1. WHEREAS, Plaintiff JEFFREY MITCHELL and Defendants ARSENAL
24 EQUIPMENT RENTALS and IAN RUTHERFORD have agreed to settle this matter for the sum

of four-hundred and fifty thousand dollars ($450,000,00) in exehange for a release and dismissal
22 with prejudice of MITC-iELL's case against AKSE'NAL nd RUTHERFORD.

24 MITt;HBLL and ARSENAL and RUTHERFORD complies with thc factors and considerations sCl

9 motion for determination of good faith settlement would be a waste of client and judicial resourcas,
14 Therefore,the parties waive notice of any submission of this stipulation for approval by the Court,
11 whether on an ex parte basis or by formal noticed motion, because there is no opposition to the
12 proposed order,
13 THEREFORE, based on the above recitals, the parties HEREBY S"T1pULATE as

15 1. The settlement between Plaintiff JEFFREY MITCHELL and Defendants ARSENAL
16 EQUIPMENT RENTALS and IAN RUTHERFORD is in good faith; and
17 2. All past,present,and fi ture claims by any other party, or any other joint tortfeasor or
18 co-obligor, including non-parties to this action, for any claims of equitable comparative
19 contribution or partial or implied r comparative indemnity, based on oomparative ncgligence of
20 comparative fault,are forever barred.
