RE: ADU Ordinance 1629 (Second Reading)
Mayor and Council-
This letter is a request to pull Item 14 (ADU second reading) from the consent items to make a couple of minor
changes. I will outline the minor changes below and am available to clarify further by email or phone if desired.
Height exception-
At the first reading of the ordinance, there was a late change that allowed units over a garage to extend to 25’
high at a 4’ setback. There appeared to be some trepidation about the 25’ as too high but this remained as
council direction to staff.
Should you feel that 25’ is appropriate, this section is fine as written and allows the designer to work under that
height maximum with great flexibility. Should you have concern as I do that 25’ is a bit too tall that close to the
property line, I would recommend you lower the height maximum to 22’ which allows for a full two-story solution
but may prevent overly tall edge conditions. It is a minor point but a 10% reduction to the proposal is still
workable for almost all conditions and may reduce some neighborhood angst.
Emergency Ordinance-
As described by Architect Ridley at the first reading, this ordinance was introduced as an emergency ordinance
to close a loophole in the current zoning ordinance, yet the word emergency nor is the imperative not listed in
the discussion. I point this out so that we remember these revisions as a patch to the ordinance, not a fully
vetted review of the section. There are still some logic flaws in the revised ordinance that don’t make sense
(Guesthouse requiring Architectural Review, for example).
I encourage council to make note that this ordinance is passed as an interim measure and that further study,
public input, and council direction is needed to strengthen and clarify the ordinance.
