NOTICE OF OPPOSITION
Dear Assembly Member Achadjian:
The City of San Luis Obispo strongly opposes your legislation, AB 461, which adds a
new section to the Alcoholic Beverage Control Act authorizing the Department of Alcoholic
Beverage Control ("ABC") to issue new original on -sale licenses over a 3-year period. This
legislation specifically provides that in San Luis Obispo County, "ABC may issue five
additional new original on -sale general licenses for bona fide public eating places per year,
until January 1, 2017."
Alcohol related incidents impact quality of life, including noise, vandalism, public
urination, and other disturbances that occur as patrons leave nightlife and travel through
neighborhoods. It has been demonstrated that there is a link between alcohol and disorderly
conduct, public intoxication, impaired driving, physical and sexual assaults and other public
safety challenges associated with the nighttime activity and alcohol consumption. As you
know, the residents and neighborhoods here in the City of San Luis Obispo are
disproportionately impacted by these adverse consequences due to the intense concentration of
alcohol related businesses in our downtown.
Because the impacts of alcohol outlets are local, the City strongly opposes legislation
that undermines or circumvents local control. The City of San Luis Obispo is opposed to the
issuance of additional licenses in the City and for the above reasons opposes AB 461.
