,F <br />i <br />.r <br />L� 3 c��, PAfiE�3 <br />VD 1' <br />3854 r <br />DEED <br />FOR VALUE RECEIVED, SHELL OIL COMPANY, a Delaware corporation, <br />hereinafter called "Grantor, " grants to the CITY OF SAN LUIS OBISPO, a Municipal <br />Corporation, hereinafter called "Grantee, " all that real property situated in the City of <br />San Luis Obispo, County of San Luis Obispo, State of California, particularly described <br />as follows: <br />That portion of Lots 1, 2 and 3 of Block 1 of the Norton's Addition as recorded <br />October 24, 1901 in Vol. A, Page 79 of Maps in the County Recorder's Office, <br />County of San Luis Obispo, State of California, described as follows: <br />Beginning.at the most easterly corner of Lot 3, Block 1, thence N 32° 15' W a <br />distance of 177.53 feet to the southerly line of South Street; thence N 890 46' <br />W along the southerly line of South Street a distance of 112.64 feet to the <br />easterly line of Lawton Avenue; thence south along the easterly line of Lawton <br />Avenue a distance of 20.00 feet to a point; theme S 890 46' E along a line <br />parallel to South Street a distance of 113.44 feet to,a point; thence S 320 15' <br />E along line parallel to and 10' westerly of the westerly line of Broad Street <br />a distance of 153.84 feet, to the southerly line of Lot 3 of said Norton's <br />Addition; thence ,S 891 55' E along the southerly line of Lot 3 a distance of <br />11.84 feet to the point of beginning. <br />Containing .0901 acres more or less. <br />This conveyance is made upon the condition that the above described property <br />shall be used only for the purpose of street, highway, public utility or other public pur- <br />poses -which will not interfere with the access rights of the above described property to <br />the adjoining public streets. In the event Grantee abandons such use or fails to correct <br />a breach of the conditions after ninety (90) days written notice thereof, then Grantor <br />shall have the right to re - purchase said parcel at the then existing market price, to <br />be determined by arbitration if the parties cannot agree. As part of the consideration of <br />this conveyance, Grantee covenants to comply with this condition. Grantor's waiver of <br />any breach of this condition and covenant shall not constitute a waiver of this condition and <br />covenant or of any subsequent breach thereof.
