Dear members of the city council ,
We would like to impress upon you the immense impact the banning of not only e cigarette
flavors but mainly flavored tobacco would have on The Club Inc. its employees and potentially
our city. The Club smoke shop would have close to an estimated two hundred thousand yearly
loss of revenue with close to three thousand being in sales tax revenue . Such an enormous
loss would create a hardship for not only my store but the other stores in the community as
well. Thus creating a hardship for its employees (our citizens) and in turn our city. Also this will
inevitably put us out of business.
1
The club smoke shop has always abides by all laws and regulations, and has never been
cited for any violations. We have even been recognized by the county for abiding by these
laws. This recognition happened to be for the refusal of the sale to a minor. One of my fears
for the banning of e cigarettes and tobacco flavors is that the loss of sales for our community
will not decrease its consumers population, but only end up translating to online sales. Not
just legal online sales but illegal as well. A lot of these sales are also likely to be counterfeit and
could also be harmful. It is the FDAs job to restrict flavors based on the science that it would
be good for public health. It is also the FDAs job to make sure that same ban won’t lead to
black market’s that causes more overall harm than good.
The FDA’s states “The enforcement policy were issuing today confirms our commitment
to dramatically limit CHILDREN'S access to certain flavored e-cigarette products we know are
so appealing to them so called cartridge-based products that are both easy to use and easily
concealable”. They furthermore go on to state that “We believe this policy balances the
urgency with which we must address the public health threat of youth use of e-cigarette
products with the potential role that e-cigarettes may play in helping adult smokers
transition completely away from combustible tobacco to a potentially less risky form of
nicotine delivery. While we expect that responsible members of industry will comply with
the premarket requirements, were ready to take action against any unauthorized e-cigarette
products as outlined in our priorities. We will also closely monitor the use rates of all
cigarette products and take additional steps to address youth use as necessary”. ALL WERE
ASKIG IS follow the FDA REGULATION.
We would like to purpose suggestions to prevent sales to minors. Such as a training course
required for all smoke shop employees, and a ban of vape advertising on store fronts. We
could keep the sale and distribution of e cig flavors and flavored tobacco products limited to
only licensed smoke shops. This would allow the city to have more control and vigilance of the
demographics of its users and the products being consumed. Together we could implement
new ideas other than a ban that will have a tremendous negative effect on so many lives and
hardworking people in the community.
As a store owner and a proud member of this community it is of up most importance for
me to inform you of all the negative and potentially harmful affects this decision could have on
all of us as a whole. I hope that I conveyed a small portion of this in my letter. And I would like
to sincerely thank you for your time and consideration in this matter.
Sincerely,
Fadi Mahmoud president of The Club Inc.
