Leola Rubottom asked the Council to agendize the deletion of Section 5.44.060 of the Municipal Code which allows for automatic adjustments of rent based on increases for certain services. CONSENT AGENDA C-1 RESOLUTION OF APPRECIATION Council considered a Resolution of Appreciation to Jesse Gonzalez for his 34 years of service to the City. Moved by Romero /Settle to adopt Resolution No. 8292; motion carried (5-0). APPOINTMENT A -1 MASS TRANSPORTATION COMMITTEE (File No. 123) Council considered appointing Amy Baker as student representation on the Mass Transportation Committee for a two-year term to expire 3/31/96. Moved by Raooa /Roalman to appoint Amy Baker to the Mass Transportation Committee fora two-year term; motion carried (5-0). COUNCIL LIAISON REPORTS C.1-1. Council Member Raooa asked that the 1994 Homeless Survey and Needs Assessment prepared by the Economic Opportunity Commission be put in the Council Reading Tile for review and that a copy be forwarded to the Human Relations Commission. C.1-2. Council Member Raooa asked that Council consider their participation on the Air Pollution Control Board at the next available meeting. Council agreed to address this item during Communications at their May 31, 1994 meeting (general consent.) PUBLIC HEARINGS 1. ROSEMONT PLANNED DEVELOPMENT PROJECT (File No. 410) Council held a public hearing to consider a request for development plan approval, within a Conservation /Open Space zone, to enable three lots and three houses at the northwest end of Highland Drive, and a caretaker's dwelling near Highway 1, with an open space dedication (PD 45 -94); Felton Ferrini, applicant. Arnold Jonas. Community Development Director, and Glen Matteson. Associate Planner, reviewed the agenda report and history of the development. Mayor Pinard declared the public hearing open. Vic Montgomery, 3026 Higuera Street, representative for the applicant, urged Council to approve the development plan and pointed to the positive aspects of the project. 1 City Council Meeting Page 3 ' Tuesday, May 24, 1994 - 7:00 P.M. Gary Felsman, 2234 Santa Ynez, supported the project and asked that an effort be made to preserve the oak trees. Michael Sullivan, 1127 Seaward Street, said he wondered if this project would be approvable without the open space dedication. Pat Veesart . San Luis Obispo resident, said this area should be preserved as open space and that this development was not appropriate use of the land. Mayor Pinard declared the public hearing closed. Moved by Raaoa /Romero to introduce an ordinance to print confirming the negative declaration of environmental impact and approving the rezoning and preliminary development as amended to add Condition No. 8(F), "Landscaping shall be compatible with native hillside vegetation and shall provide a visual transition from developed to open areas," and Condition 13 amended to include use permit approval by the City Council of caretaker's dwelling; motion carried (4.1; Council Member Settle voting no). Moved by Romero /Raooa to refund application fee; motion carried (5-0). 2. ALTA VISTA PREFERENTIAL PARKING DISTRICT (File No. 554) Council considered a request to modify the boundaries and requirements for an existing preferential ' parking district south of the Cal Poly Campus. Mike McCluskev, Public Works Director, and Wayne Peterson, City Engineer, reviewed the request from the residents of the district. Mayor Pinard opened the public hearing. Tom Kaye, 369 Chaplin Way, clarified modification to the petition regarding issuance of additional parking permits. He said that the staff report was based on an earlier version of this provision and that the correct proposal is that a second permit would be available for a fee for those properties that have a one -car garage or carport and that have two legal living units on the property. Henry Case, 244 Albert Drive, told Council that there were not enough parking spaces In the district to allow two permits per residence. He said that a majority of the residents in the parking district had signed the petition. Lurene Milton, 163 Longview Lane, agreed with the new parking program. Ray Nordauist, 750 Pasatiempo, said that although Residents for Quality Neighborhoods did not take part in this proposal, he applauded the neighborhood for organizing to solve this problem. Marilyn Leverich, 258 Albert Drive, was in favor of the parking district as modified. Beverly Green, 138 Orange Drive, supported the parking district modification and said that the current plan posed serious safety concerns. Raymond Leiphty. 296 Albert Drive, asked that his house be removed from the parking district as he was opposed to the parking modification and felt it was anti - student, anti - family and would affect the resale value of his home. Dave Thompson, 1335 Foothill Boulevard, said his problems are unique in that due to traffic from the recreation center, he has no parking and that the proposal fails to address this. Barron Wiley. 