Present: D.M.Carpenter, Paul W.Davis, Fred Lucksinger, Timothy I. O'Reilly Absent: None Minutes of the meeting of April 20th and minutes of Special Meeting of April 22nd, 1953 were approved. Re: Report on JOHNSON STREET IMP. PROJECT #1$: On motion of Fred Lucksinger, seconded by D.M.Carpenter, it was moved that the bid submitted by Henry C.Dalessi in the amount of $24,110.40 be accepted on recommendation of the City Engineer, G.Homer Hamlin. Motion carried. Re: Report on MURRAY STREET WATERLINE IMP. RELOC.�.TION CITY PLATT NO. 5: On motion of D.M.Caroenter, seconded by Fred Lucksinger, it was mn)ved that the bid submitted by W.M. Lyles Company in the amount of $3479.48 be accepted on recommendation of the City Engineer, 1 G. Homer Hamlin. Motion carried. Communication from Pacific Gas and Elec. Co. requesting the acquisition of a parcel of land from the City of San Luis Obispo for a new group service site area and purchase by the City of Pacific Gas and Electric present service area site in Block 117 Reeds Addition. On motion of Fred Lucksinger, seconded by Timothy I.O'Reilly, a letter is to be written to the Pacific Gas and Electric Co. telling them that the city is in the middle of a transaction from the present administration to the newly elected Council and that as soon as the new City Administration convenes, the Pacific Gas and Elec. Co. will hear from them regarding property transfer. Communication from Rev. Gilbert S. Zimmerman Re: invocation at Council meetings was ordered received and filed on motion of D.M.Carpenter, seconded by Fred Lucksinger. Communication from Military Order of the Purple Heart requesting permission to display 3 diamond rings and solicit donations, from May 2nd to June 27, 1953; permission was granted on motion of Fred Lucksinger, seconded by Timothy I. O'Reilly. Communication from the County of San Luis Obispo, Dept. of Public Health Re: leak of sewage in the street opposite 591 Lawrence Drive; on motion of D.M.Carpenter, seconded by Fred Lucksinger, it was moved that the sewer be fixed and that if any part of the lateral is repaired, that the property owner pay his share of the expense. Council members and Executive Secy. to the Council to meet with Dr. Sworthout Re: forms and Ordinances for Health Inspection in City of S.L.O. by County Health Dept. Communication from U.S.Pipe and Foundry Co. Re: increase in .cost of pipe from bid price. Upon recommendation of the City Engineer, Homer Hamlin, and on -potion of D.M.Crrpenter, seconded by Fred Lucksinger, it was moved that the City accept and pay for additional pipe. Communication from Fiesta de las Flores Assn. requesting, (a) Permission for Clyde Beatty Circus to parade thru the streets of S.L.O. on May 15 at 10 o'clock A.M. (b) Permission for Fiesta de las Flores to hold a parade on May 16th, 1953 at 10 A.M. (c) Permission to hang street decorations (d) Permission for car equipped with loud speaker to advertise Fiesta activities. The requests were granted on motion of D.M.Carpenter, seconded by Fred Lucksinger. Motion carried. At this time, Mr. David Hildebran, representing Ralph Westfall, appeared before the Council protesting Ordinance No. 381 (New Series) providing for a setback of 30 ft. d 1 1 7 on each side of Foothill Blvd. between Santa Rosa St. and Mt. Pleasanton. Mr. Paul S.Dillon appeared before the Council in protest of Ordinance No. 381 (New Series) stating that the -City was taking more land than a man could spare. Mr. Edgeman appeared before the Council protesting Ordinance No. 381 (New Series) and requesting that the Council set a time for a Hearing of the Proposed setback on Foothill Blvd. Series) . Mr. Grady appeared before the Co-.:ncil inprotest of Ordinance No. 381 (New Mr. Alexander McKay appeared before the Council protesting Ordinance No. 381 .