O n behalf of my client I am asking that consideration of this matter be postponed so that m y client and the hundreds of other similarly situated homeowners will have more time t o analyze it and provide input thereon . As you are aware from previous communications from representatives of th e committee, the city failed to get early and meaningful input from the residents befor e writing the document and then failed to follow its own General Plan requiring the cit y to hold meetings in the neighborhoods . Further, there were problems with the post car d notifications in that the information on the cards themselves was inadequate . In fact, th e main body of one of the postcards stated : "The Cultural Heritage Committee will conduc t a hearing to consider an application near your property or residence ." Obviously this di d not notify recipients that new laws were being formulated that could have long ter m negative impacts associated with them . It was also pointed out by city staff that postcard s were not mailed for every meeting because public hearing items are typically continue d from one meeting to subsequent meetings . Without getting too much into the history of what has and has not taken plac e with regards to making the neighborhoods aware of what was in the works, the reality i s that many homeowners are just now becoming aware of the specifics of the propose d ordinance and guidelines and many have some real concerns and questions about them . Further, the staff report for this coming Tuesday's hearing on the proposed ordinance an d guidelines just came out this week and is over two hundred and seventy pages long . The document is not only full of changes to the previously proposed ordinance and guidelines , but also full of legal jargon which makes it complicated for many of the homeowners t o understand without further clarification from staff As I'm sure you will agree, goo d legislation takes time and tries to address the concerns of all who will be affected . The Council's proposed hearing schedule will not accomplish this goal and will, effectively , shut out the effort of homeowners to have meaningful input into laws that will affec t them for years to come . I therefore request that the upcoming November 9, 2010, City Council meeting o n this issue be rescheduled to allow sufficient time for meaningful input from the histori c residential neighborhoods . cc : Babak Nafic y Peg Pinard