1621 McCollum Street, was in favor of the district modification. Victor Anastasia, 296 Albert Drive, was opposed to the proposal. Dorothy Rasmussen, 249 Longview Lane, was in favor of the proposal. 8:30 PM Mayor Pinard declared a recess. 8:45 PM Council reconvened, all Council Members present. Duba Gott. City resident, said she did not experience parking problems and opposed limiting permits in favor of not parking on lawns. John Evans. 271 Longview, supported the modifications. Carl Atkinson, 1555 Slack Street, was in favor of maintaining the current rules of the parking district and said only the district boundaries need to be modified. Jay Oshiro. 183 Hathway, said the objectives of the proposal were unclear to him. Shena Lewis. 209 Longview Lane, thought her vehicles might be part of the problem and was opposed to the proposal. Pena Irwin, 230 Kentucky, supported the new ordinance. Eric Nicita. 1466 Balboa, expressed concern about the tone of some of the comments made tonight and felt the parking modifications were anti - student. Dominic Perello, Slack Street, said there is definitely a parking problem and that he favored the proposal. Roper Keeg, 1660 Frederick Street, asked who conducted the survey identifying those in favor and what effect the ordinance would have on other parking ordinances. Mike McCiuska Public Works Director, responded that staff compared the signatures they received to the addresses and created the map that determined 54% of the residences in the district favored the proposal. Regarding the ordinance, he said that in order to make the changes that were requested a finding cannot be made that non - residents are creating the problem, but that the change is the will of the neighborhood. Mayor Pinard closed the public hearing. City Council Meeting Page 5 Tuesday, May 24, 1994 - 7:00 P.M. Council discussed various compromises to the proposal, including two spaces per household with no restriction, no change in operating hours of the parking district, and eliminating some fringe properties where there is not clear majority vote in favor of the proposal. Moved by Roalman /Settle to introduce the ordinance as amended to allow two unrestricted parking permits without charge per residence with additional permits issued not to exceed twice the number of residential dwelling units on the parcel; motion carried (5-0). Council gave preliminary direction to staff on the resolution accompanying final passage of the ordinance. Council asked staff to send a questionnaire to peripheral properties in the parking district to help in setting the boundaries. Moved by Romero /Rappa to direct staff to work with the Alta Vista neighborhood to contact those property owners on streets on the boundaries of the district where it is not a clear they favor the district; motion carried (5-0). Moved by Roalman /Rappa that staff monitor the changes in the ordinance and review hours of operation of the parking district in one year. 10:15 PM Mayor Pinard declared a recess. 10:35 PM Council reconvened, all Council Members present. 1 3. APPEAL - 2006 RACHEL STREET (File No. 407) Council considered an appeal by Pete Evans of an Architectural Review Commission action to approve a four- apartment project at 2006 Rachel Street; Kathy Dang, applicant. Arnold Jonas. Community Development Director, reviewed the agenda report. Woody Combrink, ARC Co- Chair, said although the ARC approved the project, there was some concern regarding the lofts. Frank Randise, 2000 Rachel Street, approved of the project because it will provide affordable housing Pete Evans. Rachel Street; appellant, said the proposed apartment project would be imposing on the neighborhood and was concerned with zoning and appropriateness of use. Kathy Dang, applicant, said she wanted to continue with the project and gave the addresses of property owners who support her development. Chuck Crotser, the applicant's architect, said the project was well within the zoning regulations and urged Council to support the project. Anker Molver. 2022 Rachel, expressed his opposition to the project Lucinda Nichols, 1901 Henry, said the neighborhood was very much opposed to the project ' George Chan z 2034 Swazey, communicated his concerns about growth in San Luis Obispo but was not opposed to the proposed project. Page 6 The Council debated the issue of the lofts and other rooms that might be converted to bedrooms and exceed zoning density. City Attorney Jorgensen told Council that the project was consistent with the R -2 zoning and general plan for R -2 neighborhoods. Chuck Crotser, the architect, asked Council for clarification of what the options are in providing lofts In R -2 projects. Pete Evans, the appellant, said that lofts were not the point, but that the project was not compatible with the neighborhood. Woody Combrink, Vice Chair of the Architectural Review Commission, said the commission needed some direction on how to handle the issue of extra rooms and lofts until the policy is more clearly defined. Chuck Crotser suggested that he could eliminate one or more lofts and work with the ARC on what they would feel comfortable with as a compromise. Moved by Romero /Roalman to continue the appeal for a period of 60 days and direct applicant to work with staff to deal with issues brought before the Council tonight; motion carried (4-1; Council Member Rappa voting no). 