A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING AN AMENDMENT TO THE CITY /STATE AGREEMENT FOR
THE SAN LUIS OBISPO INTERMODAL PROJECT
WHEREAS, the City of San Luis Obispo wishes to provide intermodal
facilities and area improvements at the San Luis Obispo railroad station
for the benefit of community and area residents; and
WHEREAS, by Resolution No. 5439 (1984 Series), the City entered
into an agreement with the State of California to purchase property for
the San Luis Obispo Intermodal Facility Project and to complete the
project design work; and
WHEREAS, the City now wishes to proceed with.the construction of
this project.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San
Luis Obispo as follows:
SECTION 1. That the amendment to the agreement between the City of
San Luis Obispo and the State of California (Amendment #64B25'8 A /1) is
approved and the Mayor is authorized to execute the same.
On motion of Councilman Settle ,seconded by Councilman Griffin ,
and on the following roll call vote:
AYES: Councilmembers Settle, Griffin, Dovey, Rappa and Mayor Dunin
NOES: None
ABSENT: None

RESOLUTION NO. 5961 (1986 SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
APPROVING AN AGREEMENT FOR CALIFORNIA POLYTECHNIC STATE UNIVERSITY
TO PAY ITS SHARE OF THE CITY'S WASTEWATER TREATMENT PLANT EXPANSION
WHEREAS, in 1958 the City of San Luis Obispo ( "CITY ") and California
Polytechnic State University ( "UNIVERSITY ") entered into an agreement by
which UNIVERSITY purchased Capacity rights of .64 million gallons per day
in CITY's wastewater transmission lines; and
WHEREAS, in 1963 CITY and UNIVERSITY entered into an agreement by
which UNIVERSITY purchased capacity rights of .78 million gallons per day
in CITY's wastewater treatment plant; and
WHEREAS, by the 1963 agreement UNIVERSITY agreed to share
proportionately the cost of any wastewater treatment plant improvements
required by higher government authorities; and
WHEREAS, CITY and UNIVERSITY have informally agreed to increase
UNIVERSITY's transmission line capacity rights to 1.2 million gallons per
day and to decrease UNIVERSITY's treatment plant capacity rights to .6
million gallons per day; and
WHEREAS, the United States Environmental Protection Agency and the
State of California Water Quality Control Board required improvements to
the wastewater treatment plant which were completed on January 25, 1985;
and
WHEREAS, UNIVERSITY's share of the cost of the required improvements
is $74,993, but UNIVERSITY has only budgeted $63,031 for fiscal year
1985 -86 and will_budgetCale _e dining $i1,9O� foryfiscal year 1986= 87,;.a1
NOW THEREFORE
BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
1. To approve the Sewage Treatment Plant Upgrade Agreement by which
UNIVERSITY will pay CITY $63,031 as a part of its proportionate share of
the wastewater treatment plant improvements.
2. To authorize the mayor to execute the Sewage Treatment Plant
Agreement.
3. To direct the city clerk to return three executed -
copies of the Sewage Treatment Plant Agreement to:

This Agreement made and entered July 1, 1984, by and between California Polytechnic. State
University (hereafter referred to as the University) and the City of San Luis Obispo
(hereafter referred to as the City).
The University, as co -owner with the City of the Sewage Treatment Plant, agrees to pay the
City $63,031, as its proportionate share of costs associated with upgrading the treatment
plant. Attachment "A' is provided as part of this agreement and identifies the total
project cost, the local share at 12 -1/2% and the percentage assigned to the University
computed on the basis of the University's demand of 0.6 million gallons per day as a
function of the capacity of the plant of 5.23 million gallons per day.
Upon execution of this agreement, the City of San Luis Obispo will invoice California
Polytechnic State University, San Luis Obispo, in triplicate, the above referenced amount.
The provisions on the reverse side hereof constitute a part of this agreement.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO,
AUTHORIZING THE MAYOR TO SIGN AN AGREEMENT WITH
THE .SANTA CLARA COUNTY TRAFFIC AUTHORITY
FOR ASSIGNMENT OF FEDERAL AID URBAN (FAU) FUNDS
WHEREAS, the City of San Luis Obispo receives Federal Air Urban funds,
WHEREAS, these funds may only be used to construct and maintain
streets on the Federal Aid Urban system, and
and
WHEREAS, the City has approximately $160,000 in unallocated FAU funds,
WHEREAS, the experience of the City is that FAU projects may cost in
excess of 20% more than similar non -FAU projects, and
WHEREAS, the Santa Clara County Traffic Authority has requested an
assignment of $160,000 of funds for dollars, and
NOW, THEREFORE BE IT RESOLVED by the Council of the City of San Luis
Obispo as follows:
SECTION 1. The Mayor is hereby authorized-to sign an agreement
assigning Federal Aid Urban funds to the Santa Clara County Traffic
Authority.
SECTION 2. Funds to be used for transportation = related purposes.

