CALL TO ORDER
A Special Meeting of the San Luis Obispo City Council was called to order on
Tuesday, April 1, 2014 at 4:00 p.m. in the City Council Chambers, located at 990
Palm Street, San Luis Obispo, California, by Mayor Marx.

Present: Council Members Dan Carpenter, Kathy Smith, Vice Mayor Carlyn
Christianson, and Mayor Jan Marx

Present: Katie Lichtig, City Manager, Christine Dietrick, City Attorney,
Michael Codron, Assistant City Manager, and Anthony Mejia, City
Clerk, were present at Roll Call. Other staff members presented
reports or responded to questions as indicated in the minutes.
STUDY SESSION
SS1. STATUS OF IMPLEMENTATION OF EXISTING NEWSRACK
REGULATIONS
Public Works Director Grigsby and Supervising Civil Engineer Hannula
narrated a PowerPoint presentation entitled "Newsrack Program Update"
and responded to Council inquires.
Dominic Tartaglia, representing the Downtown Association, voiced support
for staffs recommendation and efforts to provide safe clean newsracks in
1 the downtown.

Marshall Ochylski. President of the Downtown Association, spoke on
staff's efforts to improve the newsracks in the downtown and urged
Council approval of staffs recommendations.
Following discussion, Council directed staff to proceed with the newsrack
pilot program and to return to Council with an update following 6 months of
field testing.
ADJOURNMENT
Council adjourned the Special Meeting at 4:53 p.m.
CALL TO ORDER
A Regular Meeting of the San Luis Obispo City Council was called to order on
Tuesday, April 1, 2014 at 6:00 p.m. in the City Council Chambers, located at 990
Palm Street, San Luis Obispo, California, by Mayor Marx.
PLEDGE OF ALLEGIANCE
Vice Mayor Christianson led the Pledge of Allegiance.
PROCLAMATION - MONTH OF THE CHILD AND CHILD ABUSE
PREVENTION MONTH
Mayor Marx presented a proclamation to Meghan Burger, on behalf of the San
Luis Obispo County Child Care Council, proclaiming April 2014 as "Month of the
Child" and "Child Abuse Prevention Month."
PROCLAMATION — SEXUAL. ASSAULT AWARENESS MONTH
Mayor Marx presented a proclamation to Krista Stafford, on behalf of RISE
(Respect/Inspire /Support /Empower), proclaiming April 2014 as "Sexual Assault
Awareness Month."
PUBLIC COMMENT
Donald Hedrick, San Luis Obispo, questioned and received clarification that
newsrack regulations were discussed during a study session held earlier in the
afternoon.
Eric Meyer. San Luis Obispo, spoke on April Fools' Day jokes.
Steve Barasch, San Luis Obispo, requested that the City clear debris from
creeks, pointing out recent storm surges near San Luis Creek/Dana Street dam; ,
noted that the Federal Emergency Management Agency (FEMA) has recently
adjusted flood maps.

Public Works Director Grigsby, spoke on the City's efforts to clear creeks prior to
' the rainy season; advised that staff will examine San Luis Creek near the Dana
Street dam.
Mila Vuiovich -La Barre, San Luis Obispo, voiced concerns regarding the use of
Prado Road as a truck route; asserted that an Environmental Impact Report
should be conducted to evaluate the cumulative traffic impacts of Prado Road.

