On motion of Councilman Graves, seconded by Councilwoman McNeil, the following

The minutes of February 5, 1964 were approved as read.
On motion of Councilman Miller, seconded by Councilwoman McNeil, claims agai:ist
the City for the month of February, 1964 were approved, subject to the approval
of the Administrative Officer.

1. J. H. Fitzpatrick, City Clerk, reported on bids receive' for alterations to
the City Hall. They were as follows:

R. D. Miller, Administrative Officer, recommended that the Council a -: ,pt the
low bid of Arnold A. Volny.
On motion of Councilman Miller, seconded by Councilman Graves, the low bid of
Arnold A. Volny was accepted. Motion carried.
-. At this time the City Council considered the penalty for late payme.t for
Cal Poly on the sewage treatment plant.
R. D. Miller, Administrative Officer, recommended that the City Council
waive the penalty. The amount involved was less than $50 penalty and late
payment was due to clerical oversight by Cal Poly.
Mr. Miller said he felt the City was more interested in collecting the principal

amount than in collecting penalty.
On motion of Councilman Miller, seconded by Councilman Whelchel, the Council
waived the penalty. Motion carried.
3A. At this time the City Council considered the proposed pay plan as recommended
by Richard D. Miller, Administrative Officer.
R. D. Miller explained the basis of the report and recommended that the City
Council approve a 47. pay increase for all employees.
3B. Communication from the Administrative officer regarding working conditions
and fringe benefits for City employees which included a $6.00 per month
contribution towards the employees health plan and an increase in the amount
of sick leave that any employee can accumulate from sixty to ninety days.
On motion of Councilman Graves, seconded by Councilwoman McNeil, that the
Council adopt the pay plan and also the fringe benefits as recommended
effective July 1, 1964. Motion carried.
9. On motion of Councilman Miller, seconded by Councilman Whelchel, the fe'.lowing
resolution was introduced. Resolution No. 1256, a resolution authoriziag
execution of agreement with the State of California for improvements on
California Boulevard.
Passed and adopted on the following roll call vote:

10. The following report was received from the Council committee st_.. .-.-aimal
problems in the City of San Luis Obispo:
"The following is a brief report by the Council Committee appoir.t.,:d for the
purpose of studying the proposed increase by the Woods Animal SI ;41ter from
$.175 per month to $1,000 per month for providing the City with -;.::.erinany
services.
The Committee, consisting -.of Councilman Whelchel, Administrative Zdicer
Miller, City Clerk J. H. Fitzpatrick and Police Chief William SCLA "•_eld, has
studied this quite carefully and feels that the City could do a class
job of handling the problem for a net cost of $750 per month. It would
therefore be our recommendation that we make an offer to the Woods Animal
Shelter for a compromise figure of $750 per month or $700 per month if the
society wished the City to conduct the animal drive to stimulate the sale
of dog licenses.
If this is not satisfactory to the Woods Animal Shelter, it is sugges+ that
the City make provisions for its own operation starting July 1, 1964. T.f the
City undertakes the work, we feel that it should be done in a first c .,,s
manner with an attractive radio - equipped vehicle, a full time uniform - -'
employee and a contract with the Woods Animal Shelter or a local vetF_:.aarian
for sheltering services and for destruction of unwanted or sick anii•:;
The Committee will be in a position to discuss this matter in greater detail
at the Council meeting if this is desired."
Councilman Whelchel briefed for the Council's consideration the abv.e
communication.
On motion of Councilman Greves,seconded by Myor Davidson, that the r ^ ,)ort
be accepted and R. D. Miller be instructed to contact Woods Animal
and see if they wished to accept this contract under the conditions
recommended by the Council Committee. Notion carried.