WITNESSETH:

WHEREAS, City wishes to assign $ 150,000 of its allocation of FAU
funds to Authority in exchange for eighty percent (80%) of that amount in funds that may be used for
any transportation - related purpose;
WHEREAS, the Authority wishes to accept said assignment for use on a transportation project which
qualif es for FAU funding;
WHEREAS, the FAU funds are discounted to Authority because of expenditure restrictions and
increased administrative costs associated with using said funds;
WHEREAS, apportioned nonattributable FAU funds may be transferred between local agencies with
the approval of the appropriate local officials and, if applicable, the appropriate governing bodies
responsible for apportioning the funds within an urbanized area;
WHEREAS, Authority and City consider this assignment and exchange as fair
and equitable treatment under the FAU program;
Now, therefore, it is mutually agreed as follows:
1. City agrees to transfer $150,000 of its FAU fund
apportionment to Authority-,
2. Authority agrees to transfer $120.,000 _- _ _ to _City of San Luis Obispo on
notification by Caltrans that the apportionment is available for authority's use ; and
3. City of San Luis Obispo agrees to use the funds received from Authority for
transportation - related purposes.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SAN LUIS OBISPO
REGARDING THE USE OF TECHNICAL CONSULTING
SERVICES FOR LOCAL WATER RESOURCE ALTERNATIVES
WHEREAS, support from public officials throughout the County is being
sought on a concerted basis for actions leading to construction of the
Coastal Branch of the State Water Project using an assumption that the
County General Plan requires development of all available water resources;
and
WHEREAS, a more thorough evaluation should be undertaken of
alternative local water sources needed for responsible growth within the
County over the next 25 years; and
WHEREAS, the proposed recommendation to import State water for the
whole County has not adequately evaluated coordinated and combined local
sources, including the potential of the County's contracted water from
Lake Nacimiento; and
WHEREAS, a full evaluation could demonstrate the feasibility and
reliability of Lake Nacimiento water as a source of supplemental water for
the next quarter century for the central coast from San Simeon to Los Osos
and for San Luis Obispo; and
WHEREAS, it is crucial for the City of San Luis Obispo to cooperate
with all communities and public agencies to secure reliable, safe, and
cost - effective supplemental water in a manner that encourages
self - reliance and mutual support within the area.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San
Luis Obispo as follows:

1. Direct staff to develop a scope of work for the retention of a
technical consultant for review and analysis of local water resource
alternatives for the City of San Luis Obispo and surrounding areas.
2. Resource documents to be used in this review and analysis shall
include, but not be limited to:
a. San Luis Obispo County "Master Water Plan Update," April,
1986, Department of Water Resources and San Luis Obispo County Flood
Control and Water Conservation District.
b. San Luis Obispo County "Report on Master Water and Sewerage
Plan," May, 1972, by CDM Inc., Environmental Engineers.
c. San Luis Obispo County Engineering Department, "Facts About
Nacimiento Water Supply Project" for Measure N, November 5, 1974.
3. Local Water resource alternatives shall be evaluated on:
a. Quantity of Supply;
b. Water Quality;
c. Reliability;
d. Costs;
e. Environmental Impacts; and
f. Energy Consumption /Productivity.
4. The review and analysis of local water resources shall be an
independent assessment of alternatives and shall recommend an appropriate
course of action.
5. The review shall be completed and made available to the City
Council on or about July 1, 1986.

6. The City Administrative Officer shall transmit this resolution
with an appropriate cover letter to the County and to all local water
purveyors within the county.

