Thank you very much in talking the time to meet with Mike and me today. I think the conclusion of the meeting, that
Ordinance J101.6 makes sense for in -fill grading on individual lots, but not for projects where there is a Tentative Map
required and the opportunity for project -specific Conditions of Approval, addresses the confusion we have felt regarding
this ordinance.
My initial thoughts regarding the proposed revisions to Ordinance J101.6 ( below) that may be recommended to the City
Council tomorrow night is that this change should cover what we discussed today. My only other comment currently
would be that "natural state", for projects that don't involve a Tentative Map, is still confusing and would benefit from
some further definition and clarification. That said, I know most of the development community's concerns will be
addressed with your proposed revisions.

I'd like the opportunity to bounce Hal's proposed revisions off of a few more people and provide you with any further
comments by noon tomorrow.

Gentlemen,
Here are the changes to J101.6 that Hal came up with...
J101.6 Special grading standards. The topography of a site proposed for development shall
remain substantially in its natural state. Mass recontouring shall not be allowed. In all cases, the
average cross slope of a site shall be determined prior to any grading operations or approval of any
grading plan. Where a site does not slope uniformly, the building official or city engineer shall
determine average cross slope by proportional weighting of the cross slopes of uniformly sloping
subareas. The percentage of the site, exclusive of building area, to remain in its natural state, �Re
shall be in accordance with Table J101.6.
All graded planes shall be rounded on all edges to blend with natural slopes. The rounded edges
shall have a radius equal to one-half the height of the cut or fill slope.
Exception: Grading specifically approved and/or conditioned in conjunction with a tentative
subdivision map, development proposal, or similar entitlement is not subject to the specific grading
limitations noted in this section.
