COUNCIL CHAMBER, 990 PALM STREET SAN LUIS OBISPO, CALIFORNIA ROLL CALL: Council Members Present: Council Members John Ewan, Christine Mulholland, Ken Schwartz, Vice Mayor Jan Howell Marx, and Mayor Allen K. PUBLIC HEARINGS RESOLUTION OF INTENTION AND INTRODUCTION OF ORDINANCE TO PROVIDE 3% AT 55 RETIREMENT FORMULA FOR LOCAL FIRE MEMBERS OF CALPERS. Risk Manager Jenny presented the staff reporL Mayor Settle opened the public hearing. There were no public comments. Mayor Settle closed the public hearing. ACTION: Moved by Marx/Ewan to adopt Resolution No. 9287 (2002 Series) of Intention and introduce an Ordinance No. 1408 (2002 Series) to print approving an amendment to the contract between the Board of Administration of PERS and the City of San Luis Obispo to provide the 3 %@ 55 retirement formula for Fire safety members; motion carried 5:0. 1 City Council Meeting Page 2 Tuesday, January 29, 2002 - 7:00 p.m. PRESENTATION 1 Steve Devencenzi, San Luis Obispo Council of Governments (SLOCOG), presented an overview of the Regional Housing Needs Assessment Analysis, a state mandated effort to address the need for affordable housing. He reported that the State Department of Housing and Community Development (HCD) has developed a methodology for distributing housing growth to local jurisdictions. He explained that the HCD housing allocation formula sets a target of 22,460 new housing units for the County of San Luis Obispo. Of those units, he added, the City of SLO would be expected to contribute 6,843. Determined that the HCD formula is impossible to meet, SLOCOG has developed an adjusted formula that would reduce the housing allocation to 10,360 units County-wide, with a City share of 3,034 units, he concluded. Council questions and comments followed. Steve Devencenzi encouraged Council Members to attend the March a SLOCOG Board meeting to support the adjusted formula for housing allocations and noted that a representative from the State HCD will be present. BUSINESS ITEM 2. SAN LUIS OBISPO PHASE II WATERWAY MANAGEMENT PLAN. Public Works Director McCluskey. Engineering Consultant Peterson, Natural Resources Manager Havlik. and City Biologist Clarke presented an in -depth staff report. Staff clarified that Council direction is necessary prior to defining a project for environmental review. Policies will be written into the Plan as the Council's preferred approach to flood management and then the Plan itself will be the subject of an Environmental Impact Report (EIR). Public Comments Pam Marshall Heatherington, 864 Osos Street, oberved that the Army Corps of Engineers allows greater flexibility for emergency creek repair. —end of public comments — Council reviewed Individual policies for six specific projects, as outlined in the staff report. Council Member Schwartz noted that while the policies being recommended are an improvement, they do not represent a comprehensive solution to flooding that will ensure the highest level of protection for the entire City. He shared paticular concern about the policies proposed for the Stenner Creek area and asserted that the flow capacities recommended are not adequate. He concluded that more work needs to be done to establish priorites for incremental solutions and that he was not supportive of the staff proposal in its present state. ACTION: By consensus, Council: 1) Endorsed flood design levels and conceptually approved further engineering analysis and evironmental review of the following "projects" to be Incorporated Into a draft Design Manual: a) Highway 101 detention City Council Meeting Page 3 Tuesday, January 29, 2002 - 7:00 p.m. basin, b) Mid Higubia vegetation management. and minor channel excavation, c) Mid Higuera bypass and terrace, d) the bypass channel adjacent to the creek below Elks Lane, e) the moderate widening at Prefumo/SLO confluence near Los Osos Valley bypass/terrace, and f) Stenner Creek bridge replacements (Foothill, Murray and Santa Rosa bridges). 2) Approved the Incorporation of a "No Net Fill' policy in the draft Design Manual, but to be applied only to areas currently significantly undeveloped (Elks Lane drive-in theater, the Dalidio area, and in new annexations of undeveloped land along the flood plan). COMMUNICATIONS There were no Communications. COUNCIL LIAISON REPORTS Vice Mayor Marx provided an overview of the Economic Vitality Corporation meeting of Janury 23, 2002 and announced that Ray Johnson has been appointed as the new Chief Executive Officer. Council Member Mulholland reviewed the January 24, 2002 Student Community Liaison Commission meeting. Council Member Mulholland reported on the January 28, 2002 Tree Committee meeting. Council Member Mulholland summarized the Cultural Heritage Committee (CHC) meeting of January 28, 2002, Mayor Settle called a break at 10:20 p.m. Mayor Settle adjourned at 10:30 p.m. to a Closed Session in the Council Hearing Room. CLOSED SESSION CONFERENCE WITH LEGAL COUNSEL: Existing Litigation: Mardi Gras of San Luis Obispo v. City of San Luis Obispo Pursuant to Government Code § 54956.9 At 11:50 p.m., City Attorney Jorgensen announced that a closed session was held. Council received a status report on the litigation.
