On motion of Councilman Dunin, seconded by Councilman Settle, and upon the recommendation of Richard Miller, Administrative Officer, the printer and translator for the',Fire Department Communications System portion of the Police /Fire Consolidated Communications Center was authorized to be rebid. Motion carried,',all ayes. There being no further business to come before the City Council, Mayor Schwartz adjourned the meeting at 1:00 a.m., August 2, 1978, to 12:10 p.m., Monday, August 7, 1978. HEARING ROOM, CITY HALL, 990 PALM STREET Roll Call Councilmen PRESENT: Ron Dunin, Jeff Jorgensen and Mayor Kenneth E. Schwartz ABSENT: Steve Petterson and Allen Settle City Staff PRESENT: J:H. :Fitzpatrick, City Clerk; Richard D. Miller, Administrative Officer; Henry Engen, Director of Community Development; Dan Smith, Senior Planner; Greg Smith, Planning Technician 2. Council consideration of the final Parcel Map_SLO -77 -272, Laurel Lane. Dan Smith, Senior Planner, presented for the Council's consideration, the approval of the:lot split for the Parcel Map no. 77 -272 for the former General Fireproofing Building, now Vetter Fairing Company. He stated that the Condition No. 6 of the original conditions of approval read that the old General Fireproofing Building should be connected to a 16" city water main for fire protection prior to occupancy of the building. This should read "prior to removal of the water tank," rather than "prior to occupancy." The tank now provides the required fire flow and upon removal of the tank (condition #7) the:building would have to be connected to the 16" main to compensate for lost fire flow. In order to ensure that the tank remains until the other connection is made, and to ensure that the new owner of the lot (with the tank) can remove it in orderlto comply with the applicable conditions, the.easements for the tank will be automatically revocable upon Mr. Vetter connecting to the 16" main'ifor fire flow. He has agreed to do this with a note.on the final map by December 31; 1978. Therefore, after December 31, 1978, the circumstances will be as follows: 1. Mr. Vetter's building will be connected to the 16" main and disconnected from the tank.: 2. The easements and ownership of the tank will be abandoned to whomever owns the lot with the tank. 3. The tank will be removed prior to the issuance of a building permit for the vacant:lot. (The new owner having full control without any easements or encumbrances.) u LJ 1 City Council Minutes August 7, 1978 Page 2 The city staff recommended that the City Council approve the final map with notes as described. On motion of Councilman Jorgensen, seconded by Councilman Dunin, the following resolution was introduced: Resolution No. 3642 (1978 Series), a resolution of the Council of the City of San Luis Obispo granting final approval of Parcel Map SLO -77 -272, located at 1150 Laurel Lane (Ted Maino, applicant), with the map to show Condition No. 6 modified to read as follows: "A note shall be placed on the final map indicating that the building on Parcel 'A' shall be connected to the 16" city main for fire pro- tection to the approval of the City Fire Department prior to disconnection from the water tank." Passed and adopted on the following roll call vote: AYES: Councilmen Jorgensen, Dunin and Mayor Schwartz NOES: None ABSENT: Councilmen Petterson and Settle 1. Henry Engen, Community Development Director, presented for the Council's consideration a recommendation from the Planning Commission submitting changes to the Environmental Impact Procedures and Guidelines of the City. He stated that revised state regulations have again made it necessary to revise the city's procedures and guidelines. He continued that the state mandated changes are: The planning staff also recommended the city procedures be amended to allow the City Council full authority to review and certify E.I.R.'s for projects which they must approve and make the policy section more clear. Staff felt this was more appropriate because in practice, the Council has ended up modifying and certifying the E.I.R.'s on many projects. He continued that the E.R.C. has reviewed and endorsed the changes. He stated that the Planning Commission feels that they remain the body to certify all final E.I.R.'s and they recommended approval of the other proposed changes. The City Council then reviewed some of the suggested changes to the city's procedures and guidelines for environmental impact and found that the majority of the changes required by the state would have to be accepted. The only question was placed by Councilman Dunin in Section 4, Appeal Procedures - A. Exemption decision of Department of Community Development; a. Any person may appeal the decision of the Department of Community, etc. He questioned whether any person should be qualified to mean any person living within the city, any person living within the county, a property owner, etc. He felt that the word any person was too broad and someone just passing through the community could appeal a decision and then move on. A. There are now mandatory time limits for processing Environmental Review applications. B. The city may not approve projects with adverse environmental impacts unless it could make the finding that there is no feasible way to mitigate the impact. C. The city must notify all responsible agencies (agencies which must approve a project but are not the lead agency) before determining whether to file a negative declaration or prepare an E.I.R. and again before preparing an E.I.R. D. The decision - making body (Council or Planning Commission, depending on type of project) must have the final authority to determine whether a negative declaration of environmental impact or an environ- mental impact report is done for the project. Councilman Dunin stated that without some change in wording he could not and would not votelto amend the procedures and guidelines as recommended. Therefore, with only three councilmen being present, the consideration to adopting amended procedures and guidelines to the city's E.I.R. was continued to August 15, 1978. There being no further business to come before the Council, the meeting adjourned to 12 :101p.m., Monday, August 14, 1978. The City Council met at 12:10 p.m. to discuss Henry Engen's work program with him. Discussion ranged rather widely, discussing timing, progress, problem 'to be encountered, etc. Council continued to express its displeasure at delay in completion of circulation element by Wilbur Smith and suggested that staff not be in too much of a hurry to make final payment. 2.
