SPECIAL CALLM) MEETING

Special Called meeting was held by the City- Council on 1 ^Jednesday, May 18th, 1955
at 9:00 P.M. for the purpose of adopting Resolution authorizing the City Clerk to file
L�otice of Completion on the City Library and any other matters to come before the Council.
Resolution No. 1461 (New Series) - A Resolution authorizing the City Clerk to
record and file Notice of Completion of the City Library Building was passed and adopted
on motion of Kenneth W.Jones, seconded by Lowell E.Christie upon the following vote:
Ayes: P;els Beck, Lowell E.Christie, L-Jarren G.Edwards, Kenneth W.Jones, Fred H.Lucksinger
Noes: None
Absent: None
Councilman 11arren G.Edwards recommended to the City Council, that the City start
arrangements to purchase, for cash, the property planned for the viaggie Brown Parking Lot
inthe vicinity of Broad and Marsh Streets. Also the adjoining properties necessaryfor this
lot. Mr. Edwards made this recommendation for the reason that the property owners and the
City have come to an agreement as to price, but that the time that would be needed for the
lease purchase agreement to be effective, some of the property owners may withdraw from
the Agreement.
It was moved by Marren G..dwards, seconded by Kenneth W.Jones that the recomm endatioi
be adopted and that the City Attorney be instructedto prepare ordinances for the acquisitiol
of the aroperty for the purpose of " parking lot ".
On motion of N els Beck, seconded by Warren G.Edtaards, the meeting adjourned.

The minutes of the meeting of May 16th and Special meeting of May 18, 1955 were
approved.
Claims against the City for the month of June,1955 were ordered paid subject to
the approval of the heads of the respective departments and the Mayor.
Communication from Mr. John Tutsie, operator of the Green Bus Service was ordered
received and filed on motion of 1Jarren G.Edwards, seconded by Kenneth 11.Jones.
The City Clerk reported on the Bid Opening of the SANTA ROSA PARK DEVELOPMENT

Ordinance No. 414 (New Series) - An Ordinance of the City of San Luis Obispo
adopting a comprehensive ordinance code to be known and designated as the "San Luis
Obispo Municipal Code" and repealing all ordinances or parts of ordinances in conflict with
said code, etc. was passed to print on motion of Kenneth W.Jones, seconded by Warren G.Edwal
upon the following roll call vote:

Re: Report of the Arbitration Proceeding Re: City Library Building, between Mr. Harald N.
Nielsen, Contractor and the City of San Luis Obispo, owner, was ordered received and filed
and the recommendations of the Arbitrators accepted and that the claim be paid, pursuant
to the a rbitrationproceeding, on motion of Warreh G.Edwards, seconded by Lowell E.

on the plate glass for the. new City Library be accepted for three years..

Comm. from San Luis Obispo City Schools Re: Financial. Report of the-S.L.O. High School
District Nuss Memorial Swimming Pool Fund was ordered received and filed.
Comm. from the City of. Chico requesting the City of San Luis Obispo to transfer Chapter
47 Hinds to .their account was referred to Richard Miller for study and re commendation to
the Council on motion of Warren G.Edwards, seconded by Lowell E.Christie.
Comm. from the Dept. of Public `'corks, State of California Ke:nelinquishment of portions
of State Highways was ordered received and filed and the City Clerk was authorized to sign
certificate of acceptance with the State Highway Commission, on motion of Kenneth W.Jones,
seconded by Lowell E.Christie. .
The application of the Southwest Airways Co. was ordered received and filed.
The request of the Park and Recreation Commission for call for bids for Steel Fencing
at Santa Rosa Park was approved on motion of Kenneth W.Jones, seconded by Lowell E.
Christie. Bids to be opened June 20th, 1955 at 3 P.M. in the office of the City Clerk
At this time the City Council held a PUBLIC HEARING on the problem of placing street
lights in the unlighted areas of Lhe City. Mayor Lucksinger explained the reason for calli
the Public Hearing, was that all segments of the city's population in tracts or areas not
presently lighted would have an opportunity to express their views publicly before the
Council, so that the Council might have the opinion of the majority of the people in
these areas.
H.Brazil of Escuela Alta Subdivision speaking for himself and some of his neighbors
stated that they unalterably opposed to anytype of wooden poles supporting street lights
and also objected to any electroliers that have overhead wires from the rear of the lot
to the street side. He stated that he and some ofhis neighbors might be interested
inornamental electroliers with und"ergound conduit connection to the rear of the property
lines but that they were definitely opposed to woodenpoles and overhead wires.
. J.Earle Boyce of Escuela Alta is opposed to any tape of street lighting in this
tract, particularly, obnoxious would be the wooden poles and overhead wires, but might
consider steel poles with underground wiring.
Jerry Evans of Escuela Alta was not interested in anytype of street lighting that
called for wooden poles acid overhead wiring.
stated that some type of street lighting was necessary
and desired, but that he would be interested in electroliers with underground wiring
and not wooden utility poles with overhead wires.
Mr. Chas. Belcher 'of Goldtree Tract- stated that his tract not only wants but needs lighti
of some type and that any type of lighting would be better to what they how have which
is NONE AT ALL. He further stated that naturally, -the tract would prefer the most
ornamental and attractive type available, ff` this could be acquired for the sum of
$18.00 to.$25.00 as stated by Mr. Hamlin. He was sure that the residents in his area would
be more than willing to pay such a small sum for adequate lighting and further stated that
lighting of some type must be provided for this tract.
Mr Banta of Escuela Alta stated that he was personally for some type of street lighting,
particularly, the best possible, but that hebelieved anytype of lighting would be better
than none which is what they have at the present time."
Kennedv of Escuela Alta presented to the Council, a petition of approximately
40 signatures of residents and property owners of the Escuela Alta and Mira Monte Tracts
objecting to any type of lighting- for this area. He also wanted to see one of the socalled
ornamental electroliers before he changed his mind.
Mr . Hoffman , repesenting the P.G & E. Co. upon questioned by the Mayor, explained the
type of electrolier that would be placed by the company under the various plans proposed,

