C -3 CLAIM AGAINST THE CITY - SAN LUIS AUTO SALVAGE (File #189)
Claim against the City by San Luis Auto Salvage in the amount of $271.15
for damage to vehicle allegedly caused by City truck during chip seal
project in the 11400 block of Los Osos Valley Road was denied as
recommended (5 -0).
C -5 PLANS AND SPECIFICATIONS - MAINTENANCE BUILDING (File #86 -18)
Plans and specifications for "Corporation Yard Sewer Maintenance
Building, ".City Plan No. K -48D; bid estimate.$45,000, without
contingencies, were approved and staff authorized to advertise for bids as
recommended (5 -0).
C -6 WASTEWATER MANAGEMENT PLAN (File #526)
Councilman Griffin questioned that the scope had not come to the Council
prior to advertising for the RFP. He was concerned that the water and
wastewater management plans were brought together and wanted to be sure
that the scoping would include it.
Moved by Settle /Rappa (5 -0), staff authorized to negotiate contract with
Brown & Caldwell to prepare the Wastewater Management Plan as recommended
with final contract to come back to Council.
C -7 FINAL SUBDIVISION _ TRACT 1272 (File #410 -1272)
Resolution No. 6095 (1986 Series), was adopted as recommended granting
final map approval for Tract 1272, creating a 15 -lot residential
subdivision located at 2377 Flora Street and 2348 and 1410 Johnson Avenue;
Joe Boud, subdivider (D.Q. & E.J. Miller, E.J. & S. J. Gelinas, and M.
Bravo) property owners (5 -0).

Council held a public hearing to consider giving final passage to
Ordinance No. 1077, amending the Mobilehome Rent Stabilization regulations
(continued from 9- 22 -86).
Steve Henderson, Assistant to the CAO, gave the staff report and
recommended that Council give final passage to the ordinance as
recommended.
Mayor Dunin declared the public hearing open. No one spoke for or against
the proposed ordinance. Mayor Dunin declared the public hearing closed.
Moved by Settle /Dover (5 -0), Ordinance No. 1077 (1986 Series), was given
1 final passage as recommended.
2. COUNCIL COMPENSATION (File #313)
Council considered establishing: 1) a Council Compensation Plan: and 2) a
Compensation Management and Budget Policy Statement.
Ann Crosser, Personnel Director, briefly reviewed the agenda report with a
recommendation that Council adopt a resolution establishing a Council
Compensation Plan and approve the Management and Budget Policy Statement
as recommended.
Mayor Dunin asked for public comment.

