Communication from the Human Relations Commission recommending approval of a leave of.absence request by Orloff Miller, Human Relations Coordinator. R.D. Miller, Administrative Officer, felt that as the Human Relations Coordin- ator was a contract employee of the City Council, he did not feel that the City Administrator should get involved in his request for a leave of absence. Joe W. Turner, Chairman - Human Relations Commission, stated that the H.R.C. requests that the City Council approve a grant to Orloff Miller, half -time Coordinator of the Human Relations Commission, a leave of absence beginning April 1, 1978 to September 1, 1978, with pay through June 30, 1978. He stated this request had the full support of the Human Relations Commission. Joe Turner continued that this leave of absence request from the part -time position as H.R.C. Coordinator was in line with the sabbatical that Orloff Miller was taking from the Unitarian Universalist Church, and that he would be returning to both positions effective September 1, 1978. The H.R.C. voted unanimously to recommend to the City Council that Orloff Miller be authorized to use accumulated hours of overtime in his position for the period April 1 through June 30, 1978, and the period from July 1 through August:.31, 1978, would be an unpaid leave of absence. Joe .Turner reviewed the existing contract with Orloff Miller stating that he had to put in 20 -hours a week with the H.R.C. Commission, but that he put in many more hours and that over the months he had accumulated this overtime and the Commission felt that it would be no more than fair to have the Coordinator take this as part of his leave of absence. Many hours of overtime accumulated by Orloff Miller were in direct cause by the work he does for the Commission and also the tremendous: amount of time put in with the recent Human Needs Assessment that has been going on sponsored by the Human Relations Commission. On behalf of the H.R.C., Joe Turner recommended that the City Council approve the request for leave and allow the Coordinator to use up his accumulated overtime. Orloff Miller, Human Relations Coordinator, spoke to the City Council on behalf of his requested leave of absence. Councilman Dunin stated that, while he agreed that Orloff Miller did a magnificent job for the Human Relations Commission and the City, he questioned the method of requesting a sabbatical and wondered if it was legal to amend a personal contract during the life of the contract. He also felt that this matter of a sabbatical should be included in all future personal contracts with individuals. City Attorney Allen Grimes stated he could not give an opinion on the legality of the H.R.C. request as he had not researched it for this session, but in general, he felt that the contract was mute on leave or compensating time off provisions. Orloff Miller, H.R.C. Coordinator, explained how he accumulated such a large amount of overtime by working on various assignments and a great amount of time in the Human Needs Assessment Program. Councilman Jorgensen felt that he would agree with the approval of the sabbatical, but he felt that this was poor personnel.management in not supervising contract employees in such a tremendous amount of overtime and the lack of communication between City Management, the Human Relations Commission and the contract employee. Mayor Schwartz felt that now was the time for the Council to see that this 1 contractor and others be aware of the limits of employment, overtime,leaves, etc. City Attorney Allen Grimes stated that no where was overtime mentioned in the contract, but the Council could approve it if they feel it was proper. Councilman.Settle stated that he agreed with the other comments, but felt that due to the misunderstanding with H.R.C. he would approve the leave request, but hoped further contracts with individuals would cover this point and he felt that this would not set a precedent for future contractees. City Council.Minutes January 16, 1978 Page 3 Councilman Petterson stated that he did not feel the City could legally give these funds away without legal background to authorize it. City Attorney Allen Grimes felt that the Council could grant the sabbatical based on the recommendation of the H.R.C. On motion of Councilman Jorgensen, seconded by Councilman Settle, that the City Attorney prepare new documents which would. be prepared to grant a sabbatical to Orloff Miller by the City Council. Motion carried,.all ayes. On motion.of Councilman Settle, seconded by Councilman Jorgensen, this adjourned meeting adjourned at 12:40 P.M. to 4:00 P.M. this date due to the emergency caused by the heavy rains at the present time. Miller, Administrative Officer; Roger Neuman, Police Chief; Dave Romero, Director of Public Services; Richard Minor, Fire Chief Others PRESENT: George Silva, County Emergency Services Coordinator Mayor Schwartz asked for a brief report by all Department Heads on the emergency that faced the City during the heavy rains during the mid -day time. Police Chief Neuman reported on activities in his Department from 7.:00 A.M. to 4:00 P.M. this date. He stated that some Police Officers had been called back and would be working 12 -hour shifts until the emergency had passed. He stated that they had requested the National Guard to come to San Luis Obispo with 10 -heavy -duty trucks with drivers which would be available for 24 -hours for emergency services for the evacuation of people isolated by flood waters. Councilman Jorgensen asked how areas fared where City had taken remedial action in the past. Administrative Officer,R.D..Miller stated we were doing quite well at Laguna Lake, Lincoln at Broad and San Luis Creek in the vicinity of Santa Barbara Savings and Loan. City Council Minutes January .16, 1978 Page 2 . D.F. Romero, Public Services Director, stated that most areas under his jurisdiction were under control. He stated his crews were keeping.all the drains open, and overall everything was in good shape and very little damage; Just a lot of water in a short period of time. Fire Chief Minor stated that all Fire Engines in the City were in service with three men on each vehicle plus emergency vehicles and.the ladder truck were manned. The Conservation Corps would be available for sandbagging, debris clearing, etc., on call and also on standby were Fire Engines from the California Department of Forestry and Men's Colony on a 15- minute standby notice. George.Silva, County Emergency Services.Coordinator, reported on the actions through his office in clearing these emergency requests of the City. Lt. Sanders, California National Guard, stated that he had reported to City Hall at 4:00 P.M. with 6 trucks and drivers available for emergency assignments and that more trucks and drivers will be available during the night hours if needed. D.F. Romero, Public Services Director., reported to the Council on the primary areas where problems occurred. Councilman Dunin stated that he felt that the major areas that were flooded today were areas that had flooded before during heavy rains and he felt that the City Council should look into future programs on enlarging and improving the City Storm-Drains System which he felt were inadequate. After discussion by the City Council, it was determined that there was no need for further emergency procedures, that the City Staff had the situation .in hand and there being no further business to come before the Council, the meeting adjourned at 4:30 P.M. Romero, Director of Public Services. 1. At this time the City Council held a Public Hearing on the Appeal of Irving W. Petersen, on behalf of.Dalessi Center, Inc.,. and Mann Theatres, from a decision of the A.R.C. to continue consideration of their project which he alleged was a violation of the A.R.C.'s adopted procedures.
