HomeMy WebLinkAboutR-5963 - Adopting Property Management ManualRESOLUTION NO. 5963 (1986 Series) RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO ADOPTING THE PROPERTY MANAGEMENT MANUAL WHEREAS, the 1985 -87 Financial Plan states that the city should "develop a coordinated management system for city -owned property "; and WHEREAS, it is the objective of the city to establish a property management program that maximizes the productive use of city real property assets. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: 1. The property management manual (attached as Exhibit A) is hereby adopted. 2. Procedures for amending the Property Management Manual shall be as specified in Section B7 of the manual. BACKGRQ�JND: IhIs consent item was continued from the May 6, 1986 Council Meeting. The draft Property Management Manual contains both policies and procedures. Section B7 establishes the following amendment procedures: 1. The CAO reviews all proposed amendments .and determines if the change effects policy or procedure. 2. Proposals to change policy are acted on by the council while procedural changes are acted on by the CAO. Councilman Griffin feels that the manual should specify the sections that include. management polices and those that. include procedures, legal restatements, or information: The council would only be involved in amendments to sections that include management policies. SUGGESTED AMENDMENTS Section B7 can be amended to identify the sections of the manual that contain management policy. The .amended section is attached as Exhibit "A." The resolution can be amended to reference section B7 of the manual as establishing amendment procedures. An amended resolution is attached as Exhibit "B." INTRODUCTION 1. PURPOSE The purpose of property management is to coordinate all matters of real estate management, valuation, acquisition, disposition, and title that involve city -owned or controlled properties. These policies and procedures will guide all property management activities and should be used by city departments that have property management responsibilities. PROGRAM DESIGN AND MAINTENANCE ' 1. ROLES AND RESPONSIBILITIES The responsibility for managing city property is divided among nine departments. Four departments hold a lead role while five hold a staff role. Lead Departments Lead Departments are responsible for scheduling all actions needed to process a property transaction to ensure its timely completion. They must secure authorization to proceed from Administration and schedule the participation of Staff Departments. Lead Departments include: Fire Police Public Works Recreation Lead Departments are assigned set of parcels to manage (see the Appendix). The City Council, staff, or the public should contact the Lead Department about information or activities affecting a specific parcel. 1 Lead Department responsibilities include:. Coordinating all transactions related to their assigned parcels. Coordinating activities with Staff Departments. Handling public inquiries. Assigning a property activity manager. Maintaining the department's filing system. Forwarding information to the Clerk's central filing system. Providing property maintenance and inspection. Insuring compliance with licenses, permits or leases. Staff Departments. Staff departments provide advice and technical services to Lead Departments by completing specific components of a property transaction. Staff departments include: Administration_ City Attorney City Clerk Community Development Finance Staff Departments provide the following services: Program coordination: Administration Policy direction: Administration Parcel assignments: Administration Negotiations support and document review- City .Attorney Advertising: City Clerk Central Fite maintenance: City Clerk General Plan con"sistency Community Development Environmental impact analysis: Community Development Financial impacts: Finance. Collection of lease fees: Finance Data Base Maintenance: Finance The -Real Property Consultation Committee In April of each year, the Real Property Consultation Committee will evaluate the system's performance and identify alterations. Between committee meetings Administration will coordinate the program. Committee membership includes: City Administrator Assistant City Attorney City Clerk Recreation Director Supervising Principal Planner (Community Development) Administrative Assistant (Community Development) Administrative Analyst (Public Works) 2 1 2. PROPERTY ACTIVITY MANAGER The director of each Lead Department should assign a Property Activity Manager. The Activity Manager should handle all of the department's property transactions. However, if workload becomes a problem, other department staff may be assigned specific projects. 1 3. THE PROPERTY PROPOSAL.FORM The property proposal form (see Appendix, page. 119) will. be used as the 1 routing and status sheet for each property transaction. As,Staff Departments are consulted or as requirements are met, actions and comments are noted on the form and all pertinent information attached. The final action is also noted. 