HEARING ROOM, CITY HALL Councilmen Dunin, Gurnee, Jorgensen, Petterson and Mayor Schwartz None PRESENT: J.H. Fitzpatrick, City .Clerk; R.D. Miller, Administrative Officer; Wayne Peterson, City Engineer; D.F. Romero, Director of Public Services; Lee Schlobohm, Fire Chief; Dan Smith, Associate Planner The following items continued from the regular meeting of July 5, 1977: 12. Continued Council consideration of Tentative Tract Map No. 645, John Ring, developer, for a 9 lot residential subdivision between 3279 and 3355 Broad Street., R -2 zoning. (Please refer to City Council meeting minutes of July 5, 1977, item 12.) Dau.Smith, Associate Planner, again.briefly reviewed the Tentative Tract Map No. 645 as approved by the City Planning.Commission. Vic Montgomery, designer for the developer, stated.that the street layout in Tract No. 645 was based on the request of the Planning Department. The developer would have to come off Broad Street which would have made a cheaper and less expensive street for the-developer-The reason they placed the planter in the cul -de -sac was to minimize the effect of the sea of paving as this planter would make a better environment for the residents. He then re- viewed for the City Council an alternate ,for .,parking on the street by making an off set bay in the sidewalk portion to allow parking in front on one side of the street and still allow two way traffic in and out of the tract. John Ring, developer /property owner, reviewed the conditions and constraints established by the City.Planning and Building staff for development of this parcel of land. Councilman Gurnee stated he felt the developer was making the best use of a. difficult parcel of land due to the topography, size, creek, etc. He felt that the street with the parking bay would be much more acceptable to him. He also agreed with planning the traffic island and he would support the tentative map with street construction including the parking bay. Councilman Dunin stated he was opposed to the.tract..approval.due to the extra costs to the City to maintain the traffic island, the creek, etc. Councilman Jorgensen stated he felt.this was a good development for a.difficult parcel of land, but agreed with the basic development concept in not allowing access to Broad Street. He did wonder about the traffic restraints using the parking bays. He would support the Tentative Tract Map with the parking bays as presented by the developer. Councilman Petterson stated that it was unfortunate that City standards allowed this type of development in the City. He agreed it was a difficult parcel to develop; was opposed to the traffic island which he felt would be a traffic hazard. He also felt that parking in the street would be a hazard to traffic in and out of the tract. City Council Minutes July 11, 1977 Page 2 Mayor Schwartz stated that he supported the basic concept of no access from Broad Street in spite of the.difficulties in.developing this.parcel. He felt that the developer had done a good job with a difficult lot. He did not support the landscape of the traffic island due to difficulties for emergency vehicles. He felt that the street with parking bays could be very satisfactory and well done. On motion of Councilman Gurnee, seconded by Councilman Jorgensen, the follow- ing resolution was introduced: a resolution of the Council of the City of I San Luis Obispo granting tentative approval to Tract.No..645, located between 3279 and 3355 Broad Street. Resolution was amended to drop requirement #4 which was that the subdivider should reconstruct existing exposed sewer line in proposed lot #4 out of the waterway to the approval of the-Public Services Director; amend condition 421 and amend the street layout to allow parking bays on the street. Resolution lost on the following roll call vote: AYES: Councilmen.Gurnee!,and Jorgensen NOES: Councilmen Dunin,. Petterson and Mayor Schwartz ABSENT: None On motion of Councilman Jorgensen,. seconded by Councilman Gurnee,.the following resolution was introduced: Resolution-No. 3369 (1977 Series), a resolution of the Council of the City of San. Luis Obispo granting approval of Tentative Tract Map No. 645, located between 3279 and 3355 Broad .Street, subject to the following conditions: 1. Street layout be redesigned to a 32` right -of -way curb-to-curb with parking bays on the east side, and; 2. The landscaped island in the cul -de -sac be eliminated. Resolution passed and adopted on the following roll call vote: AYES: Councilmen