul W. Davis,
seconded by Timothy I. O'Reilly that this firm be engaged by the City for the auditing
services as set forth in their letter by the following roll call vote:
Ayes: Paul W. Davis, Frd Lucksinger, Timothy I. O'Reilly
Noes: None
Absent:: D. M. Carpenter, Frank V. Woods
The City Attorney was directed to prepare a Resolution covering the above Propo
for auditing services.
Re: Bond for A. L. Ferrini and Hilda Ferrini: The Council approved the bond
of A. L. Ferrini and Hilda Ferrini.
Mr. Wm. Rooney, Supt. of the Park Playground and Rec. Commission made a report
to the Council in regard to the landscaping of the City Hall Grounds, stating he he:d
received bids from the San Luis Nursery and Karlskint's Nursery for shrubs etc. needed
for the landscaping and also received a bid from L.L. lLenger for placing of top soil and

levelling the grounds. The Council advised Mr. Rooney to use his discretion as to which
bid to accent and by common consent of the Council, payment was autnorized to purchase
the necessary shrubs, seeds etc., and the City Attorney was directed to prepare a
Resolution for a lu;np sum of money which is to be expended to maintain the city hall groun
after the lawn has been planted.
The City Engineer referred to a letter redeived from the Planning. Commission
addressed to the Mayor recotImending that the firm of Hahn, Wise and Associates of San
Francisco be hired to provide the city with Planning Consultant Services in accordance
with their terms of the.letter submitted by Mr. Wise; on motion of Paul W. Davis, seconded
by Fred Lucksinger, the recommendation of the Planning Commission was acepted to engage
the servicea of Hahn, Wise and Associates as per their letter. Motion carried. Mr. Hamlin
stated that the first job to be handled by them would be the re- writing of the Sub-
division Ordinance.
At this time Jack Kaetzel, Attorney, appeared before the Council in behalf of
his client C. A. Maino, asking the Council for a clarification of the City's authority
to declare a building unsafe 'for occupancy, (the build- -ngs inquestion being owned ty
C. A. Maino at 872 and 874 Monterey street); agreat deal of discussion followed relative
to the safety of old buildings and engineering opinions etc. No action was taken by the
Council at this time.
At this ti-e, Mr. David Hildebran appeared before the "ouncil and read a speech
which contained chrges, stating that the Council had been unfair and that untruthful.:.
statements had been made relative to practices and procedures in the City Collector's Offil
The City Attorney presented the following Resolution for the approval and
adoption of the City Council:
Resolution No. 1135 (New Series)- A Resolution providing for the Execution by
the City of San Luis Obispo of an Agreement with West Coast Homes, Inc. was passed and
adopted on motion of Paul Davis, seconded by Fred Lucksinger upon the following roll
call vote:
Resolution No. 1136 (New Series) - A Resolution accepting offer of Paul Adamson
Harry N. Jenks and Johia H. Jenks for Services was passed and adopted on motion of Paul
W. Davis; seconded by Fred Lucksinger upon the following roll call vote:
Ayes: Paul Vo'. Davis, Fred Lucksinger, Tijrothy I. O'Reilly
Noes: None
Absent: D.M. Carpenter, Frank V. Woods
Resolution No. 1137 (New Series) A Resolution declaring
- a certain portion of
Higuera St. to be one and one -half hour Parking St. was passed and adopted on motion of
Paul W. Davis, seconded by Fred Lucksinger upon the following roll call vote:

A report faom the Cit. Clerk's office was presented to the Council, stating
that all claims against Bob Bosnyak Re: Fo6thill Blvd. Sanitary Imo. Dist. project have
been paid and Notices of satisfaction duly notarized and are on file in the City Clerk's
office; by common consent of the Council it was ordered that all payments withheld to Bob
Bosnyak be released for payment.
The following Ordinances were finally passed by the Council:

Ordinance No. 369 (New Series)_ - An Ordinance levying a Tax for the Current
Fiscal Year I952 -53 upon all Taxable Property within the City was finally passed on motion
of Paul W. Davis, seconded by Fred Lucksinger upon the following roll call vote:

Ordinance No. 370 (New Series)- An Ordinance requiring the City Clerk to use
Pre - Nunbered Warrants, and to pay the same vendor with one warrant designating various fund

Commissioner Fred Lucksinger, presented a Tnaffic Problem to the Council, existing
t various locations in the city, suggesting that two traffic officers dircr the traffic
t certain intersections between the hours of 4 and 6 P.M. -- to have two officers to direct
he traffic on Marsh st. at the corners of Osos St. and Chorro St.
sst. Chief Lawrence Flsea was asked to alleviate this condition and he assured the Council
his would be done by placing two patrolmen at the ar.ove named corners from 5 to 6 P.K.
On motion of Paul W. Davis, seconded by Fred Lucksinger, the meeting adjourned.