THURSDAY NIGHT ACTIVITIES
BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. That the BIA Rules and Regulations for Thursday Night
Activities, attached hereto marked Exhibit "A" and incorporated herein by

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
DENYING. AN APPEAL AND UPHOLDING ACTION TAKEN BY THE
ARCHITECTURAL REVIEW COMMISSION TO REQUIRE REVISIONS TO THE
DESIGN AND /OR LOCATION OF A MONUMENT SIGN FOR THE QUALITY SUITES MOTEL
AT 1631 MONTEREY STREET (SA 3509)
WHEREAS, the Council of the City of San Luis Obispo considered the appeal of Acme
Wiley Corp. of a decision by the Architectural Review Commission to continue
consideration of a sign permit application with direction regarding required revisions
for the Quality Suites Motel at 1631 Monterey Street, and conducted a public hearing on
the matter; and
WHEREAS, the council considered actions taken on April 14, 1986, by the Architectural
Review Commission, by reviewing. staff reports, commission minutes, and recommendations;
and
WHEREAS, the council agrees that the decision of the Architectural Review Commission
to continue the sign application was the appropriate action.
NOW, THEREFORE, the council resolves to deny the appeal and uphold the Architectural
Review Commission's decision continuing the sign application for Quality Suites Motel at
1631 Monterey Street, and directs the appellant to revise the design and /or location as
directed by the commission, and to return to the commission for further review of the
application, with the following findings:
1. The design and location of the proposed sign are incompatible with the
architecture of the approved motel buildings.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO GRANTING APPROVAL OF TENTATIVE TRACT NO. 1380
LOCATED AT 2306 JOHNSON AVENUE
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Findings. That this council, after consideration of the tentative map of
Tract 1380 and the Planning Commission's recommendations, staff recommendations and
reports thereon, makes the following findings:
1. The design of the condominium and proposed improvements are consistent with the
general plan.
2. The site is physically suitable for the type and intensity of development allowed in
the O -PD zone.
3. The design of the condominium and the proposed improvements are not likely to cause
serious health problems, substantial environmental damage or substantially and
unavoidably injure fish or wildlife or their habitat.
4. The design of the subdivision or the type of improvement will not conflict with
easement for access through (or use of property within) the proposed subdivision.
5. The Community Development Director has determined that the proposed condominium has
been adequately evaluated by the initial study for the PD rezoning for which a
negative declaration was approved. `
Section 2. Conditions. That the approval of the tentative map for Tract 1380 be
subject to the following conditions:
1. Conditions 1 through 5, 10, 11, 13 and 17 of Ordinance No. 1031 (1981 Series) as
amended by City Council Resolution No. 5775 shall be conditions of the tract.
2. Subdivider shall dedicate a 10 -foot wide public utility easement and a 10 -foot wide
street tree easement along the entire Johnson Avenue frontage.
3. Subdivider shall dedicate vehicle access rights along the entire Johnson Avenue
frontage.
4. Subdivider shall dedicate easements for all on -site public water lines to the
approval of the City Engineer.
5. Subdivider shall reserve a blanket easement over the site for underground utilities
serving the site to the approval of the City Engineer and affected utility companies.
6. Final map shall show all areas subject to inundation during a 100 -year storm.
7. Subdivider shall pay water acreage fees as determined by the City Engineer. (No
frontage fees are required.)

8. Subdivider shall provide individual water services for each unit -. Meters shall be
clustered in accessible places to the approval of the City Engineer.
9. Subdivider shall provide individual gas and electric meters for each unit to the
approval of the affected utility companies and the City Engineer.
10. Covenants, conditions, and restrictions (CC &R'S) for the tract shall contain the
following provisions:
A. Property owners association shall be created to enforce the CC &R's and provide
for professional, perpetual maintenance for common areas including but not
limited to driveway, parking areas, landscaping, utilities, and building
exteriors.
B. Grant to the City of San Luis Obispo the right to maintain common areas if the
property owners association fails to do so and to assess said association for
expenses incurred.
C. All parking spaces provided in the project shall be available for use by all
of the individual owners.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ESTABLISHING PERMIT AND PLAN CHECKING FEES FOR WORK IN
WATERWAYS NOT COVERED BY GRADING OR OTHER PERMITS
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Pursuant to adoption of Ordinance No. 1061 (1986 Series) this
Council hereby establishes the following alternative fee schedule for work in
waterways where the regular fee structure in the grading, retaining wall or
subdivision ordinance is inappropriate:
A. Plan Check Fees
Work utilizing adopted city standards $15.00
Work not utilizing adopted city standards
and /or review of engineering calculations required $30.00
B. Permit Fee - Use subsection B of Section 4:28,.030
to determine fee
SECTION 2.. The fees set forth in this resolution shall become effective
upon the effective—date of Ordinance No. 1061 (1986 Series).