C5. LANDSCAPE MAINTENANCE SERVICES REQUEST FOR
PROPOSALS I
MOTION BY VICE MAYOR CHRISTIANSON, SECOND BY COUNCIL
MEMBER SMITH, CARRIED 5 -0, to:
Approve the Request for Proposals for Landscape Maintenance
Services, Specification No. 50200- 20141-S.
2. Authorize staff to advertise the Request for Proposals for Landscape
Maintenance Services, Specification No. 50200- 20141-S.
3. Authorize the City Manager to award agreements for Landscape
Maintenance Services, Specification No. 50200- 20141-S, if the total is
within the available budget of $366,300 for landscape services.
BUSINESS ITEMS
B1. RECOMMENDATION FROM THE LOCAL REVENUE MEASURE
NOVEMBER GENERAL ELECTION BALLOT
City Manager Lichtig, Assistant City Manager Codron and Finance and
Information Technology Director Padilla narrated a PowerPoint
presentation entitled "Planning Future Revenue" and responded to Council
inquires.
Lea Brooks and Victoria Carranza, representing the Local Revenue
Measure Advisory Committee (LRMAC), summarized the committee's
deliberations, votes, and final recommendations.
Dominic Tartaglia, representing the Downtown Association, spoke on
improvements to the downtown utilizing Measure Y funds; conveyed
support for a revenue measure on the November 2014 ballot
Marshall Ochylski, President of the Downtown Association, stated that the
association is supportive of a revenue measure on the ballot; noted that
the association cannot take formal action until proposed ballot language is
available.
Michelle Tasseff, San Luis Obispo, expressed support for a revenue ballot
measure; stated that Measure Y had positive effects in the community.
Dale Magee, San Luis Obispo, advised that the Local Revenue Measure
Advisory Committee debated the matter and has provided deliberate
recommendations.

Tim Williams, speaking on behalf of the Chamber of Commerce, advised
1 that the Chamber supports a ballot measure for a local revenue tax; stated
that Measure Y helped the City manage during the recession.
Andrew Christie, Sierra Club, spoke in favor of a companion ballot
measure, noting that advisory measures are beneficial to gather public
opinion on the use of local revenue funds.
Gordon Mullin, San Luis Obispo, conveyed support for the renewal of
Measure Y; pointed out that if not for Measure Y, the recession here would
be a funding gap in the General Fund
Steve Barasch, San Luis Obispo, asserted that the advisory measure
committee selection process was not conducted in a fair and unbiased
manner; distributed a summary of CIP projects completed with Measure Y
funds; opined that the list consist of projects historically considered
routine.
Jessica Betry. representing San Luis Obispo Council of Governments
( SLOCOG), advised that SLOCOG is supportive of the City's efforts to
renew a local revenue measure; pointed out that the funds support
infrastructure improvements and make the City more competitive for
' grants.
Dan Rivoire, SLO County Bicycle Coalition, stated that the coalition is
supportive of a local revenue measure which supports infrastructure and
bicycle transportation improvements; urged Council to direct staff to draft
ballot language.
Ken Hampian, San Luis Obispo, conveyed support for submitting a ballot
measure to the voters; urged Council to be supportive of the process and
to ensure that the community considers the importance of the matter;
opined that Council should consider whether the community will be better
if Measure Y is not renewed.
Sandra Rowley, San Luis Obispo, voiced support for a companion ballot
measure and additional accountability. for the use of funds; recommended
that Council consider a four year sunset period and establishing an
advisory committee.
Patty Andreen, San Luis Obispo, spoke on her experience as a member of
the Local Revenue Measure Committee, noting that she did not feel
pressured to make a particular recommendation; voiced support for a
general purpose tax to ensure that the Council has the flexibility to
respond to crisis.

Council discussion ensued whether a special purpose tax or general
purpose tax should be submitted for the next General Municipal Election; 1
whether an advisory ballot measure should be submitted regarding the
use of the revenue funds; whether use of Measure Y funds should be
ramped down and allowed to sunset.
Council Member Ashbaugh noted for the record that he believes the
community desires to consider a ballot measure in November 2014 and
cited additional police patrols in the downtown as an example of Measure
Y revenues being used for operational costs.
Mayor Marx requested that staff post on the City's website a timeline for
submitting an initiative for the November 4, 2014 Election.
MOTION BY COUNCIL MEMBER SMITH, SECOND BY COUNCIL
MEMBER CARPENTER, FAILED 4 -1 (COUNCIL MEMBERS ASHBAUGH
AND CARPENTER, VICE MAYOR CHRISTIANSON, AND MAYOR
MARX VOTING NO), to direct staff to prepare language for a potential '/2
cent special purpose sales tax measure, for use on Capital Improvement
Projects, and sunsetting in 8 years.
MOTION BY COUNCIL MEMBER ASHBAUGH, SECOND BY VICE
MAYOR CHRISTIANSON, CARRIED 3 -2 (COUNCIL MEMBERS
CARPENTER AND SMITH VOTING NO), to:
1. Receive and file the final report and recommendation from the Local
Revenue Measure Advisory Committee (LRMAC).
2. Direct. staff to prepare language for a potential revenue measure,
based on the recommendations of the LRMAC, as outlined in the
Council Agenda Report, to be considered for placement on the
November 2014 general election ballot, and return to the City Council
for further direction or action no later than July 2014.
RECESS
Council recessed at 8:21 p.m. and reconvened at 8:31 p.m., with all Council
Members present.
B2. REQUEST FOR PROPOSALS FOR CONSTRUCTION MANAGEMENT