Dunin, Gurnee, Jorgensen and Mayor Schwartz NOES: Councilman Petterson ABSENT: None 13. At this time the City Council considered the Tentative Tract Map No. 649, VIP Future Corporation, for a 14 unit planned.development at.2803.Johnson Avenue, PD R -1 and PD R -2 zoning. Dan Smith, Associate Planner, reviewed for the City Council the recommendation of the Planning Commission creating a 15 lot residential planned development subject to the following four findings and 15 conditions: Findings: 1. The tract map and design are consistent with the General Plan. 2. The site is physically suited for the .proposed type and density-of-develop- ment permitted by the PD R -1 and PD R -2 zones. ' 3. The design is not likely to cause substantial environmental damage, or cause serious public health problems. 4. The design of the proposed subdivision will not conflict with public easements for access through, or use of, property within the proposed subdivision. City Council Minutes July 11, 1977 Page 3 Conditions: 1. The private street shall be designed so as not to exceed 12% slope and shall have a flat area large enough for one car just behind the sidewalk. 2. The private street including curb, gutter and sidewalk as indicated on the 4. A precise development plan shall be approved by the City Architectural Review Commission including a required solid landscape screen along the northern property line. 5. Conditions, Covenants and Restrictions shall be approved by the City Attor- ney and Community Development Director. CC &R's shall contain the following provisions: a) creation of a homeowners association to enforce the CC &R's and provide for professional, perpetual maintenance of all common area (lot 15) and all building exteriors in a first class condition; b) grant to the City of San Luis Obispo the right to maintain common area and building exteriors in a first class condition; c) no parking on the site except in approved designated space; d) grant to the City of "San Luis Obispo the right to tow away vehicles, on a complaint basis, which are parked in unauthorized places; ' e) no outside storage of boats, campers, motorhomes and trailers, nor long -term storage of inoperable vehicles.except in areas designated for such storage on the approved precise plan; f) no outside storage by individual units except in garages and enclosed patios. 6. The garage for the existing residence; which has been converted to residen- tial use shall be restored to a garage. 7. Park land-in lieu fees shall be paid in the amount of $1,950 (13 units x $150). 8. The sewer system shall be designed -to City standards and connected at a manhole to the existing off -site 8 "sewer main. The subdivider shall acquire and dedicate a sewer easement between the development property line and sewer main. 9. The water line where it serves fire hydrants shall be 8" diameter con- structed to City Standards. 10. Fire hydrants shall be-provided on -site in accordance with the requirements of the City Fire Marshal. ' 11. All of lot 15 (common area) shall be dedicated to the City as a blanket easement for access and maintenance of the creek, the 5' diameter drain pipe and public utilities. 12. The sewer and water mains to be included within a City easement shall be separated by at least 10 feet. Each main shall not be closer than 5 feet from a building or curb. 13. Subdivider shall submit soils tests showing that the substantial fill on the property meets all City requirements. map shall be constructed to City structural standards. The roof drainage from the buildings shall be carried to the private street and the point of disposal of the storm run -off be at the creek, either by an easement across the neighbors property or by a pipe to the creek at the rear of the lot. 4. Subdivider shall dedicate a 10 foot wide tree planting easement across the Johnson Avenue frontage of the property and plant trees in accordance with City requirements. 