It would be very unfair to appoint anyone but Dan Carpenter to the Council's
vacant seat .
Dan Carpenter campaigned for the Council seat, spent his own money, mad e
himself available for meetings, etc ., whereas Mrs . Andreen did not .If sh e
wishes to be elected to the Council then she should have placed her name on th e
ballot .
Do the right thing on Tuesday evening and make sure Dan Carpenter get s
recognition for coming in third in the election .

To the S .L .O . City Council :
It has come to my attention (http ://slovoice .org/)that because council member Jan Marx
has run for and been elected Mayor that her former council seat is now open and will b e
filled by a vote of the other council members instead a vote of the citizens of San Luis
Obispo . Is this not an affront to democracy ?
Given this undemocratic situation the only fair and just course of action for the council i s
to appoint the candidate with the next highest votes in the last election, Dan Carpenter .

City Staff and Council :
I am writing this as a preliminary "heads up" to what I perceive may become problems
Tuesday night . Unlike the indisputable results of an ELECTION, appointments open u p
potential pitfalls that may become subject to later dispute .
I have not yet had opportunity to review the Dec . 1 council meeting video (no minute s
are available yet), however I have noticed potential irregularities :
(1)Councilman Ashbaugh, on Dec . 1, voiced concerns over some sort of votin g
ambiguity that might occur which I am unable to recall without reviewing the video . Hi s
concern was not addressed as the meeting was rushed to adjournment .
(2)A Dec . 16 memo (via Katie Lichtig) alters the process outlined by the City Clerk's
staff report .
(3)I spoke with city staff last week who were unable to convey a concrete picture of ho w
the process will occur when pressed for specific details . The Clerk's staff report details a
"ranked" voting procedure which is completely contrary to the procedure outlined o n
page 1 of the staff report in the Dec . 16 memo .
(4)There appear to be numerous possible ambiguous circumstances that are unaddresse d
by the procedure published . If one of these pitfalls occurs, I see no legitimate means t o
resolving circumstances not already addressed in the Dec . 1 procedure .
(5)Even matters as simple as the order in which applicants speak may become subject t o
Iater "fairness" complaints .
I am highly concerned that if dispute or disparity occurs not addressed by publishe d
procedure--or, is resolved via a "seat-of-the-pants" action by the council--the ensurin g
appointment could be vulnerable to quo warranto via the State Attorney General . Short
of that, certain public disparagement of the process and voter disenfranchisement wil l
ensue .
I strongly encourage staff and Council to scrutinize the process before tomorrow's
hearing to ensure ambiguities are identified . However, it may be too late for correction s
as the Dec . 1 procedure was already voted upon . In any case, let's make sure everyon e
has the same understanding of the process before it begins .
Alternatively, the Council could choose not to appoint and defer to an ELECTION of the
People--which is indisputable .

Dear council members ,
I would like to lend my support for the appointment of Dan Carpenter to th e
open city council seat during your meeting tomorrow .
As he actively campaigned for the position during the last election AND took th e
3rd highest number of votes from the residents, it stands to reason he shoul d
be awarded the seat recently vacated by Ms . Marx . The reasoning of course i s
that had the seat been open prior to Ms . Marx running for office, he would hav e
won it outright .
Any other decision would appear unfair, smack of favoritism and most certainl y
result in negative press possibly even at the national level . Now is NOT the tim e
to engender additional distrust of government or further sully the impression o f
California's leadership in the eyes of the country by appearing biased and votin g
against the intention of the residents .
Again, had the seat been vacated, he would have been fairly VOTED in to cit y
council . Do the right thing and appoint him in your next meeting .

It was just confirmed to me by Chris Judge (City Clerk's office) that correspondence sen t
to individual council members (not sent to "slocitycouncil@slocity .org") has not been
transparently posted to the City Clerk's website . This, after I uncovered and provided tw o
such emails to city staff--one, from a county supervisor .
Should a county supervisor weigh-in on our new council member without knowledge o f
the public ?
The City has affirmed that transparency is of importance in this matter, howeve r
correspondence sent to individual council members has not been transparent even when i t
has involved city owned council email addresses ("@slocity .org")which are publi c
records .
Where correspondence has occurred with individual council members, now is the time t o
release and post such correspondence .
