Greg is in charge of implementing the ADU and JADU laws. Some of the items on my list of concerns e-mailed to you earlier today have to do with JADU verbiage and, as I now understand it, will come from bill 68 so those items are state law and not negotiable tonight. However, the items that I listed having to do with ADU's are not state law and are coming directly from the planning department. Please do not approve these items. The item that I believe will prevent the most growth is the item pertaining to utility connections and I again would like to stress how this would negatively affect our goal to provide that housing. I also want to point out item g. of ADU law that allows a provision for cities to choose to be less restrictive with ADU's than the state verbiage. We as a city should be leading the way to better infill projects and utilizing this provision. The state has passed these bills with the intention of creating more affordable housing in a denser and more sustainable way and the City of SLO’s proposed changes seem to directly appose that goal. ADU's tend to be smaller units (mostly one bedroom and studio units). The changing of the states verbiage will directly affect small households that rent smaller units and homeowners like us that use rental income as a supplemental income in order to afford to own. As you know, the city has a legal obligation to provide more housing and these changes would prevent that happening for many individual homeowners and small developers. These are the people that live, work, and spend money in San Luis Obispo. Leaving growth solely up to large developments will result in sprawl and money leaving San Luis Obispo in the hands of large developers that don’t reside here. Please do not allow this to happen to our city. Infill projects via ADU’s are vital for healthy growth. Some of the items that concern me being proposed by the planning commission are: Limiting the number of bedrooms in ADU's to 2 (currently no bedroom amt restriction) Limiting size of detached ADU's from 1200 to 1000 Requiring JADU's to be located on owner-occupied property with a requirement to record a restrictive covenant 1 Requiring ADU design standards to match main house (some ADU's will be located on a separate street then main and, while it would legally be part of the property, it would read as a neighboring house). "The colors and materials of the accessory dwelling unit shall match the colors and materials of the primary residential structure" (same point as above) Making it possible for detached ADU's greater than 750 sq ft to be required to have a new utility connection and impact fees to apply. This one is huge as there are a couple of areas in SLO that require you to replace a neighbor’s lateral if you are adding a lateral on your property. So in the case of my lot it would be a connection for the proposed main, a connection for the proposed ADU, and 2 neighbor replacements! A huge portion of my budget as we self perform! 80k in laterals! Many homeowners would not build because of this particular restriction. Only allowing JADU's on lots where the ADU is detached. So the main, ADU and JADU could not all be attached. Not permitting JADU conversions from garages. Not permitting JADU's being detached from main. Restricting JADU size to 500 sq ft (I believe state said 750 sq ft but I will have to double check this one) Requiring JADU's to have a connection to the main house I appreciate your time and consideration.