Jim Buttery, 1304 Pacific Street and Chairperson to the Committee, briefly
reviewed the Committee's review and recommendations.
Mayor Dunin closed the public portion.
Councilman Griffin suggested an amendment to the policy statement that
would read: "The Committee may also consider appropriate amendments to
this policy statement by recommendation to the Council ".
Moved by Rappa /Settle, (4 -1, Griffin voting no), Resolution No. 6096 (1986
Series), was adopted approving the compensation plan as recommended and
the Compensation Management Budget and Policy Statement as recommended.
3. HISTORICAL PRESERVATION (File #457)
Council held a public hearing to consider a Cultural Heritage Committee
recommendation to approve Historical Preservation Program Guidelines
(continued from 5- 21 -85).
Councilwoman Rapp a stepped down due to a possible conflict of interest.
Mike Multari, Community Development Director, briefly reviewed the agenda
report.
Terry Sanville, Principal Planner, reviewed in more depth the background
and stated that the recommended action was for Council to adopt the
resolution approving the Historical Preservation Program Guidelines as
prepared by the Cultural Heritage Committee. Further, it was recommended
that staff as well as Cultural Heritage Committee be directed to prepare
implementing ordinances and benefit program guidelines for consideration
by the Planning Commission and City Council.
Mayor Dunin declared the public hearing open.
Dan Krieger, representing the Cultural Heritage Committee and a member of 1
the Historical Society, urged adoption of the program guidelines.
Leo Pinard, President of the Old Town Association, also urged support of
the ordinance. He stated there was concern about absentee landlords
having access to city funds for the loan program and suggested an
amendment to that section so that loans only be available to
owner- occupied units.
Mayor Dunin declared the public hearing closed.
Councilman Settle stated he was supportive and agreed with the Planning
Commission recommendations that the guidelines would allow that the
property could be added to or deleted from the master list of historical
resources.
Councilwoman Dove y stated she could support all the recommendations with
the exception of those of the Planning Commission, and would be willing to
consider making some amendment to exempt absentee landlords from loan
programs eligibility. She would like to see at least the majority of the
membership on the committee be San Luis Obispo residents. She did not
feel that there was a need for the ARC member to have historic expertise.
She also could not agree with the Planning Commission recommendation
insofar as a property owner being able to delete the property from the
list.
Councilman Griffin stated he could support an amendment that would provide
that the owner occupied properties be given a stronger preference. He did
not agree with the Architectural Review Commission recommendation
regarding the ARC membership. He agreed that the majority of the members
should be San Luis Obispo residents.
Moved by Griffin/Dove y to amend the guidelines to provide that a stronger
preference be given to owner - occupied properties; deleting paragraph 3a
regarding ARC membership: and adding the word may, as recommended by
Councilwoman Dovey, to ask the CHC for review. Motion withdrawn.

Mayor Dunin stated that he would like to look at a revolving fund account
for the preservation or renovation program. He could not support a
stronger preference being given to owner - occupied properties. He also
could support allowing a person to remove his name from the list if given
a set of criteria. He agreed that the majority of the CHC members should
be San Luis Obispo residents and suggested a percentage rather than a
number, such as 75 %.
After additional discussion, moved by Griffin /Settle (4 -0 -1, Rappa
absent), Resolution No. 6097 (1986 Series), was adopted accepting the
Historical Preservation Program Guidelines as amended with item 2 of the
resolved to read: "The revised Historical Preservation Program Guidelines,
attached hereto as Exhibit A are hereby accepted for use in developing
appropriate ordinances to implement the program "; also to delete the
requirement that ARC membership composition be changed, adding that
Cultural Heritage Committee be constituted such that a majority of the
members be residents of San Luis Obispo and to not provide for property
owners to add or delete their properties from the list.
4. PROPOSED SUBDIVISION - TRACT 1311 (File #410 -1311)
Council held a public hearing to consider a Planning Commission
recommendation to approve a tentative map for Tract 1311, creating an
11 -unit commercial- industrial air -space condominium complex at 3195
McMillan Avenue; C -S zone; McMillan Park, Ltd. (R. Carsel, B. Kitamura &
R. Longden), subdividers.
Mike Multari, Community Development Director, reviewed the agenda report
with the recommendation that Council approve the tentative map with the
findings and conditions as recommended.
Mayor Dunin declared the public hearing open. No one spoke for or against
the proposed map. Mayor Dunin declared the public hearing closed.
' Moved by Settle/Rapp a (5 -0), Resolution No 6098 (1986 Series), was adopted
approving the tentative map for Tract 1311 as recommended.
8:40 p.m. Mayor Dunin declared a recess. 8:50 p.m. City Council
reconvened in Open Session, all Councilmembers present.
5. SPECIFIC PLAN AMENDMENT (SP 1283) (File #415)
Council held a public hearing to consider a Planning Commission recommen-
dation to amend the Edna -Islay Specific Plan text to allow mobilehome
parks; City of San Luis Obispo, applicant.
Mike Multari, Community Development Director, briefly reviewed the agenda
report with the recommendation that Council adopt a resolution approving
the amendment as recommended.
Mayor Dunin suggested that staff prepare guidelines for mobilehome parks
in R -1 zones so clarification is made prior to an application.
Mayor Dunin declared the public hearing open. No one spoke for or against
the proposed amendment. Mayor Dunin declared the public hearing closed.
Councilman Griffin suggested amendments to the resolution indicating that
mobilehome parks not be preferred within low- density housing areas.
Councilwoman.Dovey suggested amendment to read, " Mobilehome parks within
underlying low- density areas shall be limited to x amount of dwelling
units per acre."
After additional discussion and upon consensus, Council continued this
item to date certain Tuesday, October 28, 1986, at 7:00 p.m. with
direction to staff to come back with wording clarification (5 -0).
6. REZONING - ORCUTT ROAD (CR 1277) (File #463)
Council held a public hearing to consider a Planning Commission
recommendation to amend the zone map to change the designation from
Manufacturing (M) to Manufacturing with special considerations (M -S) in
the 800 to 900 blocks (odd) of Orcutt Road; City of San Luis Obispo,
applicant.

