The City Attorney reported.on his negotiations with Miss Mary hat.hway for the acquisition of an easement over a portion ofland owned by her adjacent to the Snat Rosa Park. i`ir. Houser reported that I.1iss Hathway's attorney arranged for the. City to obtain an easement over thie property for X1.00 per year. The City Clerk reported to the Council regarding the letter of James R. Butler regarding a duplicate charge for ':Deed Abatement on their property for 1954. Upon investigation the City Clerk recommended to the City Council that a refund be made for the overcharge for this burning. On motion of Kenneth W..Jones, seconded by Warren G.Edwards, the City Clerk was instructed to refund the amount of the Peed Abatement charge. Mr. Richard Miller reported to the Council, the outcome of grading of examination for the Fire Captain for the fire department -- as only three men passed the written ex- amination, it was recommended by the Fire Chief to Mr. Miller,. that Melvin Jones, Engineer, be promoted to Fire Captain and Gerald Babcock, fireman, be promoted to Fire Captain- - 4th step -- at $396. per month. Re: Communication from Dr. Joseph Middleton regarding statements he was asked to present on b.-half of three individuals regarding alleged indignities and brutalities at the hands of members of the City Police Dept. The matter was referred to the City Attorney for investigation and report to the Council at a later date. Re: communication from the Bureau of Census rega ding Species Census for the City of San Luis Obispo -- Mr. A.Ross Eckler, acting director, stated that the Regional Supervisor of the bureau of Los Angeles will get in touch with Mr. Miller in order to make arrangements for the census. Re: Report of Homer Hamlin, City Engineer, regarding parking layout for the ,Old Mission Garage property at I`Ionterey and Chorro St. Mr. Hamlin explained to the Council, showing a sketch of possibly being able to park a minimum of 30 cars at the Old Mission Garage property at f:Ionterey and Chorro Streets and also an entrance might be worked out thru the rear of the lot to 1,1onterey Street. The Mayor requested that dlr. Beck study this problem and bring his recommendations to the Council at the next meeting regarding possible ac- quisition of this property for " off-street-" parking. Mr. Richard Miller reported to the Council regarding the meeting he attended with the County Planning Commission regarding a new subdivision ordinance for the County of San Luis Obispo; one of the main features of this ordinance is that the County Planning Com- mission would cooperate with the City Planning Commission for any planning within a three mile limit surrounding the corporate limits of any city. E.Christie, U;arren G.Edwards, Kenneth II.Jones,Fred H.Lucksinger Noes: None Absent: None Re: In the matter of Resolution No. 2 -55 of the City Planning Commission recommending un- favorable action on the proposed Rezoning of a portion of Lots 4,5, and 6 of Block 12 of the Old Town ( I''Iadeline (C.Welsh) -- The Mayor requested that Mr. Kinney give a history of the zoning on this parcel of land and past actions of the Planning Commission regarding same. Mr. Kinnev explained to the Council that the original zoning map of the City of San Luis Obispo, it showed this property.was zoned as " Residential property" but that in- 1950 Mrs. Covell acting for her daughter, Mrs. Welsh, appeared be`'ore the Planning Com- mission requesting that this property be zoned to " Commercial" and the Plan ningCommis s ion turned down the request, but the City Council at that time, allowed the property to be zoned C -1; in 1954 when the new Zoning Ordinance was being considered for adoption, this property was again studied, uponthe advice of the consultants and the planning commission; it was zoned back to " residential status ". Mrs. Covell petitioned the PlanningCommission for change in zoning, and after two public hearings, the Plan ningCommission denied the request stating that this would be " spot zoning" and that logically, this is not a com- mercial district. The Mayor thanked A1r. Kinney for this report. Mrs. Covell then appeared on behalf of her daughter requesting that the Council again overrule the Plan ningCommis s ion and rezone this property as C -2. On motion of ;warren G.Edwards, seconded by Nels Beck it was moved that the action of the City Planning Com- mission be upheld and that the request of Mrs. Welsh for rezoning be denied. Kr. Bob Corcoran appeared before the Council representing S.L.U.Chamber of Commerce re- questing information regarding the Policy of the Council of tearing down old and unsafe buildings and wanted to know what the policy of the Council was regarding the site for these buildings that are condemned and torn down. He stated that most of these lots are left in a dirty and unkept condition. The lot in question, is on the southwest corner of Monterey and Chorro Streets on the Old Mission corner. Mr. Corcoran said the Mission is a great Tourist attraction but that the deplorable appearance of the lot with its broken boxes etc. do not make a very desirable picture for people who wish to take pictures of the Mission. 1 r. Corcoran asked that the Council please look into not only this property, but other properties that are demolished - to leave the site in a clean and sanitary condition. Mayor Lucksinger thanked Mr. Corcoran for bringing this matter to the Council's attention and referred the matter to Mr. Houser, City Attorney, to investigate and see if any city ordinances are being violated. [sir. E.C.Anderson appeared before the Council regarding his dismissal from the City Police ,Dept. and presented to the Mayor, a petition signed by 212 persons requesting the Council to reinstate Lieut. E.C.Anderson to the City police dept. Mr. E.C.Anderson then read a prepared statement of the actions and history of his dismissal from the city service by the Police Chief W.L Burns, and the Administrative Officer, Richard D.Miller. 1"Ir.Richard N.iAiller, Administrative Officer, then explained the reasons behind his actions in dismissing Mr. E.C.Anderson from the Police Dept. Mr. Miller had his letter of July 15, 1955 to Lieut. Anderson, informing him of his dismissal and the reasons for same, read by the City Clerk. Mr. (Miller also had the City Glerk read a.leter frorrs'Rrs. Ellsworth regarding the debt ow,d herby Mr. Anderson and Mr. Miller's answer to her letter. Mr. (Miller asked the Citv.Clerk to read the letter from Chief Burns to Mr. Miller regarding contacting Mr. Anderson regardinc Ivir. Anderson's debts: at Ellsworth Market about paying same. After hearing Mr. Anderson and Mr. Iiiiller, the Mayor a sked if anyone else present, either on the Council or inthe audience, had anything to add to this matter. There being none the Mayor called for five monutes recess so that the Council could discuss this matter. The Council, with the representatives of the press, both daily and weekly, ad- journed for five minutes. When the Council reconvened, the Mayor reported he believed the Council had come to a decision regarding the dismissal of E.C.Anderson. n motion of Nels Beck, seconded by 4tiarren G.Edwards, it was moved that the action of the dministrative Officer., Mr. Richard Miller, be upheld in that the dismissal was based n a violation of Council Policy, regarding employees of the city paying their just debts nd that Mr. Anderson was not being dismissed because of his duties as a Police Officer. he 11Iayor then called for a roll call vote: yes: Nels Beck, Lowell E.Christie, L.,arren G.Edwards, Kenneth W.Jones, Fred H.Lucksinger oes: None bsent: None r.
