Ray Heer of the Presbyterian Church. Roll Call: Present: Nels Beck, Lowell E. Christie, Warren G. Edwards, Kenneth W. Jones, Fred H. Lucksinger ' Absent: None The minutes of the meeting of February 18, 1957 and February 25, 1957 were approved as. presented. The claims against the City for the month of March, 1957 were ordered paid, subject to the approval of the Administrative Officer, on motion of Kenneth W. Jones, seconded by Nels Beck. Ordinance No. 39 (1957 Series) An Ordinance Calling a Special Municipal Bond Election was finally passed on motion of Kenneth W. Jones, seconded by Lowell E. Christie by the following roll call vote: AYES: Nels Beck, Lowell E. Christie, Warren G. Edwards, Kenneth W. Jones, Fred H. Lucksinger NOES: None ABSENT: None COMMUNICATIONS Comm. from Department of Water Resources regarding protests to City application for y ;ter rights for the Whale Rock Project and setting up a schedule for meeting with rotestants. Mr. Houser, City Attorney, reported that the representatives of the City, the College, the Men's Colony, and State Attorney General's Office were to meet in order to go over the facts and the propositions, which will be made at a meeting to be . held with representatives of those organizations protesting the application and also the individuals protesting the application for-water from Old Creek. Mr. Houser.further reported that the time for answering the protests have been extended to May 20, 1957. On motion of Nels Beck, seconded by Kenneth W. Jones, the communication was ordered received and filed. 1 2. Comm. from Union Oil Company of California for water service outside the City of San Luis Obispo to service a booster Dump station northeast of San Luis Obispo. On- motion of Kenneth W. Jones, seconded by Lowell E. Christie, the request was denied on the basis that this this was contrary to Council policy, that of extension or relaying of a water system outside the City of San-Luis Obispo. 3. Comm. from General Services Administration regarding the extension of present lease agreement for office space in the City Recreation Building was accepted on motion of c . Warren G. Edwards, seconded by Nels Beck. 4. Comm. from David Romero, City Engineer, recommending acceptance by the City of Ferrini Heights No. 1, Tract 104 was ordered held over to next meeting. -�� 5. Comm. from City Planning Commission regarding the recommendation that the portion of Third Street from Kentucky Street west to the freeway be abandoned was referred to the X City Attorney for preparation of proper resolutions. 6. Comm. from C. G. Holmberg regarding the traffic situation at Marsh & Santa Rosa and Marsh & Osos, and requesting some traffic control at these two corners during the busy periods. A discussion with the City Council by the City Engineer, Police Chief, and "=y" Administrative Officer regarding the traffic problem on Marsh Street was held and the various problems that must be met before a definite solution is found were discussed. The City Council instructed the traffic committee to continue their study of this problem, particulally the installation of No Left Turn signs onto Marsh Street to see if this would eliminate some of the hazard. 7. Comm. from W. E. Schofield, Chief of Police, requesting permission to send.a police officer to the Check Investigators Association meeting to be held in Los Angeles on April 25th and 26th, 1957. Attendance is recommended by Richard D. Miller, City Administrative Officer and the request was granted on motion of Nels Beck and seconded by Warren G. Edwards. 1 8 . Comm. from W. E. Schofield, Chief of Police, requesting permission for himself and ' Lieutenant Lincicum to attend the Peace Officers Administrative Institute in Los Angeles on March 5, 6, and 7, 1957. Attendance is recommended by Richard D. Miller, City Administrative (Officer and the request was granted on motion of Kenneth W. Jones, seconded by Warren G. Edwards. . Comm. from California Roadside Council regarding Senate Bill 666, which would regulate utdoor advertising signs along freeways and scenic highways; Also the winter bulletin of alifornia Roadside Council. Bureau of Public Roads; also a packet of forms and inventories necessary to' complete this report was ordered received ) and filed on motion of Kenneth W. Jones, seconded by Lowell E. Christie and the information requested was referred to the City Engineer for completion. The request of San Luis Obispo Chamber of Commerce to set Monday, Tuesday and Wednesday - March 18, 19 and 20, 1957 as our annual "Clean Up Week" as approved on motion of Warren G. Edwards, seconded by Lowell E. Christie. On motion of Kenneth W. Jones, seconded by Nels Beck, the following contract payments were authorized: The City Council would like to take this opportunity of answering Mr. Ferrini's statement of opposition to the Whale Rock Project published in last Friday's Telegram- Tribune. We appreciate Mr. Ferrini's interest in our problem and the thought he has given to it, but we also realize that there are certain points which have not yet been brought out in connection with the Whale Rock Project. In regard to Mr. Ferrini's statement that a discrepancy exists between the Bureau of Reclamation report and the one prepared by the State, it should be pointed out that the 1949 study by the Bureau of Reclamation was based on "rough reconnaissance.. First, we would like to quote briefly from the Interim Report of the State Water Resources Board, published in October, 1955: "The most pressing water resources problem facing San Luis Obispo County is considered to be the development of an additional water supply for the City of San Luis Obispo." (page 28, item 3) "The Whale Rock Project on Old Creek should be constructed as the initial feature of the plan presented in this report for conservation of the local surface runoff of San Luis Obispo." (page 28, item 9) From all information available to the city including.an Army study in 1941, a Bureau of Reclamation report in 1949 and the foregoing Interim.Study of the Water Re- sources Board in 1955, Mr. Ferrini's proposal would not supply the water needed by the City-of San Luis Obispo for its future growth. Mr. Ferrini's statement that the Laguna Lake Project would be twice the Whale Rock Project area would be correct as far as surface area is concerned, but the volume of water stored would not be at all comparable to that of the Whale Rock Project. The Bureau of Reclamation report stated that storage of 5,000 acre feet of water could be obtained at the Laguna Lake site which compares with 40,000 at Whale Rock. The