Mike Multari, Community Development Director, reviewed the agenda report
with recommendation that Council introduce an ordinance affirming a
negative declaration granted by the Community Development Director and
approving the rezoning from M to M -S.
Mayor Dunin declared the public hearing open.
Burt Forbes, nearby property owner, spoke against the proposed action. He
felt that the real issue dealt with the grade separation and when it would
be eventually built. 1
Norman Beko, president of a manufacturing company and also a property
owner of one of the three parcels, spoke against the proposed rezoning.
He would be supportive of putting together a committee for planning a
circulation system for these parcels.
Mayor Dunin declared the public hearing closed.
Councilwoman Rapp a felt that it was important to use the "S" designation
because of the problems regarding circulation and preserving the habitat
of the creeks, so that all persons involved be aware that this is a
sensitive area.
Councilman Settle suggested looking at a specific plan for the entire
area.
Mayor Dunin asked that the record reflect that neither the property owner,
Mr. Stickler nor his representative, was in attendance at the meeting
although they had been notified.
After brief discussion, moved by RappaiDoveY to introduce the ordinance to
print confirming the negative declaration grant by the Community
Development Director and approving the rezoning from M to M -S as
recommended. Motion failed (Griffin, Settle and Dunin voting no).
Moved by Griffin /Settle (5 -0), to continue this item with direction to
staff to explore with the two property owners of the three subject parcels
and the adjacent corner property owner, options for a master plan approach
for those properties.
7. STREET ABANDONMENT (File *535)
Council held a public hearing to consider final abandonment of a portion
of Pacific Street between Santa Rosa and Toro Streets (continued from
11- 15 -86).
Dave Romero, Public Works Director, reviewed the agenda report with the
recommendation that Council adopt the resolution abandoning a portion of
Pacific Street subject to recordation of a parcel map and reservation of
easements as recommended.
Mayor Dunin declared the public hearing open.
Dave Hannings, 104 Broad Street, stated he was concerned that through this
process of abandonment, that the City was not actually encouraging larger
office development.
Mayor Dunin declared the public hearing closed.
After discussion, moved by Settle /Dunin (5 -0), Resolution No. 6099 (1986
Series), was adopted approving the final abandonment of a portion of
Pacific Street between Santa Rosa and Toro Street as recommended.
8. OFFICE DEVELOPMENT (File *431)
Council held a public hearing to consider an ordinance amending Chapter
17.90 of the Municipal Code regarding major office developments to extend
the regulations to April 1. 1987 (continued from 9- 23 -86).
Mike Multari, Community Development Director, reviewed the agenda report
recommending the Council introduce the ordinance to print and schedule a
public hearing on October 28 for final adoption to extend the ordinance.