Mayor Davidson thanked the committee for their good report and
recommendations.
11. The following communication was received from the Planning Commission
recommending a small subdivision on an extension of Gerda Street:
"Resolution No. 19 -64 of the Planning Commission recommends approval of a
Minor Subdivision on an extension of Gerda Street as a half street, subject
to the following conditions:
1. Curb to curb bulb diameter to City standards.
2. A one foot strip to be retained by the City between the half street an"
the adjoining property.
3. The existing bulb to be straightened out on the north side of Gerda
Street by the provision of curb and gutter and the landscaping of ttii-
portion thus detached.
This application has been the subject of considerable discussion between
the Con ®ission and the applicants. In view of the fact that the property
owner on the opposite side of the proposed extension would not cooperate in
the installation of a full street, the Commission felt that it would ba
reasonable to make an exception to their policy against half streets in this
area."
City Engineer, D. F. Romero, presented a sketch of a strict interpre :::ion
of a Planning Commission action and presented a transparency showing e.
smaller bulb and smaller sidewalk which, in his opinion, more closely
represented the intent of the Flanning Commission action.

a proper basis for orderly development.
Councilman Miller explained to the Council.the problems iuvoly by these
property owners in trying to develop their property which is przc:ently
landlocked.
On motion of Councilman Miller, seconded by Councilman Whelchi.!. _that the
Council grant an exception and allow half street extension in ^..?.:iordance
with the recommendation of the Planning Commission.
Passed on the following roll call vote:

4. At this time the City Council "held a public hearing on Planned Devel—.•ment-
YmItiple Residence on Foothill Boulevard at Carpenter Street.
Mayor Davidson declared the public.hearing open.
John Badgley appeared before the Council and explained his landscar.: ^g plans
and stated he had complied with all of the City's requirements.
The following communication was received from the Planning Commissior.:
"Resolution No. 9 -64 of the Planning Commission recommends that thi..
Preliminary Development proposal be approved with the following ec'.. :..:ions:
1. Trees to be planted along the Foothill Boulevard frontage : :. }.he
approval of the Planning Director and Traffic Committee.
2. Three year time limit.

In addition the following variances should be specified as approved:
1. Parking encroachment in the Foothill Boulevard set back area as
shown on the plan.
2. A stairway encroachment in the Carpenter St. setback area as shown
on the plan.
3. Allow 9' parking spaces under building facing Carpenter Street.
This application is for 61 town house type apartments on slightly over 2
acres of which 12 acres are presently zoned R -3.
The proposal included a swimming pool, sauna baths, laundry and other
facilities. It is intended to retain the creek in its natural state and to
add to the existing landscaping of the site."
Peter. Chapman, Director of Planning ,& Building, showed sketches of building
sites, parking layout, etc., and stated that the Planning Commission
recommends that the Council approve the precise plan also.
On motion of Councilman Graves, seconded by Councilman Miller, the following
resolution was introduced. Resolution No. 1258, a resolution approving
preliminary planned development at Foothill and Carpenter subject to
conditions set by City Planning Commission.

On motion of Councilman Graves, seconded by Councilman Miller, _.':.2 precise
plan for multiple residences on Foothill Boulevard and Carpenter was approved
subject to conditions established for preliminary plans. Motion carried.
5. Lt this time the City Council held a public hearing on Resolution No. 1236,
a resolution requiring sidewalk improvements on Cuesta between Foothill
Boulevard and Highland Drive and on Felton Way between Cuesta ana Ferrini
Road.
Mayor Davidson declared the public hearing open.
Ken Matson, 490 Felton Way, objected to the requirement of placing sidewalk
on the Cuesta Drive side of his property as there are other areas in the
City that have more pedestrian traffic than you will find on Cuesta. Also,
he questioned the necessity of placing a parkway with the sidewalk cu•.istructi•.
and hoped if he had to put in the sidewalk, that he could put it alo-ts the
curb line. He objected to the manner in which the present sidewalk resolutio:::
was presented to the property owners without first coming to the pro,�-_rty
owners.
Mayor Davidson explained the action of the City Council in attempt -_:. --o
place sidewalk in front of all properties adjacent to schools based on the
recommendation of a citizens committee appointed by the Council in ":he summer
of 1961.
Mrs. Forsyth, 324 Cuesta Drive, appeared before the Council stating :gat
through the P. T. A., she was instrumental in bringing the matter o� %4dewalk
installation to the Council's attention.
Miss Cooley, 506 Felton Way, asked if the City could force Poly to land
to open Highland Drive to Ferrini Road and also what size sidewalk woald be
required under the resolution.

