Miller, Administrative Officer; E. Rodgers, Police Captain; P. Chapman, Planning Director; A. Juarez, Assistant City Engineer; E. P. Thompson, Water Superintendent; B. Walter, Chief Building Inspector; C. A. Weber, representing Mustang Village; W. Woodward, Fire Marshall; J. H. Fitzpatrick, City Clerk. 1. The City Council met in special session to discuss the request of Mustang Village Apartment Development for permission to occupy the first complex of the buildings prior to completion of the roads, parking areas, etc. Mr. Weber presented the problem to the Council stating that the project had been started on an extremely tight schedule for occupancy by the students on January 3, 1966. The contractor had promised completion by December 10, but due to rain and other problems the buildings will not be ready for occupancy as planned. Mr. Weber continued that they presently have 118 leases signed with students to move in in January and that they would hate to lose these leases as the financing company keeps a very close check on the apartments rented and future proposals for financing would depend on the number of units rented in the first phase before the money was available for the second phase. ' Mr. Weber said he was afraid that if they turned down the students presently signed up for apartments that this would set back the second phase beyond the September 1966 completion date estimate. Mr. Weber stated that he only wished this permission to occupy the first complex of four buildings when all Building Code requirements have been complied with. He realized that this was a temporary approval and that additional students would be moved into completed apartments when, and only when, the future units met final com- pletion inspections. He asked that the City Council grant temporary approval for January 3 occupancy or as soon thereafter as the first complex meets City requirements. W. Chapman, Planning Director, recommended that the City Council still require all the buildings to be completed according to the Building Code and that Mr. Weber be notified that this special consideration would not be given for the second unit in order that the project could be completed according to the planned,development pre- viously approved. Mr. Thompson, Water Superintendent, told the City Council that the water matters can be handled under existing City ordinances as each item comes up. Mr. B. Walter, Chief Building Inspector, stated that the following minimum require- ments must be completed prior to occupancy even on a temporary basis: 1. All electrical work completed and fixtures set. ' 2. Enclosure (weather proof) completed at exterior electrical panel location. 3. Plumbing completed with all fixtures set and connected to sewer. 4. Approved water service to each unit. 5. Scratch and brown coat stucco on exterior. 6. Railings installed on all stairways. 7. A dry access (sidewalks) to each unit. Mr. William Woodward, Fire Marshall, requested that an all weather surface access road capable of handling fire equipment be installed and a fire hydrant must be installed in accordance with the approved plan. Councilman Gallagher stated he was afraid that if the Council allowed this occupancy before completion, it would set a precedent, and it would be very difficult for the City Council Minutes December 28, 1965 Page 2 Council in the future to refuse temporary occupancy requests from others. Mr. Romero, City Engineer, stated in a letter that he felt the problems at Mustang Village were caused by the developer and did not feel that he was entitled to an exception. However, if the Council wished to grant occupancy, Mr. Romero recommended that the temporary approval be conditioned as follows: ' 1. That an access road at least 20 feet in width, constructed of 8 inches of base material be constructed along the railroad tracks from Foothill Boulevard to the parking area. 2. That a temporary parking area sufficient in size for 51 cars be constructed of a minimum of 4 inches of base material, striped for traffic control, and developed to a proper grade to permit easy access and to provide drainage control. 3. That sewer facilities be constructed and tested from Foothill Boulevard to beyond the apartment development. 4. That storm drainage facilities be installed, tested, and completed to the extent that positive Orainage control is provided for the units being considered. 5. That water main and service facilities be installed and tested from Foothill Boulevard to beyond the apartment development. Mr. Charles Weber stated to the Council that if they approve this temporary occupancy that they would limit it to 102 students who have signed n2 to date and would not allow any other students +mtil the first phase has been completed. W. Weber continued that his company was planning on putting up the 18 female studente in motels in the City as he felt it would be too much of a challenge for the young ladies to rough it in the uncompleted buildings. ' Councilman Spring questioned the sebednle of the Mustang Village construction but stated he would approve the temporary request conditioned that all City requirements have been met on the buildings. Councilman Blake statee- he Celt that a temporary approval for occupancy would be satisfactory to him but he wished the first complex to be completed under City Code. On motion of Councilman Gallagher, seconded by Councilman Spring, that temporary approval for occupancy of the first complex (4 buildings) of the first phase be approved subject to all buildings in the first phase being completed to City Code with final completion by September 1, 1966 and further that the temporary occupancy meet conditions set up by the various City Departments at this meeting. Motion carried. 2. Mr. Weber brought to the Council's attention a dispute between the contractor and the City Building Department regarding the use of plywood, water - proofed only on one side in the'shower stalls. Mr. Weber stated he was not asking for any Council action on this matter but was just bringing it to the Council's attention. Mr. Chapman, Planning Department, stated that this matter of the plywood in the stall showers at Mustang Village had been presented to the Board of Appeals and that the Bo" of Appeals had approved the recommendation of the Building Department in the speci- fications for plywood in the shower areas. Mr. Chapman continued that the contractors were still upset and stated they would bring additional information showing the validity of their claim to use this material and guaranteeing it.