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO UPHOLDING PUBLIC WORKS DIRECTOR'S DISMISSAL OF
STAN MASER FROM HIS POSITION OF MAINTENANCE WORKER II
WHEREAS, on January 21, 1986, the City of San Luis Obispo's Streets
Manager, David Pierce, served Maintenance Worker II, Stan Maser
(hereinafter Appellant), with a document entitled "Preliminary Notice of
Proposed Disciplinary Action, and Right to Respond" constituting the
allegations of charges, reasons and supporting materials for the dismissal
of the Appellant as an employee of the City of San Luis Obispo; and
WHEREAS, Mr. Maser was provided a pre - disciplinary or "Skelly" hearing
on January 28, 1986, before the City's Public Works Director, Dave Romero,
and was represented by attorney Betty Saunders; and
WHEREAS, Appellant appealed the dismissal to the City Personnel Board
which commenced a closed hearing on the appeal on March 20, 1986, and
continued on March 22, 1986. Appellant was represented at the hearing by
attorney Robert Dimitrijevich and the City of San Luis Obispo being
represented by Assistant City Attorney Anne M. Russell; and
WHEREAS, the Personnel Board made certain findings and conclusions,
and based thereon, made a recommendation to the City Council that
Appellant's appeal be denied; and
WHEREAS, the City Council has.reviewed the findings and
recommendations of the Personnel Board (a written one -page document
attached hereto as Exhibit "A ") and has reviewed the record (testimony as
reflected in the official minutes and exhibits) of the Personnel Board
hearing; and
WHEREAS, on April 29, 1986, the City Council conducted deliberations
concerning the findings, conclusions, and recommendations of the Personnel
Board; and

WHEREAS, the City Council is in agreement with the recommendation of
the Personnel Board that the appeal be denied;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San
Luis Obispo as follows:
SECTION 1. Having reviewed the materials described hereinabove, the
Council hereby adopts as its own the three findings of the Personnel Board
as set out in Exhibit "A ".
SECTION 2. Based on the findings and conclusions set out above, the
Council hereby orders that the dismissal of the Appellant be upheld and
therefore denies Appellant's appeal.

.FINDINGS AND RECOMMENDATIONS IN THE
REMOVAL. OF STAN MASER
In accordance with the Charter and San Luis Obispo Municipal Code
Chapter 2.36, the Personnel Board met on March 20 and March 22, 1986, to
hear testimony, receive evidence, and deliberate concerning the City's
removal from employment (termination) of Stan Maser, Maintenance Worker
II. Anne Russell, Assistant City Attorney, presented the City's case.
Robert Dimitrijevich presented Mr. Maser's case. After careful
consideration of all relevant facts and circumstances in this matter, the
Personnel Board found, at its meeting of March 22nd, the following:.
1. By a preponderance of the evidence., the City substantiated the
charges that Mr. Maser (a) stole money belonging to the City from parking
meters on January 14, 1986: (b) had previously stolen money belonging to
the City from parking meters on other occasions, exact dates and amounts
uncertain; and (c) lied to police officers on January 14, 1986, who were
conducting a lawful investigation of the theft of money from parking
meters.
2. The City failed to establish by a preponderance of the evidence
that Mr. Maser failed to follow established procedures regarding the
handling of money from parking meters on January 14, 1986.
3. The removal of an employee from employment is a severe
disciplinary action which should not be imposed for "an occasional error
in judgment which occurs in good faith and is unintentional" (San Luis
Obispo Municipal Code Section 2.36.380). However, the theft of public
monies on one or more occasions and lying to law enforcement officers
constitutes conduct which is wrong, fraudulent and dishonest and justifies
removal. The City's action was appropriate..
The Board recommends on a 4 -1 vote (McReynolds dissenting) that the
removal be upheld.