shaved wooden poles, steel electroliers, etc. :He also explained the reason_ for the heigh
of the light poles.
IMr. Norman_Cruikshanks,of the Goldtree.Tract ..stated that he and his neighbors, ( the
ones he talked to ) would be against wooden poles and steelelectroliers with overhead wires
but they would consider favorable, the placing of electroliers with underground wiring.
Mr. Hodgson, Escuela Alta is for Street Lights but is opposed to anytype of overhead wiring.
Mr. Hanks, Mira Monte is against wooden poles with overhead wires, but would be interested)
in orsra- ,rental light standards about 12 ft. high witha fancylight on top and not hanging
over the street.
Mr. George Mack of Foothill Gardens stated that he would approve ornamnetal

electroliers with underground wiring but as explained by Mr. Hoffmanof the P.G & E. Co.
to theCity Couhcil, he would also like to see the cost figures on purchasing, installation
and maintenance of and underground conduit system.
"ir. Hoffman of the P. G & E. Co. stated that the company's policy is not to service any
,
underground systems owned by a private corporation and that the City would be responsible
for any underground sytems installed and that the P.G & E. Co. would only-deliver power to
one point on the system and the City. would have to actually distribute the power from that
point which would alsoinclude maintenance'of the standards, globes, etc.
Mr.Clarence Lange, Escuela Alta is against a cheap lighting system of any kind, but would
accept steel electroliers, with the id ring from the rear of the lot to the electroliers,
He stated further, that he is in favor of a good lighting system for the streets of the
city and believesthat in his area, that they are absolutely a necessity.
Mr. Paul Wagner of Mira Monte is against street lights ard'.he believes that no street
lights are wanted by any of the residents of the Nira Monte area. He further stated that the
roblems that would arise over the placement of such a lighting system a s to location of the
poles and the type system installed by the city would harass the City Council and the City 1
officials forever. He suggested that a,"-.form questionnaire" should be sent to each resident
inthe city by tract, so that they could decidel0hat every par-ticular area was desirous of
installing.
Mr. Randol Ward of the Park View Homes Area stated he believes that some type of lighting is
necessary and that he was personally for the simplest and cheapest type possible and more-
over, with the amount of wires corssing the streets of the city at the present time, one
more wire to a light pole would not be anymore annoying.
Mrs. Ella Holmes of Foothill Gardens asked the question, whether one tract wanted wooden
poles and another tract desired steel poles, would the residents of each tract have their
desires fulfilled or vould one type be placed throughout the city?
Mr. Bradley of Mira Monte stated he does'.not believe that street lights are wanted or are
necessary and does not know of any reason why they-should be placed in these tracts.
Mr. O'Farrell of McMillan Manor wanted to know if the addition of new lighting in these
areas would add any new taxes?
Mrs. Dyer of McMillan Manor stated she did not see any reason for street lights but she
wculd like to see someone clean out the creek between McMillan Manor and Foothill Blvd.
Mr. Welsh of McMillan Manor wanted to -know if the owners of property over which the. wires
would go to the poles from the rear lot utility lines, that if the owmers did not give the
easements, would the city or the P.G & E. condemn the property for said easementor
right -of -way?
Mr. Frank Truchan of Escuela Alta said that he would not be interested in any type of
street lighting unless it was ornamental and had •underground conduits.