4. PROPERTY MAINTENANCE AND INSPECTION 3 Lead Departments will inspect all assigned parcels to ensure upkeep and 1 maintenance. A specific inspection schedule will be stored in the data bank. The schedule will be periodically published to remind each Lead 1 Department when inspections are due. All properties that are not on a regular maintenance schedule and covered by a department's operating budget will be inspected ak least once a Year. 5. PROPERTY MANAGEMENT Property management responsibilities are divided between Lead and Staff Departments and Administration. Tables #1-#5 (see pages 11-20) show the division of labor. In general, the Lead Department is responsible for initiating an activity or responding to public inquiries, securing Administrative authorization to proceed, handling the review process, securing City Council authorization, and ensuring on-going contract compliance. ' The City Attorney helps the Lead Department with negotiations, drafts all required legal documents, manages escrow closing and other related technical duties. 6. FILING SYSTEMS ' The property management filing_ system has two components: the standard file and the computerized data bank. The standard file includes all "paper" property records and. correspondence. It is divided in two sections: (1) a central file maintained by the City Clerk, and (2) a 1 departmental file maintained by each Lead Department. The data bank is a computer listing of pertinent information for all parcels and is maintained by the Finance Department as part of the Fixed Asset Management Program. Data entry, maintenance and access procedures are outlined in the Appendix (see Table #7, page 23). 3 i 7. The following sections include property management policies and objectives: Sections A=1, A-2 B-7 C-1, C-5 D-1 E-2 (First Sentence) 4 1 C. SALE OR LEASE OF PROPERTY__ 1. GENERAL GUIDELINES In addition to other provisions in this manual, the following principles 1 guide the sale, trade or lease of city -owned property: The City Council must declare property surplus before it can be sold. Lead Departments should identify potentially surplus properties and prepare recommendations for council action. ' Requests for the sale or lease of city property may originate from any city department, the City Council or from interested members of the public. tAll public inquiries for purchasing or leasing property must be submitted in writing to the Lead Department. Private use of city property is not permitted without a written agreement approved by the City Council. 1 The City Attorney must be contacted before processing the disposal of parks or streets and should be consulted on any other transactions where questions arise. The City Council must approve all final sale, trade or lease agreements. 2. LEGAL REQUIREMENTS Lead Departments should. contact the City Attorney when there are questions ' about the application of these provisions: Deed Conditions: Compliance with all restrictions outlined in the deed is usually required: Funds of Original Purchase: Compliance with all use conditions required by the original funding source is usually required. Article IX, Section 906, City Charter. All sales, trades or leases must be approved by the City Council. Council Resolution: Prior to approval of sale, the City Council must approve a resolution that declares the property surplus. Government Code Sec 65402: All sales should be reviewed by the Planning Commission to determine compliance with the General Plan. Government Code Sec 54220: Before a sale or lease is awarded, city -owned property must be offered to (1) Housing Authorities, (2) Parks, recreation and open space areas, (3) Enterprise Zones, (4) ' Schools. An offer from these entities need only be accepted if the terms are acceptable to the city. 5 3 4. 5. Abandonment of Parks or Streets: Special requirements must be met. Contact the City Attorney. ALE AND LEASE PROCEDURES Procedures to be followed by Lead and Staff Departments are outlined in Tables #1 and #22 (see pages 11 and 14) in the Appendix,. To verify specific procedures and legal requirements, departments should contact the City Attorney as soon as the decision has been made to sell or lease the property. METHODS QF DISPOSAL The sale or lease of city property will be conducted through a Request for Proposal (RFP), Competitive Bid, or Auction process. At the time that the sale or lease is initiated, the City Administrator will determine which procedure will be followed. (As part of the RFP process, the Administrator may choose to use a broker, consistent with purchasing manual procedures; to conduct the proceedings.) When the city is interested. in the future use or disposition of property it. is selling or leasing, the RFP option may be appropriate. It offers the city a way of negotiating various types of performance from the buyer or lessee. The formal bid procedure applies to the sale of property while the auction procedure applies to the lease of property. Specific procedures are outlined in Tables #3 - #5 in the Appendix (see pages 17-20). DISPOSAL QF RIGHT-OF-WAY The city will