Graves, Jr., Miss Margaret McNeil, Donald "I. Miller, Clell W. Whelchel City Staff Present: P. Chapman, Director of Planning & Building; J. H. Fitzpatrick, City Clerk; W. Flory, Superintendent of Parks & Recreation.• W. M. Houser, City Attorney; R. D. Miller, Administrative Officer; D. F. Romero, City Engineer; L. Schlobohm, Fire Chief; W. Schofield, Police Chief. 1. Report by Council Committee (Davidson and Whelchel) on negotiations with T. C. Maine for acquisition of property by the City to widen Foothill Boulevard, was held over. 2. On motion of Councilman Whelchel, seconded by Councilman Graves, the following resolution was introduced. Resolution No. lKa, a resolution determining policy on the use and plans for development of the Laguna Lake property. Passed and adopted on the following roll call vote: lXES: Clay P. Davidson, R. L. Graves, Jr., Miss Margaret McNeil, C1e11 i3. Wi�elchel NOES: None ABSENT: Donald Z. Biller Donald Q. Miller took his seat at 7:35 P. iv. 3. At this time the City Council considered the appeal of Reynolds Construction Company from a denial by the Planning Commission of a request to place a rotating sign at the southeasterly corner of Foothill Boulevard and Santa Rosa Street for the Texaco Oil Company. On motion of Councilman Miller, seconded by Councilman Whelchel, a public hearing was set for Fpril 13, 1964 at 8 :00 P. M. Motion carried. 4. Protest by Mr. and Mrs. LaFreniere to the iesuance of a house moving permit to Mr. Dennis Ahern, to move a building from Foothill Boulevard to Cerro Romauldo Street, was withdrawn as per request of Mr. and Yxs. LaFreniere. 5. At this time the City Council considered the appeal by the County Historical Society on the denial by the Planning Commission of z permit to move the Ramona Hotel Depot to the Dallidet Adobe property. The following letter was received from William T. Smith: "Please take notice that it is the desire of the San Luis Obispo County Historical Society to appeal the action of the City Planning Commission, in denying its application for a permit to move the above- described structures, taken at their meeting of May 5, 1964, to the City Council of the City of San Luis Obispo, and that we desire to be notified of the day and the hour at which this appeal will be heard before the City Council." Houser, City Bttorney, determined that no jurisdictional matter was involved as the Board of I.d;ustments has the right to refer any of its matters to the Planning Commission as a whole and that the Council could consider the matter without any formal notice of intent to do so. Also, the building, when moved, must meet the minimum building standards of the City based on occupimcy, use, etc. On motion of Councilman Miller, seconded by Councilman Graves, ttxat the City grant a permit to move tha old Ramona Depot to the Dallidet Adobe property subject to being brought up to minimum code. Motion carried. I report and pictures s_zowing the present condition of the old Ramona Depot were presented by s... aathaway. Communication from George H. Drumm objecting to the moving of Ramona Depot onto the Dallide;: adobe property as he believed that the Dallidet l:dobe was an important historical monument to the community and to the people so that they may be aware of the historical living conditions of their forebearers. Mayor Davidson stated he objected to moving this building to the Dallidet Adobe but agreed that it should be maintained elsewhere as an historical exhibit. On motion of Councilman Miller, seconded by Councilman Graves, all items were ordered received and filed on this matter. 6. It this time the City Council continued their study of the Sign Ordinance proposed by the Planning Commission and recommended for passage by the City Council. Peter Chapman, Director of Planning, presented colored slides of approved types ' of signs and types of signs that would have to be removed under the provisions of the proposed ordinance. Mr. Freeman reviewed with the Council the following amendments to the proposed ordinan ,te as prepared by the Sign Industry and Business Community. Street #3, F. Obztructions: 5600.3 Proposed Change: 1. )e recommend: obstruction to doors, windows or fire escapes. No sign shall be erected, relocated or maintained so as to prevent free ingress or egress from any door or %yindow re7,uired by ordinance or any fire escape. No sign shall be attached to a standpipe, gutter drain or fire escape. On motion of Councilman Miller, seconded by Councilman T."helchel, the proposed change was accepted. G. Traffic Safety: Proposed Change: 1. No Cign regulated by this ordinance shall be erected at any location whereby reason of its position it will obstruct the view or conflict with any authorized traffic sign, signal or device. 