RESOLUTION NO. 5951 (1986 SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ADJUSTING THE COMPENSATION RATE FOR COLLECTING, COUNTING AND DEPOSITING
PARKING METER REVENUE
WHEREAS, on February 15, 1983 the City of San Luis Obispo ( "CITY ")
entered into an agreement with Brink's, Incorporated ( "BRINK'S ") entitled
"AGREEMENT - COLLECTING, COUNTING AND DEPOSITING PARKING METER REVENUE"
( "AGREEMENT "); and
WHEREAS, part 3 of AGREEMENT allows for periodic adjustment of the
compensation rate based on changes in the consumer price index for all
urban consumers in the Los Angeles -Long Beach metropolitan area; and
WHEREAS, BRINK'S has requested a 12.5 percent increase in the
compensation rate, from 40 cents to 45 cents per meter; and
WHEREAS, between February 1983 and January 1986 the consumer price
index for all urban consumers in the Los Angeles -Long Beach metropolitan
area increased 13.9 percent, from 286.8 to 326.8;
NOW, THEREFORE
BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. To amend part 2 of AGREEMENT so that it reads:
"2. COMPENSATION
CITY shall pay BRINK'S 40 cents for each satisfactory collecting,
counting and depositing of money from a parking meter through
May 31, 1986.
CITY shall pay BRINK'S 45 cents for each satisfactory collecting,
counting and depositing of money from a parking meter on and after
June 1, 1986.
If actual meter collections performed in a calendar month amount to
fewer than 5,500, CITY shall nevertheless pay BRINK'S for a minimum
5,500 collections at the stipulated rate.
For each calendar month in which collections are performed, BRINK'S
shall submit to CITY an invoice showing actual collections performed
and collections billed. Within 30 days of receiving the invoice, CITY
shall pay BRINK'S the amount due."
SECTION 2. To direct the city clerk to furnish copies of this
resolution, as executed, to the finance director, the public works

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO GIVING NOTICE OF INTENT TO APPROVE AN AMEND-
MENT TO THE CONTRACT BETWEEN THE BOARD OF ADMINISTRA-
TION OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND
THE CITY OF SAN LUIS OBISPO
WHEREAS, The Public Employees' Retirement Law permits the partici-
pation of public agencies and their employees in the Public Employees'
Retirement System by the execution of a contract, and sets forth the
procedure by which said public agencies may elect to subject themselves
and their employees to amendments to said Law; and
WHEREAS, one of the steps in the procedure to amend this contract is
the adoption by the legislative body of the public agency of a resolution
giving notice of its intention to approve an amendment to said contract,
which resolution shall contain a summary of the change proposed in said
contract; and
WHEREAS, the following is a statement of the proposed change:
To provide 2% @ 50 Full formula (from 2% @ 55 full formula) and
Section 20461.6 (Reduction of Benefits), applicable to Section
20024.2 (One -Year Final Compensation), for local fire members
only.
NOW, THEREFORE BE IT RESOLVED that the governing body of the above
agency gives,and it does hereby give notice of intention to approve an
amendment to the contract between the said governing body and the Board of
Administration of the Public Employees' Retirement System, a copy of said
amendment being attached hereto, as "Exhibit A" and by this reference made
a part hereof.

AMENDMENT TO CONTRACT
BETWEEN THE
BOARD_ OF ADMINISTRATION
OF THE
EMPLOYEES' RETIREMENT SYSTEM
AND THE
CITY COUNCIL
OF THE
CITY OF SAN LUIS OBISPO
The Board of Administration, Public Employees' Retirement System, hereinafter
referred to as Board, and the governing body of above public agency, herein-
after referred to as Public Agency, having entered into a contract effective
July 1, 1952, and witnessed June 9, 1952, and as amended effective October 1,
1962, October 3, 1963, October. 1, 1974, June 1, 1976, December 1, 1976,
December 20, 1978, January 16, 1980, May 1, 1980, July 1, 1980 and July 1,
1983, which provides for participation of Public Agency in said System, Board
and Public Agency hereby agree as follows:
A. Paragraphs 1 through 10 are hereby stricken from said contract as executed
effective July 1, 1983, and hereby replaced by the following paragraphs
numbered 1 through 12 inclusive:
1. All words and terms used herein which are defined in the Public
Employees' Retirement Law shall have the meaning as defined therein
unless otherwise specifically provided. "Normal retirement age"
shall mean age 60 for local miscellaneous members, age 55 for local
police members, and age 50 for local fire members.
2. Public Agency shall.participate in the Public Employees' Retirement
System from and after July 1, 1952 making its employees as hereinafter
Provided, members of said System subject to all provisions of the
-- - Public Employees' Retirement Law except such as .apply only on election
of a contracting agency and are not provided for herein and to all
amendments to said Law hereafter enacted except those, which by express
provisions thereof., apply only on the election of a contracting agency.
3. Employees of Public Agency in the following classes shall become
members of said Retirement System except such in each such class as
are excluded by law or this agreement:
a. Local Fire Fighters (herein referred to as local safety members);
b. Local Police Officers (herein referred to as local safety
members);
C. Employees other than local safety members (herein referred to as
local miscellaneous members).

