1. City Council and staff discussed water rights at Santa Margarita take and the
City's status is regards to the application by the County of San Luis Obispo
for a change in place of use of the water rights assigned to-the City of
Paso Robles which are being transferred to Zone II water district.
On motion of Councilman Shipsey, seconded by Councilman Graves, the-meeting
adjourned to the City Hall, 10 A.M., June 20, 1962.

City of Paso Robles:
City Staff: Mayor Schwartz; Mr. Blake, Councilman; Mr. Madden, City Attorney;
Mr. Tucker, Administrative Officer; Mr. Munger, City Engineer.
Also present: Mr. I. Kogan, Chairman of County Pure Water Association.
1. Mayor Davidson opened the meeting by stating that the purpose of the meeting
was to discuss development of the water rights and that the City felt it
has a direct interest in the.application for enlargement of the place of use
because of the historical right established at Santa Margarita Lake. Mayor
Davidson then introduced Mr. Robert.Edmonston, the City's consulting engineer.
Mr. Edmonston: The purpose in being here is to expl4
the reasons and possible necessity for enlarging the

and Water Conservation District. In discussing this

As long as we do not know these answers, the only thing the City can do at
this time to protect itself is to file a protest.
Mr. Madden: To explain something of the County's problem, ground water in
the area.of Zone._II is not good. The.City of Paso Robles has fully
developed its ground water and wells are going dry in places.. Atascadero is
having problems. it was decided to enlarge the place of use to take in more
area and not to enlarge the amount of water allocated. The City of Paso
Robles assigned to Zone II its water and will have to have ail enlarged
place of use. For economical reasons, with.the enlarged place of use and
depending on a favorable outcome of the pending bond election.in September,
they could build the diversion dam now and supply water to the state hospital
and other facilities at this time. This would give the users an adequate
supply of water for probably the next 10 years, and yet they would not have
to face the economical burden of construction the entire water system
facilities at this time.
kr. Born stated that it should be brought out that Salinas Reservoir was
not designated by the Santa Rita Project, and the allocation could be firmed
up which would permit an earlier staging of the Santa Rita Project because the-
use of the water could be used on an interim basis.
Mr. Madden stated that as this is going to be a staging project, they are
interested in getting all the details worked out and protecting their water
rights, which were for use under their permit. Applications for rights at
Santa Rita have been assigned to the County for Zone II provided certain
uses are met.
Mr. Born said that an agreement had been made between the Flood Control
District and the City of Paso Robles whereby Paso Robles Creek filings
were assigned to the Flood Control District and at the same time and in the
same agreement, filings that the City of Paso Robles had at Salinas
Reservoir were also assigned. The prupose of this agreement was to permit
assignment of applications which the City of -Paso Robles held on Paso Robles
creek.
Mr. Edmonston asked if they feared the project would not provide water in time.
Mr. Gates stated that it was for a diversion of the capital costs.

Mr. Madden stated that San Luis Obispo is attempting to enlarge their
permit for use. The County is under contract to Paso.Robles and has to
protect their rights for a firm source of water supply.
Mr. Lee stated that the County has not asked for an increase in the amount 1
of water.
Mr. Edmonston informed him that the City of San Luis Obispo has the full
right to water under the permit, seconded only to the Army..
Mr. Born reiterated the fact that the permit now before the Water Rights
Board contemplates a change of place of use and not a change in priority in
any manner.
Mr, Kimball stated that the application came about because Zone II takes in
a certain area. It will be the same amount of water. Paso Robles has the
right of storage of 2400 acre feet.
Mr. Madden stated that when the applications were filed, two filings•were
involved; one for the City and one for an enlarged area.
Mr. Edmonston stated that he had reviewed correspondence on this matter and
that no propositions were made to the City of San Luis Obispo to set down and
discuss these problems, He referred to the Board of Supervisors letter to
the Army requesting that the City's share be cut back to 3,000 acre feet
even though the City had been using in excess of that amount.for-several
years, and further stated that.there had-been a complete lack of communication
between the Board of Supervisors and the City Council.
Mr. Edmonston then suggested that a committee be appointed to get together
and.work out these details.
Considerable discussion was held on the value of a committee, and the request
by the City for an extension of time to August 10 in which to file a protest
against the application.
Mr. Drake stated that the success of the upcoming bond.election depends upon
a solution to our problems.
Mr. Madden then stated that there should be a committee, because we have
the same goals. He stated that the City should withdraw their request"for
a time extension and see what results could be gained from the committee.
After discussion, it was decided that the present time limit of July 10
would not give the committee members enough time to meet and make recommend-
ations, due to the heavy workload, and that the City should request that the
County be asked to consider concurring with this request at their regular
' meeting on June 25:
Mayor Davidson then appointed the following persons to represent the City:
Robert Edmonston, William Houser and Price - Thompson.
Mr. Lee indicated that he would appoint the representatives from the County
at the next meeting of the Board of Supervisors. .
It was agreed that the report and recommendations of said committee would
be presented to the respective legislative bodies on August 6, with copies
of the report available no later than August 3, 1962.
Meeting adjourned to Monday June 25; 1962 at 7:30 P.M. on motion of Council-
man Graves, seconded by Councilman Shipsey.