Public Works Director Grigsby and Engineering Inspector Rowland
narrated a PowerPoint presentation entitled "Request for Proposals for '
Construction Management of the Los Osos Valley Road /101 Interchange"
and responded to Council inquires.

Mila Vujovich -La Barre, . San Luis Obispo, suggested that the project
t incorporate public art on the fagade such as San Juan Capistrano and
Anaheim.
Jessica Berry, San Luis Obispo Council of Governments ( SLOCOG),
commended staff for working on this project and noted that SLOCOG has
dedicated funding in support of this project.
MOTION BY COUNCIL MEMBER ASHBAUGH, SECOND BY VICE
MAYOR MARX, CARRIED 5 -0, to:
1. Approve the Request for Proposals for construction management
services for the US 101 /Los Osos Valley Road Interchange
Improvement Project, Specification No. 99821.
2. Authorize staff to advertise for construction management services for
the US 101 /1-os Osos Valley Road Interchange Improvement Project,
Specification No. 99821.
3. Authorize the City Manager to award a contract up to $2,408,315 for
construction management services when funding becomes available
for the construction management phase.
I 4. Authorize the transfer of $759,475 from the Land Acquisition phase to
the construction management phase of the 99821 project account.
PUBLIC HEARINGS
PHI. REVIEW OF PRE - APPLICATION CONCEPTUAL MATERIALS FOR
THE PROPOSED SAN LUIS RANCH PROJECT, WHICH ENVISIONS A
PRESERVING OPEN SPACE AND AGRICULTURAL LAND ON THE
131.3 -ACRE PROPERTY (1035 MADONNA ROAD, FORMERLY
KNOWN AS DALIDIO)
Community Development Director Johnson, Consulting Planner
Rickenbach and Deputy Director Davidson narrated a PowerPoint
presentation entitled "San Luis Ranch Project" and responded to Council
inquires.
Marshall Ochylski, representing the Applicant, expressed support of the
Planning Commission's recommendation; expressed desire for the project
site to be annexed into the City, noting that it will allow the Council to
consider the project; pointed out that there is a housing shortage and the
' project will create needed homes; conveyed that the applicant will work
with Central Coast Grown in relation to the agricultural land on the site.

Steve LePell, San Luis Obispo, spoke on the importance of preserving
agricultural property; opined that residents prefer pastoral views; urged
that Council manage growth and development, pointing out the number of
vacant businesses in the city.
Jenna Smith, San Luis Obispo, representing Central Coast Grown, spoke in
support of retaining a minimum of 50% of the site for agricultural purposes;
stated that a local food system is a priority for a local sustainable economy;
urged that the agricultural land remain contiguous.
Jamie Lopes, San Luis Obispo, narrated a PowerPoint presentation
depicting a map of the project site and recommended that the site be
developed in a method that retains the maximum possible area for
agricultural land.
Linda Seeley, San Luis Obispo, voiced concern that the proposal includes
roadways in the open space allotment and the potential for severe flooding
caused by mitigation measures; expressed opposition to allowing offsite
open space.
Michelle Tasseff, San Luis Obispo, conveyed support for the project and
recommended Council approval.
Theodora Jones, San Luis Obispo, voiced concern regarding the potential '
for flooding and trafficicirculation impacts; spoke on the importance of
addressing water issues and draught impacts.
John Phillips, San Luis Obispo, stressed the importance of preserving
agricultural land; urged that the developer and Council consider methods
of preserving the largest amount of farmland as possible.
Rosemary Wilvert , San Luis Obispo, we are an interface of urban and
agricultural uses; open space is a mitigation itself and cannot be mitigated
offsite; no amount of offsite acreage will make up for the 50% allotment
and open space must exclude roadway; oppose froom ranch from cutting
from the other proposed open space area; we must preserve farmland;
stick to General Plan and better yet keep more than 50% as ag.
Carlvn Smith, San Luis Obispo, suggested that the project application
should be postponed pending the completion of the Land Use and
Circulation Element (LUCE); conveyed concerns related to traffic and
circulation impacts; voiced support for the continuation of the Airport Land
Use restrictions and maintaining a minimum allocation of 50% for open
space.

