I. City Council continued their discussion with Mrs. Boriack,
regarding the acquisition of a new drainage easement through her
property, for installation of a.large pipe to handle storm waters
across her property, the existing easement would then be abandoned
and redeeded to her.
D. F. Romero, City Engineer, again presented sketches of the two
alternatives.for the easement through.the Boriack property, one
"A" between the residence and carport and "B" along the property
line and through the carport. He also showed sketches of the
proposal as amended by Mrs. Boriack with revisions to the carport
as she suggested.
Lloyd Somogyi, Attorney for Mrs. Boriack, stated that the main worry
of the Boriacks was what would happen to the balance of their prop-
erty in the open ditch. She felt that the larger volumes of water
would cause serious erosion.problems, not only on the Boriack
property, but also on properties adjacent to the ditch owned by other
individuals. Lloyd Somogyi. suggested on behalf of Mrs. Boriack
that the City continue the covered pipe through her property and
empty it into Old Garden Creek. She would also like to use the
easement for access to the rear of her lot. Lloyd Somogyi concluded
by saying that if this was satisfactory to the City and they ran
this line to the creek, they would waive any compensation from the
City. Upon question, he felt that Mrs. Boriack would ask $5,000 for
Plan "B" as proposed.
The City Council discussed with the City Engineer, D. F. Romero,
Mrs. Boriack and Mr. Somoqyi, the implication of the Boriack
proposal to encloses all th.e drainage within a pipe through the
Boriack property. The Council discussed the proposal in view of the
potential development of the subject property to greater density
without commensurate contribution by this property owner.
Councilman T. Keith Gurnee stated that the City Council should take
no action on this proposal until the Waterways Planning Board and
Tree Committee have had an opportunity to study the implications of
this matter on Old Creek and its environs.

On motion of Councilman T. Keith Gurnee seconded by Couhcilman
Myron Graham that the matter be continued to November 5, 1973, with
report from the Attorney, Clerk and Engineer on the offer of $5000
for the easement to implement Plan "B ". Motion carried.

2. On motion of Councilman John C. Brown, seconded by Councilman
Myron Graham, the request of Theta Chi Fraternity, 344 Upham Street,
to close Upham Street between Santa Barbara and Chorro Streets for
their annual Children's haunted house program, be approved subject
to coordination with the Police Department. Motion carried.

3. Notice of adjourned meeting of the County Board of Supervisors
for 9:00 A.M., Tuesday, October 30, 1973, regarding the purchase of
property on Palm Street by the County of San Luis Obispo was noted
by the City .Council and ordered received and filed.
4. On motion of Councilman John•C. Brown, seconded by Councilman
Myron Graham, the meeting adjourned at 1:20 P.M., October 26, 1973.
