Applications
Attached is a resolution for the City Council’sconsiderationnecessaryfor the applicationfor the
Infrastructure Infill GrantProgram. A signed Resolution is required for this grant application.
This grant application is intended to supportthe Prado Interchange Project’sconstruction cost.
Unlikemore commontransportation infrastructuregrants, this grant allows the Cityto partnerwith
projects thatprovide housingto reduce the fiscal impact of construction of necessary backbone
infrastructure.In this case, the grant application has been developed in partnership withthe San
Luis Ranch LLCwhowill be co-applicant.Dueto the numberof planned residential unitsin the
San Luis Ranchdevelopment,partnershipwith San Luis Ranch LLCallows for the Prado
InterchangeProject to be consideredfor funding by the Infrastructure InfillGrant Program.If
successful, this grant could provide up to $7.5Mto support the Prado Interchange Project.

6.Adopt a Resolution (Attachment D) authorizing the Cityand San Luis Ranch to apply
for the Infrastructure InfillGrantfor an estimated value up to $7.5M to supportthe
Prado Interchange Project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS
OBISPO, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR
THEIR DESIGNEE TOFILE, EXECUTE ANDFULFILL ANY RELATED
INFILL INFRASTRUCTURE GRANT PROGRAMAPPLICATIONS,
CERTIFICATIONS, ASSURANCES, FORMS, AGREEMENTS, AND
ASSOCIATED DOCUMENTS ON BEHALF OF THE CITY
WHEREAS, the State of California Department of Housing and Community Development
(the “HCD”) has issued a Notice of Funding Availability (“NOFA”) for Infill Infrastructure Grant
Program (“IIG”)established under Assembly Bill 101 (Chapter 159, Statutes of 2019) and Part
12.5 (commencing with section 53559) of Division 31 of the Health and Safety Code, which
authorizes the HCDto approve funding allocations utilizing monies made available by the State
Legislature, subject to the terms and conditions of the statute and the IIG Guidelines implemented
October 30, 2019; and
WHEREAS,the City of San Luis Obispo (“City”or “Lead Applicant”) desiresto apply
for IIG Grant Program funds and submit an application packagereleased by the HCD for the IIG
Grant Program; and
WHEREAS,Citywishesto receive fundingto assist with construction costs for the Prado
Road Interchange Project(“Project”);and
WHEREAS,City will serve as Lead Applicant of the IIG Grant Program and has requested
that San Luis Ranch LLC (“SLR”) to be identified in the IIG Grant Program Applicationas a
“ParticipatingEntity” in part as required through the NOFA; and
WHEREAS, the Project is currently in the Project Approval and Environmental Document
preparationphasein compliance with State Department of Transportation requirementsand is
subject to the California Environmental Quality Act (CEQA)and nopermits or approval of
construction has been authorized.
NOW, THEREFORE, IT IS RESOLVEDbythe Council of the City of San Luis Obispo
asfollows:
SECTION 1.IIG Program Participation.The City Council hereby authorizes the City to
be designated as a Lead Applicantin the IIG GrantProgram Applicationand authorizesCity
Managerto apply for and submit to the HCDthe IIG Grant Program Application, as detailed in
the NOFA, in an amount not to exceed $7,500,000,to fundconstruction of the Project.
SECTION 2.Execution of Documents. The Council hereby authorizes the City Manager
or their designeestoexecute, aInfill Infrastructure Grant Program DisbursementAgreement
(“Agreement”), and any and all other documents required or deemed necessary or appropriate to
carry into effect the full intent and purpose of the above resolution, in order to evidence the IIG
Grant, the City’sobligations related thereto, and the HCD’ssecurity therefore; including, but not
limited to, an affordable housing covenant, a performance deed of trust, a disbursement agreement,

and certain other documents required by the HCDas security for, evidence of,or pertaining to the
IIG Grant, and all amendments thereto (collectively, the "IIG Grant Documents").
SECTION 3.Eligible Activities. If the application for the IIG Grant Program is approved
for fundingtothe Project, the City hereby agrees to expend the IIG Grant Program funds for
eligible activities in the manner agreed upon in the Agreement, also presented in the IIG Grant
Program Applicationas approved by the HCDand in accordance with IIG Guidelinesas cited
above.
SECTION 4.Environmental Determination. No environmental review is required for
grant submittals, per section 15061(b)(3) General Rule of the CEQA Guidelines. It can be seen
with certainty that the proposed action ofthe City to apply for grant funding will have no
significant effect on the environment. A separate environmental document is being prepared for
the Project and Caltransis the lead agencyand will be reviewed and certified by both Caltransand
the City of San Luis Obispo prior to construction.The Project was also reviewed and discussed
as part of the Final Environmental Impact Report for the San Luis Ranch Project.