15. The final grading plans shall reflect the following revisions not shown on the tentative tract map: a) The contours should be referenced .to a City datum. b) Grading within 2 feet of the property lines should indicate a retaining wall being constructed. c) Contours should be extended to the west of the development to indicate the flow line of the creek. Dan Smith continued that a residential planned development established the basic site plan layout and building character was previously approved by the City. The intent of the proposed subdivision was to establish the project as would be home owners as opposed to tenants. Individual lots would conform to building foundation lines.plus an area.for.individual patios. The common area designated as lot 15 would be owned and.maintained by a homeowners-association. He stated that the Planning Commission determined that tentative tract map was consistent with the approved planned development. The Environmental Review Committee had granted a negative declaration for the project. The Planning Commission and staff recommended approval of the Tentative Tract Map No. 649, subject to the previously listed findings and conditions. In addition to the conditions. listed, Dan Smith stated that the Planning Commission included a new condition, lot 14, which would be a lot used for a play lot. On motion of Councilman Gurnee, seconded by Councilman Jorgensen, the following resolution was introduced: Resolution No. 3370 (1977 Series), a resolution of the Council of the City of San Luis Obispo granting approval of Tentative Tract Map No. 649, located at 2803 Johnson Avenue. Passed and adopted on the following roll call vote: AYES: Councilmen Dunin, Gurnee, Jorgensen, Petterson and Mayor Schwartz NOES: None ABSENT: None 14. Memorandum from Charles Dills, Chairman, Citizens Advisory Committee, notifying the City Council that the CAC had completed the supervision of the last 6 issues of the Newsletter-and they would like to have the City Council make the decision whether they should continue and made the following suggestions: 1. Make the present newsgatherer and writer,. Richard Schmidt, the editor, in fact, with accompanying editorial responsibility. 2. Provide him with increased remuneration for his efforts. 3. Publish a double -page spread each time. 4. Utilize the Newsletter to convey the Council's policies or messages to the public. Foster Gruber, Secretary to the Citizens Advisory Committee, reviewed some of I the points of Charles Dills' letter with the City Council.. Councilman Gurnee stated that he supported the concept of a Newsletter and-felt that less restraints should.be made on the editorial policy in order to get more input from the public. City Council Minutes July 11, 1977 Page 5 Councilman Petterson said.he would support continuation of the six Newsletters in the Telegram Tribune, but rather than hire an outside writer, that the City should use the-in-house writer, Robert Anderson. Councilman Jorgensen agreed and stated he would support the continuation of the Newsletter and also felt that Robert Anderson, who was already on the City staff, should do the actual technical writing. Mayor Schwartz agreed that the Newsletter should be continued for public information. Councilman Dunin stated that he supported the concept of a Newsletter and felt that the City should proceed with the minimum of 6 issues. On motion of Mayor Schwartz, seconded by Councilman Jorgensen,.that the City Council- approve 6 or less Newsletters for the 1977/78 fiscal year with City Clerk, J.H. Fitzpatrick, acting as.Coordinator with Bob Anderson to do the technical writing. Motion carried, all ayes. 15A. At.this time the City Council considered the plans and specifications for "Water Reservoir No. 1, Install Floating Cover ", City Plan No. 37 -77, to be funded under the Capital Outlay Budget at an estimated cost of $250,000 including contingencies and engineering. On motion of Councilman Petterson,-seconded by Mayor Schwartz, that the plans. and specifications be approved and the City staff authorized to go to bid. Motion carried. 15B. City-Council considered the plans and-specifications for "Santa Rosa Street Storm. Drain, Marsh Street to San Luis Creek", City Plan No. 25 -77, to be funded under SB 325 Funds. Estimated cost of $6,750 plus $875 for contingencies and engineering. On motion of Mayor Schwartz, seconded by Councilman Petterson, the plans and specifications be approved with the City staff authorized to go to bid. Motion carried. A. J.H. Fitzpatrick, City Clerk, was directed to write to Senators Cranston and Hayakawa, and Congressmen Ketchum, Lagomarsino and Panetta, urging that the Federal Government continue their financing for sewer plant improvements. B. J.H. Fitzpatrick, City Clerk, was directed to advise Zone 9 that Councilman Gurnee and Wayne Peterson had been appointed as City representatives to the committee. C. Wayne Peterson, City Engineer, was directed to review all reports for presen- tation to the City Council on the feasibility of dredging Laguna Lake.