Mr.'Greenelsh.- of.Park View Homes stated.he.was.ih favor of street lights but personally
hopes -that steel poles are used instead. of the rough wooden utility poles.
Mr. Eckrode of Park View Homes..want.ed.to know if it .were at all possible to use some
of the present utility poles for street lighting?
Mr.Fitz of McMillan Manor suggested that possibly a show of hands of the people present
that evening by tracts, so as to get an opininn of those present.
Mr.Pollett asked,if it is the requirements that all new tracts in the city be required
to provide street lighting as part of the tnstallation of Public Convenience in the tract?
Mr. Brazil, at this time wished to thank the Mayor and Council for the courtesy they ext
to the people present and beingable to explain their views or ask questions regarding the
lighting, also, allowing them to give their opinion on this important problem. Mr.
Brazil asked the people present to give the City Council a round of applause for their
courtesy and their patience.
After some discussion by the Council and suggestions from the audience as to the
proper method of determing the people's choice, as to whether they want lights or not and
the type of lighting desired, and as to whether a petition or a post card questionnaire
be sent by the City,- the Mayor suggested after all the suggestions are considered,
that the City a)uncil would go over all the comments of this meeting and try to de-
termine the best possible way to get the majority's opinion regarding street lights.
The Mayor asked anyone who would he interested to handle petitions in the various tracts
to leave their name with the City Clerk, and if petitions were the answer arrived at,
the would be notified for their help.
The Mayor thanked everyone for taking part in the important item of the growth
of the City.

On motion of Kenneth W /Jones, seconded ..by. Lowell E.Christie,the Mayor was authorized
to sign Agreement for Temporary Transfer of Vehicular Equipment, for Civil Defense Fire
Truck No. 29.
At this time the 1955-56 Budget was presented to the Council for their consideration
by the City Administrative Officer, Mr. Richard Miller.
On motion of Warren G.Edwards, seconded by Kenneth W.Jones, the Budget document was
ordered received and filed for further study by the Council. The Mayor called for budget
study session for June 13th, June 14th and June 15th and a Special Called Vieeting to be a
held on June 27th; at 7:30 Y.M. for a Public He --ring on the Final 'Lpproval of the budget.
The City Clerk was instructed to advertise in accordance withthe new charter for the public
hearing on the Budget.
Old Business a
Re: Report of the Traffic Committee;
On motion of Kenneth W /Jones, seconded by Lowell E.Christie, the recommendation of
the Traffic Committee on item 55 -6 -1C regarding temporary parking for patrons of the
Wineman Hotel, and on item 55 -6 -2C, the placing of "Hospital Quiet Zone Signs" at the
two hospitals, was approved.
The report of Warren G.Edwards regarding the acquisition of property at the proposed
parking lot known as the "Maggie Brown property" was ordered received and filed, and the
City Engineer, Homer Hamlin, in making plans to pave and grade this parking lot is to
include the grading and paving of the alley adjoining the lot going from Broad St. to
Garden St. on motion of Warren G.Edwards, seconded by Kenneth W.Jones.
The communication from the N,,tional Auto Club regarding the Inter City Accident
Prevention contest was ordered received and filed on Motion of Kenneth W.Jones, seconded
by Lowell E.Christie.
The communication from Leon Verrett regarding the tentative subdivision in the vicinity
of Laurel Lane and Orcutt Road and Johnson Ave. was held over so that a public hearing
could be held regarding the formation of an Assessment District in this wea for sewer and
water, onJune 20th, 1955,
The Proposed Ordinance s regarding the regulation of moving buildings in the City of
San Luis O''ispo and an ordinance r quiring the capping or covering wells, were referred to
"r. Richard Miller to study and bring back recommendations to the Council, of the proper
type of ordinances for the City of San Luis Obispo.
The report of the City Clerk regarding the turning over of keys to the old city library
building to the County Clerk was ordered received and filed.
The report of the City Engineer regarding the giosquito control problem and the cleaning a
of drainage ditch adjoining the McMillan Tract, was ordered held over for further study.
Communication from the S.L.O.Reoort requesting that the City of San Luis Obispo place
legal advertising with the Reporter was ordered received and filed on motion of Kenneth IV.
Jones, seconded by Lowell E.Christie, and the mat er would be taken up at the budget sessions,
starting June 13, 1955. The City Clerk was instructed to notify Mr, Friederich of the
Council's decision,;
Comm. from R.R.Duncan regarding the acquisition of a small piece of property adjoining
his at the corner of Toro and Third Street was ordered investigated by the City Clerk and
to report to the Council, the best method of handling this problem, also, the City Clerk
was instructed to write to Mr,DUncann of the Council's decision,