4. APPEAL - 109 DEL SUR (File No. 407) Assistant City Clerk Kim Condon told Council that Item No. 4 on tonight's agenda, a public hearing to appeal a use permit for a second dwelling at 109 Del Sur Way, had been withdrawn by the appellant. Moved by Settle /Romero to accept withdrawal; motion carried (5.0). 5. ZONING TEXT AMENDMENT (File No. 463) A public hearing was scheduled to consider amendment to the Zoning Regulations to simplify processing, add and change definitions, clarity wording and format, and make minor changes to development standards. (Continued from.4 /11/94.) Moved by Romero/Settle to continue this item to Tuesday, May 31, 1994; motion carried (5-0). 6. BANNER POLICY (File No. 605) A public hearing was scheduled to consider revising the banner policy to eliminate all banners at Mission Plaza, provide a broader definition of events and limit banners to the announcement of events only. ORCUTT ROAD SETBACK UNE AMENDMENT ale No. 537) A public hearing was scheduled to consider adopting a revised setback line for Orcutt Road, between Broad Street and the SPRR, and limiting vehicular access to two locations on the south side of Orcutt Road, between Broad Street and the SPRR. (Continued from 4/19/94.) Moved Romero /Settle by to continue this item to Tuesday, May 31, 1994; motion carried (5-0). S. NEIGHBORHOOD TRAFFIC MANAGEMENT (File No. 537) A. CITYWIDE NEIGHBORHOOD STRATEGY /AUGUSTA STREET PEDESTRIAN SAFETY Council considered pedestrian safety devises on Augusta Street near Sinsheimer Elementary School. Mike McCluskev. Public Works Director explained the need to adopt a strategy for neighborhood traffic management planning and how the need for pedestrian crossing facilities on August Street had been brought to staffs attention by the Sinsheimer School. Mayor Pinard asked for comments from the public. Mary Lou Johnson, PTA Safety Chair for Sinsheimer School, suggested that Council adopt the staff recommendation for a pedestrian crossing on Augusta. John Ewan, 1221 Sylvia Court, expressed his concerns about the speed of traffic travelling on Augusta Street. Carol Tangeman, 806 Murray Street, supported the staff recommendation for neighborhood traffic management, but did not support citizen funding of these projects. Pat Veesart , 976 Buchon, expressed his support for neighborhood traffic management but objected to asking citizens to fund these projects. Moved by Roalman /Raaoa to adopt the strategy for proceeding with neighborhood traffic management planning and support staffs work with the Sinsheimer School to design, finance and install trial pedestrian safety facilities near Sinsheimer School: motion carried (5-0). B. CROSSING FACILITIES ON RAMONA AVENUE Council was scheduled to consider pedestrian crossing facilities on Ramona Avenue. Moved by Romero /Settle to continue this item to Tuesday, June 7, 1994; motion carried (5-0). 9. OPEN SPACE PLAN IMPLEMENTATION (File No. 462) Council was scheduled to consider the Open Space Plan Implementation. POWER BLOWER REGULATIONS (File No. 703) Page 8 Council was scheduled to consider giving final passage to Ordinance No. 1261 amending the noise regulations and restricting the hours of operation of power blowers in residential and non - residential zones. Moved by Romero /Settle to continue this item to Tuesday, May 31, 1994; motion carried (5-0). 11. INTERIM PARK CONCEPT FOR EMERSON PARK (File No. 800) Council was scheduled to consider an Interim Park Concept for Emerson Park as proposed by the residents of the Emerson area and approved by the Parks and Recreation Commission. Moved by Romero /Settle to continue this item to Tuesday, May 31, 1994; motion carried (5-0). 12. BICYCLE LICENSING (File No. 133) Council was scheduled to consider discontinuing the licensing of bicycles. Moved by Romero /Settle to continue this item to Tuesday, May 31, 1994; motion carried (5-0). COMMUNICATIONS COMM. 1. Jeff Jorgensen City Attorney, referred to his memo submitted to the Council regarding a request by Leola Rubottom that Section 5.44.060 of the Municipal Code, dealing with automatic adjustments of rent based on increases in expenses for common area utilities and other services. Staff was directed to bring this item back under Communications at the meeting of Tuesday, June 7, 1994; (general consent). COMM. 2. John Dunn, City Administrative Officer, clarified Council's need and desire to hold a meeting on Tuesday, May 31, 1994, in order to address items 5, 6, 7, 9, 10, 11, and 12 from tonight's meeting, and to consider extending the Sonic Cable franchise agreement.
