RESOLUTION NO. 10895 (2018 SERIES) <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS <br />OBISPO, CALIFORNIA, CALLING FOR THE HOLDING OF A <br />GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, <br />NOVEMBER 6, 2018, FOR THE ELECTION OF CERTAIN OFFICERS AS <br />REQUIRED BY THE PROVISIONS OF THE CHARTER, ADOPTING <br />REGULATIONS FOR CANDIDATE STATEMENTS, FOR THE <br />SUBMISSION TO THE VOTERS OF A QUESTION WHETHER TO <br />ESTABLISH A CANNABIS BUSINESS TAX AND REQUESTING THE <br />BOARD OF SUPERVISORS OF THE COUNTY OF SAN LUIS OBISPO TO <br />CONSOLIDATE A GENERAL MUNICIPAL ELECTION WITH THE <br />STATEWIDE GENERAL ELECTION TO BE HELD ON NOVEMBER 6, <br />2018, PURSUANT TO § 10403 OF THE ELECTIONS CODE. <br />WHEREAS, under the provisions of the Charter, a General Municipal Election shall be <br />held on November 6,2018, for the election of Municipal Officers; and <br />WHEREAS, it is desirable that the general municipal election be consolidated with the <br />Statewide General election to be held on the same date and that, within the city, the precincts, <br />polling places and election officers of the two elections be the same, and that the county election <br />department of the County of San Luis Obispo canvass the returns of the General Municipal <br />Election and that the election be held in all respects as if there were only one election; <br />WHEREAS, Sections 37101 and 37100.5 of the California Government Code authorize <br />the City to levy a license tax, for revenue purposes, upon business transacted in the City; and <br />WHEREAS, as a result of recent voter -approved changes to statc law, there has been <br />strong interest by cannabis businesses to open in the City; and <br />WHEREAS, cannabis businesses are likely to create demands upon City services, and the <br />City does not currently impose any taxes upon cannabis businesses, aside from generally <br />applicable municipal taxes; <br />WHEREAS, the City Council desires to seek to impose a tax upon cannabis businesses, <br />in -lieu of the City's business tax set forth in Chapter 3.01 of the Municipal Code, to be known as <br />the "Cannabis Business Tax"; and <br />WHEREAS, the Cannabis Business Tax cannot be imposed without voter approval; and <br />WHEREAS, the City Council desires to submit a Cannabis Business Tax measure to the <br />voters of the City at the General Municipal Election to be held on Tuesday, November 6, 2018, <br />and to be consolidated with any other election to be held on that date; and <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis <br />Obispo, as follows: <br />R 10895 <br />
