The recommendation was submitted to Kim Murry last week with the comment that i t had not yet received board approval and was therefore a committee recommendation tha t would be reviewed by the Board . The purpose of this memo is to provide documentatio n of that subsequent action by the Board today . The memo is attached to this document . Thank you for your consideration of the Downtown Association's concerns and for you r efforts in establishing preservation measures for our city's historic properties . The consensus of the committee was that the changes included in the ordinance ar e acceptable and likely to achieve a high level of community acceptance . There are two recommendations the committee would like to submit for the Council's consideration, although at this point in time, these recommendations have not bee n reviewed nor approved by the Board of Directors which meets next on November 9 . R C F \/f L ..) NOV 0 9 2M10 SLO CITY CLERK However, the committee feels confident that the recommendations warrant consideratio n and will be asking for board support at that time . These are : (Page 26) Section D . Violation — Penalty .Every property owner and/o r responsible party, as defined in this chapter who violates provisions of this chapter i s subject to penalty as set forth in chapter 1 .12 or administrative enforcement as set fort h under chapter 1 .24 of this code . Comment: While it seems the intent of the modification to the formerly presente d ordinance is to eliminate the monetary penalty section of the ordinance associated wit h the demolition of historic resources, the language in this section does continue t o reference penalties and it is not clear whether they remain or not . The committee feels this section should clearly spell out what violations are being referenced and if penaltie s are actually eliminated or if they are just shifted to another section . (Page 9) 46 . Responsible party :any person, business, corporation or entity , and the parent or legal guardian of any person under the age of eighteen (18) years, wh o has committed, permitted, directed or controlled any act constituting a violation of thi s ordinance . Comment : A responsible party should designate only someone who has ownership o r control of the property . This is not clearly spelled out and could seemingly be applied to someone who is working on a property at the direction of a property owner but wh o should not be held liable for violating the ordinance if following the direction of th e owner. Thank you for considering these comments for next Tuesday's night public hearing . After the SLO Downtown Board of Directors meets on Tuesday, I will provide additiona l information regarding board support of these comments .