(New Series). Mr. McKay also stated that this area of Foothill Blvd. was zoned for C -1 and not R -1 as it should be, and he requested action on Ordinance No. 3$1 (New Series) be postporied until both the City and the property owners could arrive at an equitable solution. On motion of Fred Lucksinger, seconded by Timothy I. O'Reilly that Final Passage of Ordinance No. 381 (New Series) be postponed for two weeks until the City Engineer can make a survey of exact lines of street widths on Foothill Blvd. from Santa Rosa Street to Mt. Pleasanton. At this time, A.J. Chargin, Attorney at law, representing the claw machine operators appeared before the Council protesting the City Council's action in outlawing claw machines and having them removed from their locations. Mr. Chargin went on at some length stating that this machine was a game of skill and not one of chance. Mr. Chargin requested that the City Council reconsider its action regarding the banning of the claw machines, Communication from S.L.O. Medical society statirig that the Medical Society approved the principle of fluoridation of city water as a health measure. Communication from the 16th District Dental Society endorsing the fluoridation of the S.L.O. city water supply and urging the Council to place this plan in- operation as soon as possible. On motion of Paul W.Davis, seconded by Fred Lucksinger, the Executive Secretary, Richard Miller, was instructed to write to the State of California, Dept. of Public Health, for a permit to fluoride the city water upon the following roll call vote Ayes: D.M.Carpenter, Paul W.Davis, Fred Lucksinger, Timothy I. O'Reilly Noes: None Absent: None By cdmmon consent of the Council the City Engineer is to help Richard Miller in preparing the application for the permit from the State, Dept. of Public Health. At this time, Mr. Frank Cheda addressed the Council, protesting fluoridation of city water, quoting statistics from the 1950 Congressional Record, of the health statistics of Grand Rapids Michigan. Mr. Alexander McKay appeared before the Council protesting the Council's action in applying to the State Dept. of Public Health for a permit to fluoridate city water. Mr. McKay also challenged the straw vote on "Fluorides" held with the Municipal Election on April 6, 1953• I comments . Mr. Gannon from the Statc Dept. of Public Health was introduced but made no Dr. Howard B.Kirtlandappeared before the Council stating that the people of San Luis Obispo had voiced their approval of fluoridation of city water by their vote on April 6, 19530 Communication from Mission Trails requesting a donation from the City of S.L.O. (7 was ordered received and filed on motion of D.M.Carpenter., seconded by Paul W.Davis. Resolution No. 1220 (New Series - A Resolution transferring moneys within certain funds was passed and adopted on motion of Paul W.Davis, seconded by Timothy I. O'Reilly upon the following roll call vote: Ayes: D.M.Carpenter, PaulW.Davis, Fred Lucksinger, Timothy I. O'Reilly Noes: None (Absent: None Report of Richard Miller, Executive Secy. regarding request of Alex 1'iadonna to purchase a parcel of city owned property. On motion of Fred Lucksinger, seconded by , Timothy I. O'Reilly, Councilman Paul W.Davis is to see Mr. Madonna regarding this purchase. Communication from Richard Miller, addressed to City.Council, reported on Informal Bids for Blanket Bond coverage, on city employees. Mr. Miller was instructed by the Council to draw up specifications for bonds and report back to the Council to set date for ad- vertising. Communication from State Controller regarding check for city's share of appor- tionment of Alcohol Beverage License fees in amount $10,068.77 was ordered received and filed. Communication from Maino Construction Co. requesting extension of time for com- pletion of Addition to Sewer Plant to May 15, 1953; same was approved on motion of D.M. Carpenter, seconded by Paul W.Davis. Communication from Roy Randall submitting a price for cutting down trees on Slack Street in amount $ 4500. On motion of Paul W.Davis, seconded by Fred Lucksinger, it was referred to the Commissioner of Finance. Mr G.Homer Hamlin reported regarding letter from the Statecf California, Dept. of Finance, City application No. 20/2321 Water line Improvement. On motion of D.M.Carpenter, seconded by Paul W.Davis, permission was granted for the city to advertise for Bids on GRAND AVE. PROJECT #20 - bids.to be opened on June 1, 1953 at 3 P.M.