D. F. Romero, City Engineer, made the following recommendations:
4' separated sidewalk on both sides of Cuesta between Cerro Romauldo and
Foothill Boulevard.
6' Integral on both sides of Cuesta from Highland to Felton
4' separated sidewalk on the west side of Cuesta from Felton to Cerro Romauldo
6' Integral on both sides of Felton Way between Ferrini Road and Cuesta
Either 6' Integral or 4' Separated on the east side of Cuesta between
Cerro Romauldo and Felton Way.
Mr. Romero explained that this recommendation was consistent with all city
standards and past city policy and would preserve most of the existing trees.
Mr. Romero continued by explaining the procedure that would be followed by the
City after this meeting if the Council decided to proceed.
1. The property owner would be notified to do the work.
2. If the property owner did not do the work within the time specified,
the City would call for bids, award the project to low bidder, and
allocate the cost to each property owner for his property only.
3. The City Council would then hold an additional hearing at which it-me the
cost to each property owner would-be reviewed and at that time the Council
would order the costs made a lien on the property to be collected with
the taxes.
At this point, the property owner would have the option of paying the
sidewalk costs within thirty (30) days, have the bills charged w.'•.i.:s the
property taxes, or request a three (3) year deferred payment at 3%
simple interest per annum which would also be collected at the ei-e time as
property taxes.
C. E. Boutin, 435 Cuesta, objected to the placing of a 6 foot sidewalk on
his property due to the shallowness and topography of his lot, which will
cost him additional amount of money to make this improvement.
H. W. Burt, 423 Cuesta Drive, objected to the requirement of plsring 6 foot
sidewalk on this street and urged that the City adopt a standare of 4 foot
sidewalk.
Councilman Graves explained the reasoning of the Council in attempting to
have sidewalk placed throughout the City.
John Nelson, 432 Cuesta Drive, objected to the requirement of placing a
6 foot sidewalk on his property due to shallow depth of lots and narrowness
of the street.
E. P. McElherne, 418 Cuesta Drive, objected to the requirement of 6 foot
sidewalk and urged that the City allow a 4 foot sidewalk.
J. Nelson asked when would their protests to the 6 foot sidewalk be
considered by the Council.
Mayor Davidson answered that they would be considered before the meeting was
over.
D. F. Romero, City Engineer, explained that at 543 Felton Way and 501" Felton
Way did not meet City standards. He recommended that the driveway at 505
Felton Way be allowed to remain as it would not create a hazard for pedestriazIO.
However, the driveway at 543 Felton is so far out of grade that it eroild be
replaced. Be stated that if the Council adopts the 4 foot integral s '-dewalk
for this area, it will start a precedent which will be difficult to live
with as this is the area of most use.

