RESOLUTION OF THE CITY OF SAN LUIS OBISPO OPPOSING PROPOSITION 16THE "NEW TWO-THIRDS VOTE REQUIREMENT FOR PUBLIC ELECTRICITY PROVIDERS " INITIATIV E 1S t Whereas : Delete "has qualified for" and replace with "appears as Proposition 16 on " WHEREAS,the "New Two-Thirds Vote Requirement for Public Electricity Providers " Initiative ("Initiative") has qualified for appears as Proposition 16 on the June 8, 2010 Statewid e Primary Election ; 3rd Wherea s Delete utilitysystem expansion ; and RECEIVE D MAY 18 2010 SLO CITY CLERK Memorandum to Council Page 2 4 th Whereas : Delet e citizens from determining whether theywant tohave publicpower inany newly annexed areas ; aid 5 thWhereas : Move up to 3 rd Whereas, in view of the greater importance to SLO of the CCA issues (v . public power entities) 6thWhereas : Delete communities throughout thestate ; and 7 th Whereas : Delete the City's electric utilityoperations within the City'sexisting jurisdiction, includingpotentiall y requiring a 2/3voter majority before the Citycan make investments intransmission o r generation facilities toserve itselectric load ; and Section 1 : Insert "Proposition 16" in place of "the Initiative " SECTION 1 .The Council by adopting this resolution does hereby oppose the Initiativ e Proposition 16 on the June 2010 ballot .