respond to public requests for the disposal of right-of-way. Right-of-way will be abandoned only when it has no apparent current or future use. The following principles guide the disposal of right-of-way:. The city will only abandon right-of-way which is held as an easement. Right-of-way that has been a purchased in fee will be sold at market value. Easements that have been purchased with city funds wi11 also be sold at market value. Easements used for utility transmission and distribution systems will normally be reserved. If the utility previously using the easement. declines further use; the city will offer it to other utilities before abandonment. The city may reserve an easement for its water and sewer system or may reserve a blanket easement for all utilities. The city will not guarantee the title of right-of-way it abandons. 2 I 1 1 1 1 1 1 1 1 1 1 1 1 I 1 D. ACOUISITION QF PROPERTY 1. GENERAL GUIDELINES The following principles guide the city's acquisition of real property: Any department or the City Council may request the acquisition of real property. These requests should normally be part of the department's capital budget proposals., Acquisition proposals should be consistent with adopted plans and policies including the Capital Improvement Program. The City Council must authorize negotiations and approve the purchase of any real property. Negotiations for the acquisition of property should be authorized only after an intended public use or purpose has been established. When an intended use has-been identified, the environmental review process should be completed before negotiations are authorized. 2. ACQUISITION PROCEDURES Acquisition procedures are outlined on Table #6 (see page 21) in. the Appendix. For more details, departments should contact the City Attorney's Office. 7 E. FUTURE.USE STRATEGIES 2. USE CATEGORIES Each city -owned parcel is included in one of the following five use categories: Category # 1. Long -Term Use: the parcel is being used for facilities that support a long-term public program. ' 2. Interim Use/Targeted: the parcel is being used but the use will change io a long-term public use. 3. Unused/Targeted: the parcel is not being used but will be used for a long-term public use. 4. Recommended Surplus: the parcel has no current or future public use as determined by the Lead Department. 5. Right-of-way (fee title or easements): properties used for public activities such as streets, utilities, storm drains, and flood control projects. FUTURE MANAGEMENT STRATEGY All Lead Departments will aggressively pursue the full use of under -used properties and the disposal of surplus properties. Survlus Properties In January of every year, each Lead Department will ,prepare and submit a list of recommended surplus properties to the City Administrator. The Administrator and the Lead Department will decide to: (a) Take no action. (b) Request that the City Council declare all or some of the properties surplus and proceed with disposal. (c) Create the listing of recommended' surplus properties and proceed With council action and disposal throughout the year. Under -Used Properties In January of every year, each Lead Department will prepare a list of under -used properties and determine whether expanded use is warranted. Proposals for intensifying uses will be sent to the City Administrator for consideration. The city may reject any or all of the bids and may waive any informality or irregularity in the bids. 18 I I I I 1 19 TABLE #4 CONTINUED 2. The city council must approve any sale negotiated. 3. The successful bidder shall take possession only after the grant deed from the city has been recorded. 4. The right, title and interest in the property sold shall not exceed that vested_ in the city, and the sale is subject to title exceptions and reservations of record including but not necessarily limited to those specified elsewhere in the offering. No policy of title insurance will be furnished by the city in this transaction. The successful bidder may obtain title insurance at his own expense.. 5. No warranty is made by the city for the ground locations of property lines. The successful bidder may conduct an independent survey at his expense. 6. The successful bidder shall pay all recording fees, documentary transfer taxes, or other real estate transaction taxes or fees, including escrow fees, broker's ' commissions and personal property sales taxes. 7. The city does not. guarantee the condition of the property nor does it assume any responsibility for conformance to codes or permit regulations. The successful bidder is responsible for determining all building, planning and zoning regulations governing this property and its proposed uses. Plan states that the city should "develop a coordinated management system for city -owned property"; and WHEREAS, it is the objective of the city to establish a. property management program that maximizes the productive use of city real property assets. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: 1. The property management manual (attached as Exhibit A) is hereby adopted. 2.
