Memorandum..from Wa ne..Peterson,.City Engineer,.stating that the developer of Los Verdes Park, Tract 467, has promised to begin moving the rocks adjacent to the tract starting .January 9, 1976, but because he has promised this.before, Wayne.Peterson suggested that the Council continue the matter for further reporting. Councilman Gurnee stated that this.matter_ has been before the City Council a number.of.times;_that._the developer has-..promised to.take some action and he feels that the City Council should.proceed and put the property owner on notice of an abatement proceedings. On motion.of..Councilman Gurnee ,..seconded- .by_Councilman Graham, the following resolution.was introduced :....Resolution_No...2955,.a resolution-of the City Council of the City.of San.. Luis Obispo.finding that .a public nuisance may exist on Tract 467 (Los Verdes Park) and.the abatement thereof. Passed and adopted_on.the following roll-call vote: AYES: Councilmen Graham, Gurnee,- Petterson, and Mayor.Schwartz NOES: None ABSENT: Councilman Norris 13. The City Council.continued _ their..discussion.of the..public hearing on Resolution.No. 2901,- ..a.resolution.of the City-Council of the City.of.San Luis..Obispo requiring-the- removal of certain driveway ramps on portions.of.various• streets in the City of.San Luis.Obisp'o. (Continued from the December 1,. -1975 meeting due to .appeal of the..property owners.) Warren A.._ Sinsheimer ,,- representing.the.property owners B.H. Gibson, for property located at 1200 Monterey.Street.and -the tenant'Hathway Enterprise, Inc., requesting-that the City Council not order the closure of the driveway ramps on this property as all.the ramps-must be used when-moving-recreational vehicles, trucks and.trailers, in and.out..of.this sales.storage yard. He stated that-while it.was.true that..temporary: fences or corral had-been placed in front of these driveway ramps, a..mere..removal of pins allowed the fence to be removed and the vehicles backed in and.out to the property. On.motion'.of Mayor_Schwartz ,,seconded ... by:. .Councilman - .Graham,_. that. the City Council ;accept the appeal of Gibson, close the more easterly driveway on Monterey Street but leave the other driveways.on this property open for vehicle use. Motion .carried, Councilman Norris absent. The matter of limited. parking. restrictions_ adjacent. to. the- Hathway_ property sales.yard.was referred to the Traffic Committee for study. CITY COUNCIL MINUTES JANUARY 7, 1976 PAGE 2 The City Council considered the appeal of P.S. Burton, 1185 Monterey Street to have the driveway.ramps closed. . D.F. Romero, Director of Public.Services, stated.that.due to..some mixup, the Attorney.Sinsheimer was not. appealing on behalf of.this property owner and felt that these abandoned driveways should proceed.-in accordance with Council .direction. On motion.of.Mayor..Schwartz, seconded_by.Councilman Gurnee, -.the following resolution was introduced: Resolution_No...2956, a resolution of the Council of the City-of-San Luis.Obispo.finding and.determining that-.the public convenience_and' necessity require the-removal of certain driveway ramps on portions of various streets in the City of.San Luis Obispo. Passed._.and.adopted.on_ the following roll -call vote.: AYES: Councilmen Gurnee, Graham,_Petterson and Mayor Schwartz NOES: None ABSENT: _Councilman Norris 14. Communication from Murray.Warden, Administrative.Officer for the City-of Morro Bay, forwarding proposed revisions to the Area Planning Coordinating Council Joint Powers Agreement, draft dated 12/8/75. The - proposed revisions were referred to Councilman - Gurnee, the City's representative'to the Area Planning Council for study and report back-to the City Council of his recommendations. 15. Memorandum from. Wayne Peterson,.. City. Engineer., --recommending that the.request..for a 4 -way stop at..Pismo.and.Nipomo.Street.be. denied On motion-of.-Councilman Petterson, seconded by Mayor Schwartz, that the recommendation of-the City Engineer be- accepted. Motion lost on the following roll call vote: AYES: Councilman Petter son and Mayor Schwartz NOES: .Councilmen.Graham.and Gurnee ABSENT: Councilman Norris The matter-was continued to the January 19, 1976 Council meeting for full Council.consideration. 16. ...R.D...Miller, Administrative Officer, submitted.for the Council consideration a draft resolution establishing policy on contracting for professional - services. The City:Council discussed.some of the recommendations of the.Administrative Officer and.the matter was referred back'.to Richard D. Miller to' update for future Council consideration. 18. Memorandum from Paul Lanaell: requesting -Council _ consideration of flood.control alternatives and.memorandum_ from David F. Romero on the same subject were continued to the February 8, 1976 Council meeting. 20.- . R.D.-Miller,. Administrative ..Officer,..forwarded to. the City Coundil.a:sample_ contract for.animal. regulations -to_be provided by the County during the 1976/77 year. The provisions of the revised contract are similar =to those outlined in .October 15, 1975. The proposed contract provides that the.County would no longer absorb 40% off the top, but the County_.would.agree.to.building a. shelter_ and.. would....guarantee.that the e, 1 I u ._CITY COUNCIL.MINUTES JANUARY 7, 1976 PAGE 3 total net cost.to_.the City -.of San Luis..Obispo would not.exceed $21,300.00. He, therefore ,..suggested..that ... the City.Council -go_ along. -with the.County on their proposal_ as- he_did..not..feel.that..the -City could-provide-anywhere near that service-at.that cost. On..motion.of.Councilman Gurnee, seconded-by Councilman Petterson, that the City - Council.- accept the recommendation of the Administrative Officer and ' inform the County that the City of San Luis Obispo will cooperate in future animal.regulation:.services. 22. Memorandum.from Rob - Strong, Director.of Community.Development, forwarding recommendations ract.No. 575, Tres Hermanos Park, 28 lot industrial subdivision, Richard Burke, developer. On-motion of-Councilman Gurnee, seconded by..Councilman Graham,.the matter was continued to.the January 19, 1976.meeting. 23. On motion of Mayor Schwartz,.. - seconded by Councilman. Petterson, Stephen.Nelson_.was appointed to the .Housing .Authority-to fill .an..expired term.. Motion.- carried. .On motion .of_Councilman.
