1. PRESENTATION /COUNCILMEMBER SEAT':':::
Mayor Dunin gave a brief overview.of the Councilmember -elect
presentations. He presented farewell gifts to out going Councilmembers
GlennaDeane Dovey and Robert E. Griffin,
Pam Voges, City Clerk, administered oaths of office and presented
certificates of election to Mayor -elect Ron Dunin and Councilmembers - elect
Peg Pinard and Jerry Reiss.
The new Council took their places at the dias.

Councilmembers
Present: Councilmembers Peg Pinard. Vice -Mayor Penny Rappa, ,Jerry
Reiss, Allen K. Settle and Mayor Ron Dunin
Absent: None
It was then moved by Rappa /Settle (5 -0), to adopt Resolution Nos. 6363 and
6364 (1987 Series), for outgoing Councilmembers GlennaDeane Dovey and
Robert E. Griffin.
Moved by Settle /Reiss (5 -0), to appoint Penny Rappa Vice -Mayor for one
year, ending December 1. 1988.
7:30 p.m., Mayor Dunin declared a brief recess. At 7:45 p.m., City
Council reconvened.

The Consent Agenda, moved by Settle /Rappa (5 -0)., was unanimously approved
with exception as follows:
C -1 CONTRACT PAY ESTIMATES
Contract pay estimates and change orders approved and ordered paid as
recommended.
C -2 AWARD OF BID - STREET WIDENING (File #87 -27)
Resolution No. 6365 (1987 Series), adopted awarding contract to Walter
Bros. Construction Company in the amount of $157,838 for "Street Widening=
at Prado Road and South Higuera Street" and "Traffic Signal Installation
at Prado Road and South Higuera Street;" City Plan Nos. M -12B and K -31C.
Funds for this project to be transferred from the Capital Outlay and Gas
CRP Appropriations as recommended.
Councilwoman Rappa requested staff to keep Council apprised of the status
of this project.
C -3 ZONE 9 FUNDS (File #593)
Resolution No. 6366 (1987 Series), adopted budgeting revenue receivable
under the city's agreement with the County Flood Control and Water
Conservation District (Zone 9) as recommended.
C -4 FINAL MAP /SUBDIVISION ACCEPTANCE - TRACT 1459 (File #410 -1459)
Resolution #6367 (1987 Series), adopted approving final map and accepting
subdivision improvements for Tract 1459, creating a six -lot residential
subdivision at 160 Cerro Romauldo; Susan Schriner, subdivider, as
recommended.

1. APPEAL - USE PERMIT (File x407)
Council held a public hearing to consider an appeal by Dane Phillips of a
derision by the Planning Commission to deny use permit applications for an
off- premise sign /bench seating proposal.
Councilmember Jerry Reiss stepped down due to a possible conflict of
interest.
Nike Multari, Community Development Director, briefly reviewed the Council
agenda report, with the recommendation that Council adopt a resolution to
deny the appeal and uphold the decision of the Planning Commission as
recommended in the staff report.
Mayor Dunin declared the public hearing open.
Dane Phillips, applicant, spoke in. support of his appeal.
GlennaDeane Dovey, 3170 Flora Street, spoke in opposition to the proposed
request stating that it violated the intent of the sign ordinance.
Randy Courtright, part owner and appellant, spoke in support of the
appeal.
Mayor Dunin declared the public hearing closed.
After brief discussion, moved by Rappa / Pinard (2 -2 -1, Councilman Reiss
absent). to adopt a resolution denying the appeal and upholding the
decision of the Planning Commission as recommended. The motion failed.
Councilwoman Pinard felt the benches would provide a negative visual
impact.
Councilwoman Rappa stated she would be interested in looking at a benching
program but could not support this request.
Councilman Settle and Mayor Dunin felt that the benches would provide a
real service to the seniors.
It was then moved by Settle 'Dunin (2 -2 -1, Councilman Reiss absent), to
refer this to the Architectural Review Commission for input. The motion
failed.
Moved by Settle /Dunin (3 -1 -1, Councilwoman Rappa voting no /Councilman.
Reiss absent), to continue this item for a matter of no more than six
months to be brought back for further deliberation.
Councilman Settle stated he would be interested in investigating other
options that might be available through the ARC and Planning Commission'.
2. REZONING - SOUTH STREET (PD 1328) File x463) ,
Council held a public hearing to consider a Planning Commission
recommendation to approve a preliminary development plan and amend the
zoning map from service - commercial (C -S) to service - commercial - planned
development (C -S -PD) to allow large office uses at 265 -285 South Street;
Volny Construction, Inc., applicant.

