1,. 'HISTORICAL PRESERVATION REGULATIONS (File 41457)
Council reviewed draft regulations proposed by,the Cultural Heritage
Committee regulating the design of new construction in historical districts
and the exterior modification of designated historical properties.
Terry Sanville, Principal Planner, reviewed the Council agenda report and
the background summary of the program's development and overall review
strategies. I
The purpose of this meeting was to allow staff to present the recommendations
of the Architectural Review Commission and the Planning Commission, allow
representatives of the Cultural Heritage Committee an opportunity to make
their presentation, schedule a future study session to give the legal and
planning staff specific direction on the content of preservation regulations,
by formulating a preferred project review strategy.
Sandy'Merriam,-a member of the Cultural Heritage Committee, then made the
presentation-on behalf 'of the full committee. He'then introduced members,
Frederick Mamerow, Priscilla Graham, Gloria Heinz, Chuck Quinlan and former
member Leo Pinard. Primarily, he identified the recommendations being made
by the Cultural Heritage Committee and how they differed with those of the
ARC and the Planning Commission. Although this would be an additional.'
review body, the committee had tried hard to streamline the process in
order that a development project would not be unduly held up due to-this
board. He would urge the Council to adopt an ordinance or other strong
regulations that would provide the mechanism for enforcement if necessary.
Councilman Dunin questioned if the committee had reviewed the cost implications
including enforcement that an additional review board would incur as a
result of the regulations imposed upon the homeowner. He was also concerned
as to the criteria used in establishing the various districts which would
be zoned historical.
Councilwoman Dovey commended the CHC, felt they were going in the right
direction, and although there may be some fine tuning to be done of the
ordinance, she was highly supportive of'it. She would like to see more
emphasis placed on the positive aspects that the regulations would provide.
She felt that the survey and the district designation was the most important
and the zoning could follow. She also commended the CHC for the objectives
and rather than calling them regulations she would prefer to have them
considered as a "Designated Historical Resource" document:

Mayor Billig.agreed with comments by Councilwoman Dovey, was highly supportive
of the regulations as proposed, although, there were some areas still
needing to be reviewed or amended by Council. She felt the ordinance was
long overdue and, had it been in place at the time the Park Hotel was being
developed, could have saved considerable costs for the developer and been
much less time consuming than it was. She would like to see the committee
further analyze the incentives outlined in the report.
Councilman Dunin stated, again, that he was supportive of the approach and
attitude of the committee. His concerns were primarily with the creation
of a body that might be over - regulatory. He would again urge that any
regulations that were approved would be done more in the format of guidelines,
with the committee to be available on an on -going basis to review and
monitor.
Councilman Settle stated he was also very supportive of the program. He
too would like to see more in -depth review of the incentives, but felt this
was a good point of departure. He was supportive of Councilman Dunin's
concern that the City not just appoint another review body.
Mayor Billig again emphasized that she would hope the regulations could be
streamlined wherever possible and at a later date a brochure be developed
that would explain how the process works on a step -by -step basis.
With response to Councilman Dunin's concerns, Councilman Settle stated that
these regulations may need to be adopted in an ordinance format rather than
guidelines if in fact the homeowners would -need this kind of a mechanism in
order to obtain grant funding.
Mayor Billig requested that staff prepare a matrix that would more clearly
identify the various recommendations by.the ARC, Planning Commission and
the•CHC::
Upon Council concurrence this item was continTied for additional review and
report back by staff. 1.
2:00 p.m. Mayor Billig declared a recess.
2:20 p.m:-City Council reconvened in closed session to discuss personnel
matters, Councilman Griffin absent.
3:30 p.m. there being no further business to come before the City Council,
Mayor•Billig adjourned the meeting to Tuesday; - August 14, 1984 at 7:00 p.m.