Mayor Davidson stated that he believed a 4 foot integral sidewalk should
be allowed and would not start a precedent.
On motion of Mayor Davidson, seconded by Councilman Whelchel, that 4 foot
integral sidewalk be installed on both sides of Cuesta between Highland and
Felton Way. Motion carried. Councilman 14iller voted no.
Councilman Whelchel agreed with Mayor Davidson that special considerations
should be given this area due to size of lots and topography.
J. Goodman, 405 Ferrini Street, asked who pays to relocate power poles in
sidewalk area.
D. F. Romero, City Engineer, answered that P. G. & E. pays to relocate all
utility poles they own.
0. & R. Jones, 111 Cuesta Drive, protested installation of 6' integral
sidewalk and wanted 4' integral to save use of driveway.
Mrs. Sloughter, 167 Cuesta Drive, asked why did the City required sidewalks
when the property owners did not request them.
Mayor Davidson declared the public hearing closed.
On motion of Councilman Miller, seconded by Councilman Graves, that the
following requests for sidewalk he approved:
Felton- Ferrini to Cuesta 6' Integral Sidewalk
Cuesta- West side, Felton to Foothill 4' Detached Sidewalk
Cuesta- East side, Cerro Romauldo to Foothill 4' Detached Sidewalk
Cuesta- East side, Cerro Romauldo to Felton Way - 4' Detached or Integral
Motion carried.
On motion of Councilman Miller, seconded by Mayor Davidson, that the driveway
at 543 Felton Way be replaced with standard driveway and the driveway at
505 Felton Way be allowed,to - Etiain. Motion carried.
6. At this time the City Council held a public hearing on Resolution, No. 1240,
a resolution requiring sidewalk improvements on Del Sur Way between
La Entrada and Del Norte.
Mayor Davidson declared the public hearing open.
Communication from Richard H. and Melba G. Hoffman at 107 Ramona Drive,
requesting that they be excluded from the provisions of Resolution No, 1240.
Communication from P. M. Plummer, 120 Del Sur Wav, requesting that her
property be removed from the provisions of Resolution No. 1240.
Mr. Hoffman stated that only 45% of the property owners were represented
on the petition.
Mr. Pounder, 142 Del Sur Way, appeared before the City Council stating that
he would rather not place concrete due to cost and also he does not want to
be part of forcing his neighbors with large lots to go to the expense rf
placing sidewalk.
R. L. Mock,148 Del Sur Way, explained steps taken by groups to petiti,�n
the Council to place sidewalk on Del Sur Way, without hurting any of r.is
neighbors and urged that the Council only have the sidewalk placed fo;:
safety's aake.
Mr. Simas, 126 Del Sur Way, asked that the Council take his name off the
petition as he had been misinformed as far as basis for charges are concerned
on an equitable basis or front foot cost.

Mrs. Brown, 162 Del Sur Way, urged that the Council only have the sidewalk
placed for safety of the children.
Mr. Hoffman stated that he and P. M. Plummer and Mr. Simas have asked to be
excluded from this improvement and asked what the Council has done on these
requests.
Mayor Davidson declared the public hearing closed.
On motion of Councilman Graves, seconded by Council=n Miller, the following
resolution was introduced. Resolution No. 1259, a resolution determining
that public convenience requires construction of sidewalks on Del Sur between
La Entrada and Del Norte.
Passed and adopted on the following roll call vote:

ABSENT: None
Councilman Whelchel stated he believed that the exceptions should be granted
as the need for sidewalk is on La Entrada and believed the request for
exception should be allowed.
R. D. F. Romero, City Engineer, reported to the City Council on status of
sidewalk:Installation on La Entrada from Foothill Lculevard to Deeter 'tract
and explained conditions c° right of way on this street,
Representatives of the Oui::tana 2. T. A. appeared before the City Council
' notifying them of the dangerous conditions of children walking to school on
La Entrada and Patricia Drive and urged the City Council to install. sidewaW,,.
for the protection of the children walking to school.
On motion of Mayor Davidson, seconded by Councilman Miller, the ?lowing
resolution was introduced. Resolution No. 1257, a resolution r(q-liring
sidewalk improvements on La Entrada from Foothill to Deeter Tracc, a portion
of Catalina Street and Patricia from Foothill to Highland Drive.
Passed and adopted on the follu,: .,ing roll call vote:

On motion of Councilman Miller, seconded by Councilman Graves, that the City
withhold action on trimming of the tree within 35' corner cutoff area at
northerly corner of Ramona and La Entrada until after the sidewalks are
installed and visibility checked. Motion carried.
7. At this time the City Council held a public hearing on Resolution No. 1241,
a resolution of intention to abandon a portion of Krebs Street.
Mayor Davidson declared the public hearing open.
D. F. Romero, City Engineer, reported to the Council the location of the portior.
of Krebs Street to be abandoned and that it was not needed for present or
future street purposes.
Mayor Davidson declared the public hearing closed.
On motion of Councilman Graves, seconded by Councilman Miller, that this
portion of Krebs Street is not needed for present or future street purposes
and that it is abandoned. Motion carried.
S. At this time the City Council considered the final passage of Ordinance No.
279, an ordinance regulating the planting, care and removal of trees on
streets and public places in the City of San Luis Obispo.