Mike Multari, Community Development Director, reviewed the agenda report
with the recommendation that Council introduce the ordinance to print,
which would approve the preliminary development plan for PD -1328 subject
to findings and conditions noted in the staff report.
Mayor Dunin declared the public hearing open.
Bill Dermaty, representing the owner, was available for questions. He
stated that he could support the additional condition being recommended.
Mayor Dunin declared the public hearing closed.

Moved by Settle /Reiss (5 -0), to introduce Ordinance No. 1104 to print
approving the preliminary development plan and rezoning properties from
C -S to C -S -PD as amended.
3. CONSTRUCTIONT CODE AMENDMENTS (File #402)
Council held a public hearing to consider an ordinance adopting the 19535
editions of the Uniform Construction Codes and making editorial and minor
amendments (continued from 11- 17 -87).
Mike Multari, Community Development Director, reviewed the agenda report
with the recommendation that Council adopt the resolution finding the
existence of certain climatic, geographic and topographic conditions which
would justify and require specific amendments to the Uniform Construction
Codes. Further, that Council introduce an ordinance to print adopting the
latest editions of the uniform codes and making editorial and minor
amendments.
Mayor Dunin declared the public hearing open. No one spoke for or against
the proposed recommendation. Mayor Dunin declared the public hearing
closed.
After discussion by Council, it was moved by Rappa %Settle (5 -0), to
introduce Ordinance No. 1105 to print adopting the codes as recommended
and to delay the resolution until staff could bring back a revised
resolution which would address some of the concerns raised by
Councilmembers, specifically, Finding #3.
4. ZONING REGULATIONS AMENDMENTS (CR 1307) (File 9363)
Council held a public hearing to consider giving final passage to
Ordinance No. 1102 amending various sections of the zoning regulations
(continued from 10- 20 -87).
Mike Multari, Community Development Director, reviewed the agenda report
with the recommendation that Council give final passage to the ordinance,
deleting section #9, regarding parking spaces for certain residential
uses. In addition he suggested that this section be brought back at a
later time as a separate ordinance.
Mayor Dunin declared the public hearing open. No one spoke for or against,
the proposed amendments. Mayor Dunin declared the public hearing closed.
Moved by Rappa /Settle (4 -1, Mayor Dunin voting no), Ordinance No. 1102
given final passage with amendment to delete section #9 and to retain the
"S" designation.
8:50 p.m., Mayor Dunin declared a recess. At 9:00 p.m., City Council
reconvened, all Councilmembers present. No public comment was received.
B U S I N E S S I T E M
5. REQUEST FOR CITY SONG (File x114)
Council considered a request from Lucille Janisse to designate her song
' entitled, "Good 01' S.L.O." as the official City Song of San Luis Obispo
(this item was taken as Item #1).
John Dunn, City Administrative Officer, briefly reviewed the agenda report
with the recommendation that Council approve /disapprove the designation of
"Good 01' S.L.O." as the official song.
Mayor Dunin asked for public comment
Lucille Janisse, proponent for the song, recommended that Council adopt
this as the City's official song. She reviewed the history of the song to
date, stating that she first brought the song to Council nine years ago.
She then played three versions of the song.

No other public comment was received on this item.
Moved by Settle / Rappa (5 -0), to adopt "Good 01' S.L.O." as the official
City song of San Luis Obispo. Further, that staff be directed to send an
appropriate letter of resolution of thanks be sent to Mrs. Janisse for
bringing this to the City Council.
C O M M U N I C A T I 0 :N S
C -1 Upon general consensus, GlennaDeane Dovey was appointed to the
Economic Opportunity Commission (5 -0).
C -2 Upon general consensus, Penny Rappa was appointed to the S.L.O. Area
Coordinating Council (5 -0).
C -3 A memo of information from Community Development Director regardin,
the interpretation of zoning ordinance concerning a temporary shelter
of homeless in churches received and filed.
C -3 Upon general consensus, modifications to the Council table plan
approved as amended.
C -5 Upon general consensus, staff to report back on the transportation of
explosive rocket fuel on local streets.
C -6 Upon general consensus, staff to give status report back on the
recently formed County Solid Waste /Hazardous Committee. Council was
concerned that solid waste be reviewed and discussed by this -
committee. At this point, they had only discussed hazardous
materials.
C -7 Upon general concensus, staff to correspond with Cal Poly officials
regarding plans for increased enrollment at Cal Poly.
There being no further business to come before the City Council, Mayor
Dunin adjourned the meeting at 10:05 p.m. to Monday. December 7, 1987 at
