Minutes of the Tree Committee meeting of December 10, 2019 PUBLIC COMMENT: At this time, people may address the Committee about items not on the agenda. Persons wishing to speak should come forward and state their name and address. Comments are limited to three minutes per person. Items raised at this time are generally referred to staff and, if action by the Committee is necessary, may be scheduled for a future meeting. ROLL CALL Present: Committee Members Elizabeth Lucas, Sean O'Brien, Allen Root, Rodney Thurman, Vice Chair Jane Worthy, Chair Scott Loosley Absent: Committee Member Alan Bate Staff: Matt Horn, Deputy Director Public Works, Charles Bell, Assistant City Attorney City Arborist Ron Combs and Teresa Purrington, City Clerk BUSINESS ITEMS 1. Review of Tree Committee Bylaws Teresa Purrington, City Clerk provided a review of the Tree Committee bylaws and responded to Committee inquiries. Public Comment None. --End of Public Comment -- ACTION: By consensus the Committee made the following recommended changes to the bylaws: ARTICLE 2. COMMITTEE MEMBERSHIP The Tree Committee shall have seven members and shall consist of the Pa -lEs and Re e tion r,,.,,,, issien, one representative from the Architectural Review Commission, and sixmembers from the general public (one two of whom shall be a horticultural expert, if possible). Members must be residents and registered voters of the City. ARTICLE 4. MEETINGS DRAFT Minutes — Tree committee Meeting of December 5, 2019 Page 1 1. The Committee will hold a regular meeting each month. 2. Regular meetings will be held at -5-A95:30 pm the fourth Monday of each month. 4. A quorum will consist of four tluee voting Committee members. 7. The Chairperson or any four three members of the Committee may call a special meeting provided that a week's prior notice is given in writing to each member and the meeting is otherwise properly noticed pursuant to the Brown Act. 2. Review of Tree Ordinance Revisions Matt Horn, Deputy Director for Public Works provided a presentation on the revised Tree Ordinance and responded to Committee inquiries. Charles Bell, Assistant City Attorney provided a presentation on purview and legal requirements and responded to Committee inquires. Consideration of Minutes of the Tree Committee Meeting of September 23, 2019: ACTION: UPON MOTION BY CHAIR LOOSLEY, SECONDED BY COMMITTEE MEMBER O'BRIEN, CARRIED 4 — 0 - 3, (Committee Members Alan Bate, Elizabeth Lucas, and Rodney Thurman absent) the Tree Committee approved the Minutes of the Tree Committee Meeting of September 23, 2019, as presented. Foothill Blvd. City Arborist Combs provided a presentation and responded to Committee inquiries. Joseph Rutherford, Applicant or applicant representatives provided a brief overview of the tree removal project. Public Comment None --End of Public Comment -- ACTION: By consensus the Committee continued the item for the next meeting to allow the Applicant's representative to provide more information. 4. 1594 Cucaracha Ct. Committee Member indicated he would need to recuse himself due to living within 500 feet of the property. ACTION: Item continued due to lack of a quorum. 5. 883 Murray Ave. City Arborist Combs provided a presentation and responded to Committee inquiries. Lori Allen, Applicant provided a brief overview of the tree removal project. Ron Rinell, Bunyon Bros. applicant representatives provided a brief overview of the tree removal project. John Duvall, applicant representatives provided a brief overview of the tree removal project. Public Comment John Hanlin --End of Public Comment -- ACTION: UPON MOTION BY CHAIR LOOSLEY SECONDED BY COMMITTEE MEMBER ROOT, CARRIED 4 — 0 - 3, (Committee Members Alan Bate, Elizabeth Lucas, and Rodney Thurman absent) that the City require remediation from the property owner for inappropriate pruning of the tree and either a fine or a requirement for replanting of trees on the property.