Archie Lux appeared before the Council questioning the need of passing
another ordinance particularly where there does not appear to be a need
for controlling trees on private property,
Councilman Miller explained the recommendation for considering an ordinance
controlling street trees and planting in the City of San Luis Obispo on the
public ways and street rights of way. He listed examples of abuses to trees
that required adoption of the ordinance.
Councilman Graves stated he feels very strongly about the removal of any
trees from the setback areas and does not agree that this should have been
removed from the proposed ordinance.
Harold Mrris questioned the right of the City to delegate to property owners
how they may use their property behind the setback line.
R. D. Miller, Administrative Officer, commented regarding budget request for
maintaining street trees, etc. The Council would determine the extent of
maintenance to be performed on street.trees and -. ;.3o whether work was to be
performed by contract or City forces.
Ordinance No. 279 was finally passed on the following roll call vote, on
motion of Councilman Miller, seconded by Councilman Whelcb.el.

12. Communication from the Board of Appeals recommending that the City Council
amend the Electrical Code for the City, was referred to the Board of Appeals
for comments of theCalifornia Society of Professional Engineers.
13. Communication from the Quintana P. T. A. bringing to the Council's attention
a potentially dangerous school crossing at Patricia Drive and La Entrada and
Foothill Boulevard, was referred to the Traffic Committee.
14. City Clerk, J. H. Fitzpatrick, reported on the results of the citizens straw
vote on bus service. The report was as follows:
"Attached for your information is a result of the Citizen's Poll on Public

15. Communications from the Citv Council suggesting procedures to the Pldaning
Commission for processing Planned Development Project, was considered by
the Council.

City Council and staff discussed present procedures for processing planned
development programs and also methods for better operation of the ordinance.
On motion of Councilman Whelchel, seconded by Councilman Miller, the
communication from the City Council was approved and referred to the
Planning Commission. Motion carried. Councilman Graves voted no.
16. Claim against the City from Mrs. Louisa B. Mellem -fall in crosswalk, was
referred to the City's insurance carrier.
17. Communication and resolution from the Library Board regarding Black Gold
Cooperative System, was presented to the Council for their consideration and
approval.
Miss Clark, City Librarian, explained the method and details of how the
Cooperative Program would be worked out between the various cooperative
member libraries.
On motion of Councilman Graves, seconded by Councilwoman McNeil, the following
resolution was introduced. Resolution No. 1253, a resolution authorizing
application for public library establishment grant.
Passed and adopted on the following roll call vote:
He suggested that if the Council wished to widen the roadway, that the curbs
on the east side of Chorro Street be set 19 feet out from center line between
Mill and Walnut and that curbs on both sides of Chorro between Walnut and
Lincoln be set 20 feet out from center line.
On motion of Councilman Graves, seconded by Councilman Miller, that the City-
Engineer's recommendations be approved and that the curb on Chorro Street be
set as suggested by the City Engineer. Motion carried.
19. On motion of Councilman Graves, seconded by Councilman Miller, that two (2) ,
days be authorized to each employee who is called for pre - induction physical.
Motion carried.
On motion of Councilman Miller, seconded by Councilwoman McNeil, the meeting
adjourned. Motion carried.

18. D. F. Romero, City Engineer,
reported that a careful study of the garage
problem at
842 Mill Street indicated that access could be retained to 1/2 of
the garage
when the sidewalk
is narrowed to 6 feet provided the sidewalk slope
could be varied from standard
across the driveway.
He suggested that if the Council wished to widen the roadway, that the curbs
on the east side of Chorro Street be set 19 feet out from center line between
Mill and Walnut and that curbs on both sides of Chorro between Walnut and
Lincoln be set 20 feet out from center line.
On motion of Councilman Graves, seconded by Councilman Miller, that the City-
Engineer's recommendations be approved and that the curb on Chorro Street be
set as suggested by the City Engineer. Motion carried.
19. On motion of Councilman Graves, seconded by Councilman Miller, that two (2) ,
days be authorized to each employee who is called for pre - induction physical.
Motion carried.
