Attached, please find two letters of correspondence to the Council which I believe should have been disclosed publicly (both on their own, and as a target of my PRA request). The first letter was clearly sent to all four council members using thei r city provided email addresses . This qualifies as a public record . Additionally, it appears that correspondence not sent to th e "slocitycouncil@slocity .org<mailto :slocitycouncil@slocity .org>" emai l address is not posted by the Clerk . I have heard from others that say thei r emails have not appeared . The second letter in my attachment is from a prominent and influentia l local politician to all four council members . Influential letters are bein g withheld from the public in a matter where the City claims 'transparency'. Thank you for your concern . Kevin P . City Council : It has come to my attention (http :llslovoice.orgl ) that because council member Jan Marx has run for and been elected Mayor that her forme r council seat is now open and will be filled by a vote of the other council members instead a vote of the citizens of San Luis Obispo . Is this not a n affront to democracy? Given this undemocratic situation the only fair and just course of action for the council is to appoint the candidate with the next highest votes in th elast election, Dan Carpenter . She would have been an excellent addition , but I am pleased to keep her on at the County . Good luck on your appointment process No doubt you'll have several strong candidates, and I understan d that Dan Carpenter and his allies have been pushing strongly Which is good as Dan certainly has bee n very involved in city committees and boards, and thus, is deserving . I have known Patty for more years than I recall, both socially and professionally ; I have appeared before her in arbitration, and have helped wit h her various campaigns for public office. Her intelligence and critical thinking abilities always continue to impress me . She has done her homework and is prepared to back up her position ; yet she i s willing to consider new evidence, remaining flexible and pragmatic i n reaching a final decision . I have found her prime consideration to be, ho w does this benefit the larger good ? On the other hand, when not engaged in social or legal debate, you'll find Patt y has a wicked sense of humor and easy to work with, doing more than her fai r share, and, just as importantly, she radiates an infectious feeling of joy in al l her activities . She would be an excellent choice to represent SLO residents on the city council . You are one o f dozens of citizens who have done so . In many cases, comments have centered o n criticism of the provisions of the City Charter that imposes this responsibility on th e Council . Let me assure everyone that I have not made up my mind at this point as to which o f the three candidates are best qualified for this position . To my knowledge (an d because of the Brown Act, I have very limited knowledge), none of my colleague s have committed in support of any individual candidate . Nor should we, if we are to respect the spirit of our Council policies and procedures . You can be sure that I will carefully consider all factors involved in this decision, and I will give due consideration to the input of all citizens who have contacted us , including those who will speak on Tuesday evening . I will ultimately make my ow n decision only after all testimony and evidence have been provided, and in deliberatio n with my colleagues . As to the process set forth in the Charter, it has served the City well in the past . Goo d people have been selected, and the City has benefitted from their service .If anybod y wishes to place an amendment to our charter to modify this system, I will conside r that proposal with an open mind . As of now, however, this process is what we ar e required to observe, and I'll do my best to discharge my duty . Among those duties i s the need to maintain an open mind through and including the public hearing . Additionally, let me assure you that the main factor that I will use in making thi s decision is NOT my own individual assessment of which candidate comes closest t o my own political views, but rather which candidate would best help the Council t o reflect the diverse interests of our community . I know all of the candidates and hav e had productive conversations with each . I would also hope that none of the candidates are subject to any unwarrante d personal attacks, although I have no control over this . Anyone who puts their "hat i n the ring" for a Council office must be ready to be criticized . We will be successful in this process if, when it is concluded, the following can b e said by those who observe the testimony, the deliberations, and the vote : Th e Council was fair to all concerned ; they sincerely considered the best interests of th e entire community; and they carefully weighed the relative contributions that eac h candidate can make to the collaborative process that we have come to expect fro m our Council .
