Lucksinger Absent - None Mr. Houser, City Attorney, reported to the City Council on the actions-taken regarding the Writ of Prohibition which has just been quashed by Judge R.-B. Lyon, Superior Court Judge, San Luis Obispo. Mr. Houser then explained the law regarding future Council action on consideration of the adoption of Ordinance No. 111 and 112. Mr. Houser stated that the Council was not required to hold additional meetings legally, but that the Council should advertise any meetings at which they would consider the final adoption of these two ordinances in the public press, so that anyone who had not appezed previously C0 could appear and be heard. M Mn Houser further stated that discussion could be limited to only those who have not been heard previously. It was moved by Councilman Smith and seconded by Councilman Beck that the City Council cancel the adjourned meeting of May 18, 1959, at which time Ordinances 111 and 112 were to be heard. Motion carried. It was moved by Kenneth W. Jones, seconded by Nels Beck that the City Council hold a public meeting in the Council Chambers at 8:00 pm on April 30, 1959, to consider final adoption of Ordinance 111 and 112. Motion carried. It was moved by Richard G. Sleight, seconded by Nels Beck that the City Clerk adver- tise the public meeting in the public press on Wednesday and Thursday, April ' 29 and 30. Motion carried. On motion of J. Barry Smith and Richard G. Sleight the meeting adjourned. Approved this 29 day of May, 1959. / ,/ SPECIAL CALLED MEETING April 30, 1959. 8:00 PM Roll Call:. Lucksinger Absent - None Mayor Lucksinger explained the purpose of the meeting was the consideration of the ' final adoption of Ordinance No. 111 (1959 Series), "An Ordinance Rezoning Prop- erty on Johnson Avenue From R -1 to C -1 -S" and Ordinance No. 112 (1959 Series), "An Ordinance Rezoning Certain Properties From M to R -1 and From M to R -3." The Mayor declared the public meeting open. APR City Clerk reported that he had received 20 communications protesting the estab- lishment of a shopping center on Johnson Avenue. McDermott 2900 Johnson Avenue Mr. & Mrs. Hank Bettencourt 3045 Johnson Avenue At this time Mr. Kogan, 242 Ferrini Road, appeared before the City Council protesting the rezoning to C -1 of R -1 area, and the establishment of a shopping center on Johnson Avenue. Further, Mr. Kogan stated he was disturbed over the attempted rezonings to R -3 in the vicinity of Teach School where he lives, and where the neighbors had to constantly appear before the Planning.Commission and City Coun- cil in order to protect the R -1 zoning for single families. He stated there was something wrong ina program that requires the people to fight for single family protection. Mr. Louis Isola appeared before the Council protesting the rezoning and establish- ment of a shopping center as proposed, and he cited as an example the work being don 1 done at the present time in the Southwood Tract by Lindero Investment Company, which he claims is ruining the natural.beauty of the area. There being no further comments from the people present, the public hearing was closed and, ORDINANCE NO. 111 (1959 Series), "An Ordinance Rezoning Property on Johnson Avenue From R -1 to C -1 -S" was finally passed on motion of J. Barry Smith, seconded by Richard G. Sleight, on the following roll call vote: AYES: Nels Beck, Kenneth W. Jones, Richard G. Sleight, J. Barry Smith, Fred H. Lucksinger NOES: None ABSENT: None ORDINANCE NO. 112 (1959 Series), "An Ordinance Rezoning Certain Properties From M to R -1 and From M to R -3" was finally passed on motion of J. Barry Smith, seconded by Richard G. Sleight, on the following roll call vote: AYES: Nels Beck, Kenneth W. Jones, Richard G. Sleight, J. Barry Smith, Fred H. Lucksinger NOES: None ABSENT: None On motion of Richard G. Sleight, seconded by Kenneth W. Jones, the meeting adjourned. Approved this 29 day of May, 1959.