4. In addition to the classes of employees excluded from membership by
said Retirement Law, the following classes of employees shall not
become members of said Retirement System:
a. CROSSING GUARDS.
5. The fraction of final compensation to be provided for each year of
credited prior and current service as a local miscellaneous member
shall be determined in accordance with Section 21251.13 of said
Retirement Law (2% at age 60 Full).
6. The fraction oi .in;_ compensation to be provide(i for a ch year of
credited prior and current service for those local police members who
did not elect within 90 days of January 1, 1983 to continue under the
provisions of Section 21252.1 shall be determined in accordance with
Section 21252.6 of said Retirement Law (2% at age 55 Full).
7. The fraction of final compensation to be provided for each year of
credited prior and current service as a local fire member shall be
determined in accordance with Section 21252.01 of said Retirement Law
0% at age 50 Full). '
8. The following additional provisions of the Public Employees'
Retirement Lau, which apply only upon election of a contracting
agency, shall apply to the Public Agency and its employees:
a. Sections 21380 - 21387 (1959 Survivor Program) excluding
Section 213;2.2 (Increased 19`9 Survivor Benefits) and
Section 21382.4 (Third Level of 1959 Survivor Benefits).
b. Sections 21263, 21263.1 and 21263.3 (Post- Retirement Survivor
Allowance), for local safety members only.
C. Section 20862.8 (Unused Sick Leave. Credit).
- d: Section 20024.2 (One -Year Final Compensation) for -- local miscel-
laneous and local police members, and for those local fire
members hired prior to the effective date of this amendment to
contract.
e. Section 20461.6 (Reduction of'Benefits), applied to Section
20024.2 for local fire members hired on or after the effective
date of this amendment to contract.
9. Public Agency, in accordance with Government Code Section 20740,
ceased to be an "employer" for purposes of Section 20759 effective on
June 1, 1976. Accumulated contributions of Public Agency shall be
fixed and determined as provided in Government Code Section 20759, and
accumulated contributions thereafter shall be held by the Board as
provided in Government Code Section 20759.

10. Public Agency shall contribute to said Retirement System as follows:
a. With respect to local miscellaneous members, the agency shall
contribute the following percentages of salaries earned.as
members of said. Retirement System:.
(1) 9.438 percent until June 30, 2000 on account of the lia-
bility for current service benefits. (Subject to annual
change.)
(2) 0.095 percent until June 30, 2000 on account of the lia-
bility for the 1959 Survivor Program. (Subject to annual
change.)
b. With respect to local safety members, the agency shall contribute
the following percentages of salaries earned as members of said
Retirement System:
(1) 22.941 percent until June 30, 2000 on account of the lia-
bility for current service benefits. (Subject to annual
change.)
C. A reasonable amount, as fixed by the Board, payable in one in-
stallment within 60 days of date of contract to cover the costs
of administering said System as it affects the employees of
Public Agency, not including the costs of special valuations or
of the periodic investigation and valuations required by law.
d.- A reasonable amount, as fixed by the Board, payable in one in-
stallment as the occasions arise, to cover the costs of special
valuations on account of employees of Public Agency, and costs of
the periodic investigation and valuations required by law.
11. Contributions required of Public Agency and its employees shall be
subject to adjustment by Board on account of amendments to the Public
Employees' Retirement Law, and on account of the-experience under the
Retirement System as determined by the periodic investigation and
valuation required by said Retirement Law.
12. Contributions required of Public Agency and its employees shall be
Paid by Public Agency to the Retirement System within thirty days
after the end of the period to which said contributions refer or as
may be prescribed by Board regulation. If more or less than the
correct amount of contributions is paid for any period, proper
adjustment shall be made in connection with subsequent remittances.
Adjustments on account of errors in contributions required of any
employee may be made by direct payments between the employee and the
Board.
B. This amendment sha•ll.be effective on the day of