After discussion, moved by Settle/Rapp a to direct staff to give additional
review of expansion of purpose and intent of the ordinance. Motion
withdrawn.
Moved by Dovey /Rappa (3 -2, Dunin & Griffin voting no), Ordinance No. 1078
(1986 Series), was introduced to print amending the regulations to extend
the regulations as recommended.
9. REQUEST FOR FUNDS - H.A.Y. (File #1051)
Council considered a request from the Music & Arts for Youth Group
(M.A.Y.) asking the city to help sponsor a concert by the Masters
Orchestra of Switzerland (up to $4,000) (continued from 8- 5 -86).
Steve Henderson, Assistant to CAD, reviewed the agenda report with the
recommendation that Council approve the request by M.A.Y. and authorize
staff to negotiate an agreement, with the CAD to execute, which would
grant $4,000 to M.A.Y. for the concert by the Masters Orchestra of
Switzerland. Monies to come from Promotional Coordinating Committee
budget.
Mayor-Dunin asked for public comment.
Fred Balazs, President of M.A.Y., spoke in support of their request. He
stated he was available for questions or to explain the program.
Councilmembers discussed the timing of bringing this to the Council and
the inability of the Promotional Coordinating Committee to act on it due
to their grant funding process being completed and no monies available
from the grants program.
' Councilmembers had also discussed the need for having a better financial
picture given to them by Mr. Balazs.
Moved by Griffin /Dunin to authorize staff to negotiate an agreement
authorizing the CAD to execute to underwrite a concert performance by the
Masters Orchestra of Switzerland for an amount not to exceed $4,000.
Motion failed, Councilmembers Dovey, Rappa, Settle and Mayor Dunin voting
no.
C O M M U N I C A T I O N S
C -1 DEMOLITION OF THE SUNNY ACRES BUILDING (File #426)
Continued to Monday, 10/13/86 at 12:10 p.m. Staff directed to draft
letter or set up meeting with County officials and staff urging the
County's staff option 42 to adequately secure the building, including
possible increased city patrol, and urge the County's participation in the
City's demolition review process (5 -0).
C -2 PRE - APPLICATION CONFERENCE (File #442)
Mayor authorized to write a letter to the applicants urging joint
discussion between City and County officials as to future development of
the property. No pre - application review to be considered at this time
C -3 EIR FOR STATE WATER PROJECT (File #1122)
Council supported the scoping sessions for the State Water Project as
recommended.
C -4 LEAGUE RESOLUTIONS (File #362)
Continued to Monday, 10/13/86 at 12:10 p.m. Council to identify any
concerns for discussion on that date.
C -5 PETITION•- FRATERNITY NOISE (File #464)

Petition received from residents near Hillcrest and Phillips to be
forwarded to Cal Poly Dean of Students, President Baker's Office and Walt
Lambert for information.
11:35 p.m. Mayor Dunin adjourned the meeting to Closed Session to discuss:
1) pending litigation - Alpha Sigma Fraternity at 1681 Phillips Lane; 2)
pending litigation - Gracia vs. City; 3) pending litigation - Bartholow
vs. City; and 4) property acquisition of the Evans building.
There being no further business to come before the City Council, Mayor
Dunin adjourned the meeting at.12:35 a.m. to Monday, October 13, 1986, at
12:10 p.m.

1. CREEKSIDE APPEAL (File #428)
Council held a public hearing to consider an appeal by the Creekside
Homeowner's Association of a decision by the Mobilehome Rent Review Board
to deny application for a rent decrease for the tenants of Creekside
Mobilehome Park (continued from 9- 22 -86).
Steve Henderson, Assistant to the CAO, reviewed the agenda report with the
recommendation that Council adopt a resolution denying the appeal and
upholding the decision of the Mobilehome Rent Review Board to deny
application for a rent decrease for the Creekside Homeowner's Association
as recommended.
Mayor Dunin declared the public hearing open.
Pat Perry, representing the Tenant's Association, spoke on behalf of the
tenants and the two reasons for action of the appeal.
Robert Souther, Creekside Mobilehome Park #7, felt that all information
that had come forward should be referred back to the Rent Review Board.
Jim Buttery, representing Ed Evans, owner of the mobilehome park, stated
that Mr. Evans was ill, and spoke on behalf of the owner and reasons to
deny the appeal.