1 On motion of Councilman Graves, seconded by Councilman Miller, the proposed change was accented. G. Traffic Safety: 3. Delete 3 and substitute with: Fleshing signs. Flashing sign shall mean any illuminated sign on which the iilu :nation is interrupted or variee in 4ntensity for a special purpose. Graves, Jr., Donald '. itiller ABSENT: None Councilman Graves moved that this provision (H -1) be deleted from the crdinance and be carried in a resolution to be adopted at some future date. Ken Schwartz, Planning Commission Chairman, appeared before the Council urging that the Council sustain the Planning Commission's recommendation of prohibiting signs which flash, move, or simulate movement and gave reasons for the Planning Commission's recommendation and results of the Planning Commission's study. On motion of Councilman i- .11er, seconded by Councilman Graves, that H -1 be amended as follows: that rotating and flashing signs shall be regulated by resolution or ordinance. Davidson, Cieil W. `.:7halchel E:BSENT: None City Council Minutes May 11, 1964 Page -4- Councilman Graves suggested that a Council committee be appointed to establish the resolution in connection with the Planning Commission and representation of sign industry and bring back a recommendation to the City Council. On motion of Councilman Graves, seconded by Councilman Whelchel, that a committee be appointed to work out standards for the above resolution. Councilman Wheichel stated that any items that they can't agree on be reported back to the Council. Motion carried, all ayes. On motion of Councilman Miller, seconded by Councilman Graves, H -2 was amended as follows: Signs within five hundred (500) feet of any existing or proposed freeway intended to be viewed, primarily persons traveling on such freeway, except when such sign is used exclusively: (a) To advertise the sale or lease of the property upon which it is located: or (b) To designate the name of the owner or occupant of the premises upon which it is located, or to identify such premises. Motion carried unanimously. On motion of Councilman Hiller, seconded :by Councilman Graves, I1 -3 was deleted from the ordinance. Motion carried. On motion of Councilman X4iller, seconded by Councilman Uhelchel, H -4 was deleted ' from the ordinance. motion carried. 8600.4 Add sub - section 10 (Section 2700.24 of existing ordinance dealing with temporary signs) 8600.5 B. Exception. On motion of Councilman Miller, seconded by Councilv.To=n McNeil, the following changes to be made to 2600.5 1 An appurtenant sign, up to fifty (50) square feet in area, which complies with the requirements of this Chapter may be painted directly on a building or cut out letters that do not project more than 3 inches or weigh more than 5 pounds without a permit provided th-- Department is notified of the size and location in advance. Motion carried. 8600.6 C. Signs in C -1 and C -2 Districts. Mayor Davidson suggested that a sub - paragraph 2 be added which would allow roof signs as follows: ' 8. Signs may be erected on a flat roof o parapet wall in addition to those otherwise permanent provided that they comply with the following requirements: (a) Not to exceed a maximum of 10 feet in height. (b) area may be one square foot for each two feet of property frontage not to exceed two hundred (200) square feet per side. (c) Sign may not project beyond the edge of roof or parapet. The City Council then discussed the Mayor's suggestion in relation to the overall regulation of roof signs being allowed in the City of San Luis Obispo. Peter Chapman, Planning Director, reminded the City Council of the existing roof signs which do not add to the downtown beauty and suggested that the City Council not allow any roof signs within the City. E. R. C. on comparison study of the City of Sc-n Luis Obispo and the City of Santa Maria, was ordered received and filed. 9. Mayor Davidson presented the matter of the claim of the Trustees of ne t. Z. Sinsheimer Family Memorial Fund for tlae uncashod salary warrants of Louis Sinsheimer. He stated thc he had met with Tim O'Reilly and Mr. Sinsheimer and that they had questions that he could not answer for the Council. The Mayor stated that the Trustees wanted to know if the Council would waive the statue of limitations and make payment to the trust and also would the Council agree to a friendly suit to allow the payment of these warrants. He also stated that if the Council a =proved the payment, the money could be held in trust until any and all threatened suits had been satisfactorily settled in order to protect the Council and City officials from liability, and also that the Council not-take aLy action until _r_e Couhcil had met_ with the Trustees. Further, he wished the Council to keep in mind the fact that the money would be used for worthwhile projects. Councilman T %?helchei stated that if the money were left in general fund it would be spent for the gocd of all the citizens and purposes would be as good as the Trust and expenditures would be under control of Council. Councilman Miller stated that there are other worthy methods of honoring former Mayor Sinsheimer in which the Council would retain the control of the expenditure of public funds. On motion of Councilman Miller, seconded by Councilman Graves, that payment of the warrants be denied, on advice of the legal counsel as each member of the Council could be held liable.