Charlene Rosales, representing the Chamber of Commerce, voiced
t support for moving forward with the project; pointed out that the project will
benefit commercial, residential, bicycle transportation, and open space
uses.
David Brodie, San Luis Obispo, spoke on need of addressing water
resources and transportation prior to moving forward with the project.
Donald Hedrick, San Luis Obispo, pointed out that the property was the
site of a plane crash; addressed the need for conserving agricultural land
and maintaining the character of the city.
Andrew Christie, representing the Sierra Club, urged that Council raise the
minimum allocation of open space to higher than 50% and to include Mr.
Lopes' proposal as an alternative in the Environmental Impact Report.
Daniel Phares, San Luis Obispo, asserted that high density projects
increase area crime rates; voiced concern regarding traffic impacts and
crime; suggested a ban on new construction pending resolution of a
compost facility project.
Eric Meyer, San Luis Obispo, noted his preference that the property be
annexed into the City to allow the Council to consider the project; noted
' that the LUCE Task Force recommended retaining a minimum of 50% for
agricultural purposes; recommended that the area be considered for safe
routes to school.
Mila Vuiovich- LaBarre, San Luis Obispo, voiced opposition to the
proposed project, citing concern to high density; pointed out that the site is
high quality farmland; questioned whether the developer has realized his
obligations in relation to financing of infrastructure improvement.
Marshall Ochvlski, representing the Applicant, advised that the applicant
desires to address the drainage issues, Prado Road extension, bicycle
needs, and maximizing the agricultural land. In response to Council
inquiry, Mr. Ochylski advised that the submitted proposal includes
consideration of relocating 10 -acres of open space off site to ensure that
the EIR analyzes this possibility.
In response to Council inquiry, City Attorney Dietrick advised that tonight's
actions do not obligate the Council to approve the project in the future.

Following discussion, MOTION BY COUNCIL MEMBER ASHBAUGH,
SECOND BY COUNCIL MEMBER SMITH, CARRIED 5 -0, to:
1. Adopt Resolution No. 10509 entitled "A Resolution of the City Council
of the City of San Luis Obispo, California, authorizing initiation of an
application for the proposed San Luis Ranch project, including related
actions in support of the application."
2. Approve the Processing Memorandum of Understanding between the
City of San Luis Obispo and Coastal Community Builders, Inc., which
provides the framework for the planning process and evaluation and
implementation of fees and mitigation measures.
3. Authorize staff to initiate discussions with applicants for a Development
Agreement to establish certain development rights and developer
commitment to construct and pay for certain amenities for the City benefit.
4. Authorize staff to issue a Request for Proposals to prepare an
Environmental Impact Report for the project.
LIAISON REPORTS
Council liaison reports were received from Council Member Ashbaugh, Vice
Mayor Christianson and Mayor Marx.
COUNCIL COMMUNICATIONS
None.
ADJOURNMENT
The City Council adjourned to an Adjourned Regular Meeting to be held on
Wednesday, April 9, 2014 at 3:00 p.m. for discussion of public employee
performance evaluations and to conference with labor negotiators relative to the
City Manager and City Attorney. The meeting will convene in the City Council
Chambers located at 990 Palm Street, San Luis Obispo, California. The City
Council will then recess to the Council Hearing Room to discuss closed session
matters.
A subsequent Adjourned Regular Meeting will be held on Thursday, April 10,
2014 at 4:00 'p.m. to continue discussion of public employee performance
evaluations and to conference with labor negotiators relative to the City Manager
and City Attorney. The meeting will convene in the City Council Chambers
located at 990 Palm Street, San Luis Obispo, California. The City Council will
recess to the Council Hearing Room to discuss closed sesr
�ion matters.