Whale Rock Project would guarantee a safe annual yield of 8,900 acre feet of which the city would receive 4,900, the college 3,000 and the mens' colony 1,000. Because of evaporation losses, however, the Laguna-Lake project would not assure any safe annual iy eld during- a series of dry years. It then becomes obvious why all three of these comprehensive and expert engineering reports gave no serious consideration to the Laguna site. _The Army report and the Bureau of Reclamation study went further than the Laguna Lake site and considered the possibility of damming up San Luis Obispo Creek near Avila in a much larger project to impound all flood waters from the sources mentioned by Mr. Ferrini as well as water from other sources. This proposal was finally rejected because the safe annual yield was determined to be not more than 2,000 acre feet. In addition, there would be problems of contamination and a high financial cost due to excess land condemnation and relocation of the present 101 expressway below the city. Mr. Ferrini's statement to the effect that the city is rushing into the Whale Rock Project prior to the publication of the final report by the State Water Resources Board is not a valid criticism, since Mr. Robert M. Edmonston, Principal Hydraulic Engineer for the Board stated, in an appearance before the County Board of Super- visors last November that the Interim Report contained all the essential conclusions to be found in the Final Report, which is now in the hands of the State Printer in Sacramento. In regard to Mr. Ferrini's statement that a discrepancy exists between the Bureau of Reclamation report and the one prepared by the State, it should be pointed out that the 1949 study by the Bureau of Reclamation was based on "rough reconnaissance.. `Y "yU r 7" I field estimates of stream run -offs and reservoir capacities" (page 59). The recent state study was part of a three -year exhaustive survey of the enti prepared at a cost of $81,000.00, and additional records of rainfall and runoff were available to the state which permitted a more exact estimate of the safe annual yield for the Whale Rock reservoir on Old Creek. We would like to repeat previous statements that no existing water rights in the Cayucos area will be impaired or infringed upon as a result of the Whale Rock Project. They are protected as a matter of.law. Any negotiations conducted with these people prior to actual formal hearings.would be for the purpose of granting them water over and above their existing water rights. In obtaining water from the Whale Rock project site, the city and state agencies would only be entitled to and are only considering surplus waters which are now wasting into-the ocean.. Mr. Ferrini's quotation from the Reclamation Report to the effect that most of .the city's water needs could be supplied from the Salinas Dam to the year 1980 is true if the entire safe annual yield of that reservoir could be utilized by the City. However, the city is limited to 3,000 acre feet a year. We have attempted to get more water from the Salinas Dam and have been unsuccessful. We anticipate that the City will be. out of water by 1960. It is therefore mandatory that we gain an additional source of water immediately. With reference to Mr. Ferrini's appeal for the recreational aspects of Laguna Lake, last year the City joined forces with the Wildlife Conservation Board of the State of California in attempting to develop a warm water fishery at Laguna Lake. However, this project has not progressed, because the Wildlife Conservation authorities are not convinced that the Laguna Lake would receive and hold sufficient amounts of water to sustain fish life during dry spells. Our neighbors to the west also expressed considerable opposition at that time to the taking of their land. At this time Mr. Francis McNamara appeared before the City Council regarding his client, Shoemaker Industries, who is making arrangements to purchase a parcel of land adjacent to the City of San Luis. Obispo and would buy this land if the following questions could be answered: 1. Could the property be annexed to the City? 2. Could the property be connected to the Sewer? 3. Could adequate water be made available to this property? 4. Would the City share in the cost of construction of this water line? After some discussion by the City Council, Mr. McNamara and various department heads concerned, Mayor Lucksinger suggested with the Council's permission, that he prepare a letter for his signature answering the questions presented by Mr. Shoemaker. The suggestion was approved on motion of Warren A. Edwards, seconded by Nels Beck. OLD BUSINESS 1. Following.is the Traffic Committee report: 57 -3 -1C. Reference made to the letter of C. G. Holmberg in regard to the traffic conditions at Santa Rosa and Marsh Streets and Osos and Marsh Streets was referred to the Traffic Committee for further study. 57 -3 -2T. The matter of yield right -of -way signs in place of certain stop signs in the City was referred to the City Attorney for preparation of Ordinance. 57 -3 -3T. The matter of cars often blocking the Standard Oil driveway on Santa Rosa Street near Monterey was ordered held over for further study by the City Engineer. 57 -3 -4T. The matter of installing stop signs on Bond at Kentucky was referred to the City Attorney for preparation of necessary resolution. 2. Comm. from David Romero, City Engineer, in reply to the letter of Mr. A. M. Nash, District Engineer of Division of Highways regarding Mr. Nash's objections to the South Street overpass was ordered received and filed and the City is to consider a joint meeting with the City Board of Supervisors, if.necessary, to present their thinking to the Division of Highways. 3. Comm. from California State Assembly, office of Frank G. Bonelli regarding Assembly Bill to ban the sale of crime horror comic books was ordered received and filed on motion of Lowell E. Christie, seconded by Warren G. Edwards. 4. Comm. from Carlos Moerman regarding the sale to him of a portion of City owned propert! was referred to the City Engineer and City Clerk for preparation of notice and appraisal of minimum bid. 5. Comm. from San Luis Obispo County Bowmen's Association regarding the use of the City Hall basement for an indoor archery range was ordered held over. Comm. from the Southern Pacific Company in answer to the request of the City Council for an advance of $30,000 as a part of their share of construction of Johnson Street Overpass per the P.U.C. Decision No. 53850. The communication was ordered placed on the Agenda in 30 days.
